ADMINISTRATIVE MEASURES FOR THE LAND APPRAISER QUALIFICATION EXAMINATION
 
(Order of the Ministry of Land and Resources (No. 35[2006]), November 22, 2006: The Administrative Measures for the Land Appraiser Qualification Examination, which have been deliberated and adopted at the fifth executive meeting of the Ministry of Land and Resources on November 20, 2006, are hereby promulgated and shall come into force as of January 1, 2007.)

CHAPTER I GENERAL PROVISIONS

Article 1. For the purpose of regulating the order of land appraiser qualification examination, strengthening the construction of professional land appraiser team, and enhancing the quality and professional level of land appraisers, these Measures are formulated according to the Law of the People's Republic of China on Urban Real Estate Administration, the Land Administration Law of the People's Republic of China and the Regulation on the Implementation of the Land Administration Law of the People's Republic of China.


Article 2. The State will implement a land appraiser qualification authentication system. No one can obtain a land appraiser qualification until he passes the national land appraiser qualification examination.


Article 3. The land appraiser qualification examination shall be governed by the principles of objectivity, fairness and fair competition.



CHAPTER II REQUIREMENTS FOR EXAMINATION APPLICATION

Article 4. Any citizen of the People's Republic of China who has the full civil capacity, abides by laws and disciplines, and meets any of the following requirements may sign up for the land appraiser qualification examination:

(1) Having obtained a diploma from a junior college, and having engaged in the relevant work for more than two years;

(2) Having obtained a bachelor's degree, and having engaged in the relevant work for more than one year; or

(3) Having obtained a doctoral degree, master's degree, the second bachelor degree, or graduated from a graduate class.

Anyone who does not meet the State-accredited academic or degree requirement as prescribed in (1), (2) or (3) but has a relevant State-accredited medium or higher professional technical title may also sign up for the land appraiser qualification examination.


Article 5. Anyone who is under any of the following circumstances can not sign up for the land appraiser qualification examination; and if he has gone through the formalities for signing up the examination, his examination application shall be invalidated:

(1) He is subject to criminal liabilities due to intentional crime or there is no five years from the completion of his criminal penalty to the day when he signs up for the examination;

(2) There is no five years after his land appraiser qualification has been revoked;

(3) There is no two years after his examination qualification has been revoked; or

(4) He is given an administrative punishment or an administrative sanction of dismissal from the post or a heavier one, and there is no two years from the date of punishment or sanction to the day when he signs up for the examination.


Article 6. When signing up for the examination, an applicant shall faithfully fill out application forms, and submit the following materials:

(1) the original of his valid and effective identity certificate, and its photocopy;

(2) the original of his diploma or degree certificate, or professional technical title certificate, and its photocopy; and

(3) the certificate on his relevant work experiences.

In case an applicant entrusts someone else to sign up for the examination, the original of the valid and effective identity certificate of the trustee, its photocopy and a power of attorney shall be submitted together with the aforesaid materials.

An applicant shall be responsible for the authenticity of the materials he submits.



CHAPTER III EXAMINATION

Article 7. The Ministry of Land and Resources will organize the national land appraiser qualification examination council for coordinating and deciding significant matters concerning the land appraiser qualification examination.


Article 8. The Land Appraiser Association of China shall specifically organize and implement the work on land appraiser qualification examination according to the decisions made by the national land appraiser qualification examination council.


Article 9. The land appraiser qualification examination will be held once in a year, and be held simultaneously in all the examination centers in the third quarter every year. The specific time for examination will be determined by the national land appraiser qualification examination council.


Article 10. The land appraiser qualification examination is mainly to check the professional knowledge on land appraisal and the practicing ability an examinee should have.

The contents of land appraiser qualification examination include:

(1) Basic knowledge on land administration;

(2) Land appraisal theory and methods;

(3) Economic theory and methods on land appraisal; and

(4) Land appraisal practice.


