established as a not-for-profit enterprise in order
to fill a void that was experienced by lawyers, China
scholars, academics, journalists, and foreign governments.
Its aim is to provide accurate, and up to date translations
of Chinese laws and regulations, as well as some political,
social, and economic news about China in English. Because
Chinese is the controlling language for all legal matters
in China, Chinese versions of each of the laws are accessible
through links on the same page as the English version. |

Chinese law is for the most part, opaque, difficult to find,
and can involve internal administrative regulations not available
to the public. This is the point we are trying to make by
including the hammer and sickle of the Chinese Communist Party
in our emblem. It is very important to understand that even
within the context of Chinese law, the Communist Party reigns
supreme, and as far as the party leadership is concerned,
the law should not be used as a tool to subvert the party's
leadership. Although the legal environment has been changing
for the better during the last few of years, the fact that
the Chinese Communist Party's main goal is the continuation
of its leadership, often interferes with a more transparent
and free legal system.
Nonetheless, we hope to present a comprehensive data base
of Chinese laws and regulations that are easily accessible
by browsing the pages of our site, and without the need
to access a multitude of sites, books and Chinese language
CD-ROM's. We have also gone to great lengths to make the
translations of Chinese laws and regulations available to
those who would otherwise not be able to read them. By providing
accurate translations, we give the decision making responsibilities,
back to those who normally would be relying solely on Chinese
linguists to provide you with the information you need.
Both current and superseded laws remain available, as sometimes
this is important in understanding legal reforms in China,
and more importantly because the courts and administrative
agencies in distant provinces may not be aware of changes
in regulations, and may in fact, apply the old rules and
regulations for a variety of reasons. Therefore we believe
that it is important to be aware of these superseded laws
and their importance to understanding the current legal
environment.
In addition to providing both English and Chinese versions
of of Chinese law, when applicable, we also have provided
a link to commentaries concerning each of the applicable
statutes and administrative regulations. We have done this
because often in China, national policy, foreign affairs,
propaganda campaigns, or strict Communist Party authority,
trumps the law, and experience has shown that many laws
and regulations are often selectively applied or upheld.
Furthermore, because of the lack of transparency and equitable
justice, we feel it is important to demonstrate how popular
laws have been applied in the past, and when they have been
upheld, as well as the intricacies and difficulties experienced
by other lawyers when dealing with such laws or regulations.
Chinese courts also commonly face interference from local
or central authorities, and the appeals process is often
simply a rubber stamp by higher governmental authorities
who desire a specific outcome.
