Article 1. These Provisions are formulated in accordance with the "Price Law of the People's Republic of China", the "Telecommunication Regulation of the People's Republic of China", the "Provisions on Marking Clearly Prices of the Commodities and Services" of the State Development Planning Commission in order to regulate the pricing acts of telecommunication business operators, improve the measures on administration and supervision of the clear marking of prices of telecommunication services, maintain the lawful rights and interests of telecommunication users and business operators, and promote the fair, open and lawful competition on the telecommunication market. Article 2. These Provisions shall apply to the pricing acts of the telecommunication business operators who provide telecommunication services inside the territory of the People's Republic of China and the organizations and individuals who are entrusted by them to operate the telecommunication business (hereinafter referred to telecommunication business operators). Article 3. "Marking prices clearly" mentioned in these Provisions shall mean the telecommunication business operators' act of indicating clearly the prices of telecommunication services and other relevant contents to the public required by these Provisions when they are providing telecommunication services. The prices marked for all telecommunication services shall be clearly no matter they are subject to market regulation, governmental guidance or government determination. Article 4. Telecommunication business operators shall, when marking clearly prices, comply with the principles of openness, fairness, honesty and credibility, and abide by the laws, regulations and policies concerning price affairs. Article 5. The government department in charge of price affairs is the administrative organ for the clear marking of prices, and its institution for supervision and inspection of price shall be responsible for the supervision and inspection of the implementation of the clear marking of prices of telecommunication services. The department in charge of the information industry under the State Council and the administrative organ for telecommunication of each province, autonomous region or municipality directly under the Central Government shall assist the government department in charge of price in the supervision and inspection of the clear marking of prices of telecommunication services. Article 6. The methods for clearly marking the prices of telecommunication services shall be uniformly stipulated by the government department in charge of price affairs at the provincial level. The production of the price marks shall be supervised by the institution for supervision and inspection of price affairs under the government department in charge of price affairs. No entity or individual may unlawfully print or make the price marks with the production of which having not been supervised. Article 7. For the sake of marking clearly the prices of telecommunication services, the price list shall be complete, the contents marked shall be authentic and definite, the writing shall be clear and normative, and the indication shall be eye-catching. If the prices of telecommunication services are indicated in characters (including charts), their Renminbi amount shall all be indicated in Arabic numerals. Article 8. The contents of the clear marking of the prices of telecommunication services shall include: service items, rates, principles for calculating fees and approval number. Article 9. The following methods may be adopted for clearly marking the prices of telecommunication services: (1) announcement, public notice column, public notice bulletin, public notice wall; (2) price list, handbook of charge rates; (3) price calculator for public telephone; (4) internet inquiry, multi-media terminal inquiry; (5) voice messaging; (6) telephone rate list; (7) other methods admitted by the public. A telecommunication business operator shall, if marking clearly the prices by means of internet inquiry or voice messaging, publicize to the telecommunication users the inquiry methods and the telephone number for serving clients. Article 10. A telecommunication business operator shall marking clearly the prices on an eye-catching position in its business site or business agency, and shall provide free inquiry of prices of telecommunication services at the places convenient to the users. Article 11.Where a telecommunication business operator provides telephone information services, it shall publicize the items and prices of all information services, and shall, once a user has connected the information station, transmit the indication voice on the charge rates. A telecommunication business operator shall, if providing other service items under separate charge besides the basic telephone rates, publicize such service items and the prices thereof. Article 12. A telecommunication business operator shall, when providing man-watched public telephone services, clarify the service items and prices on an eye-catching position at the serving place, and shall keep the screen of the price calculator of the public telephone facing the users. Article 13. A telecommunication business operator shall indicate clearly the items and scope of free emergency telephone and other telephone services it provides. Article 14. In case of price adjustment for telecommunication services, the telecommunication business operators shall adjust the prices accordingly in time, and shall reserve the records on the change for verification. Article 15. A telecommunication business operator shall, for the sake of marking prices clearly, announce the telephone number for price reporting, which is "12358", so as to facilitate the masses to carry out supervision. Article 16. No telecommunication business operator may make use of false or misleading price marking contents or methods to commit price frauds, nor may it charge any unmarked fees apart from the marked prices. Article 17. A telecommunication business operator who does not mark prices clearly in accordance with the relevant provisions or who makes use of the marked prices to commit price frauds, shall be punished by the government department in charge of price in accordance with the "Price Law of the People's Republic of China", the "Provisions on the Administrative Punishments Against Acts in Violation of Price Laws", the "Provisions on Marking Prices Clearly of the Commodities and Services", or the "Provisions on Prohibiting Price Fraud Acts". Article 18. These Provisions shall come into force on August 1, 2002. These Provisions shall be taken as the standard for the contents on clearly marking the prices of telecommunication services. |