Article 11. The land appraiser qualification examination questions shall be uniformly set according to the examination outline.


Article 12. The land appraiser qualification examination shall be taken in a closed-book form. An applicant can freely choose examination subjects and their number. And the results of each examination subject will be valid within the three consecutive examination years.


Article 13. All the land appraiser qualification examination papers shall be uniformly marked throughout the country. The results for each subject will be released within three months upon completion of the examination by the Ministry of Land and Resources via the Practicing Information Publicity System for Land Appraisal Institutions and Practitioners.


Article 14. An examinee who has passed all the subjects within three consecutive examination years can obtain a Land Appraiser Qualification Certificate of the People's Republic of China, and obtain a land appraiser qualification.



CHAPTER IV EXAMINATION AFFAIRS

Article 15. The land appraiser qualification examination centers shall be set up according to the province, autonomous region or municipality directly under the Central Government. The administrative departments of land and resources of all provinces, autonomous regions or municipalities directly under the Central Government shall, under the leadership of the national land appraiser qualification examination council, organize the implementation of the following examination affairs:

(1) Releasing examination announcements;

(2) Organizing the examination application and handing out admission tickets;

(3) Arranging examination centers and examination rooms;

(4) Implementing examination safety and confidentiality measures;

(5) Offering assistance to the implementation of examination invigilation; and

(6) Carrying out other matters concerning the examination.

The administrative department of land and resources of each province, autonomous region or municipality directly under the Central Government may entrust the aforesaid examination affairs to the local land appraiser association.

Where it is necessary to adjust examination centers due to a special circumstance, it shall be decided by the national land appraiser qualification examination council.


Article 16. An examinee shall handle the formalities for examination application at a place as announced by the administrative department of land and resources of the province, autonomous region or municipality directly under the Central Government.


Article 17. In case an examination functionary is a close relative of an examinee or has any other kind of interests with the latter, he shall apply for withdrawal.



CHAPTER V LEGAL LIABILITIES

Article 18. If an examinee is under any of the following circumstances, the administrative department of land and resources at or above the provincial level shall, in light of the circumstances, respectively impose a punishment of warning, announcement of examination results as invalid, or forbidding the examinee to sign up for the national land appraiser qualification examination again within two examination years:

(1) Signing up for the examination by providing false certification materials or by frauds in other forms;

(2) Asking someone else to take the examination under his name;

(3) Disturbing the order of examination center or examination room, or threatening the personal safety of examination functionaries; or

(4) Resorting to cheats during the process of examination.

If any person who has obtained a Land Appraiser Qualification Certificate of the People's Republic of China is under any of the circumstances prescribed in the first paragraph, his land appraiser qualification shall be cancelled.


Article 19. If an examination functionary is under any of the following circumstances, he shall be given an administrative sanction:

(1) Helping any person who has not the qualification for examination application to sign up for the examination;

(2) Failing to withdraw when he should do so;

(3) Illegally changing the time for examination;

(4) Divulging examination questions or other confidential information about the examination;

(5) Covering up for or conniving an examinee to cheat; or

(6) Altering scores.



CHAPTER VI SUPPLEMENTARY PROVISIONS

Article 20. A land appraiser who has obtained a land appraiser qualification and is practicing in a land appraisal institution shall pass the practice assessment and go through the practice registration.

Only a land appraiser whose practice has been registered can sign his name on land appraisal reports and assume legal liabilities.

The practice assessment and registration shall be specifically implemented by the Land Appraiser Association of China.


Article 21. A land appraiser whose practice has been registered may provide such land appraisal services as the evaluation or judgment of or consultation about the price or value of relevant rights and interests on land as well as its adhesions and fixtures.


Article 22. Any land appraiser who has obtained a Land Appraiser Qualification Certificate of the People's Republic of China according to law and has begun to practice shall be subject to the self-disciplinary management of the Land Appraiser Association of China.


Article 23. These Measures shall come into force as of January 1, 2007.
