NOTICE OF THE HUMAN RESOURCE DEPARTMENT OF THE STATE COUNCIL AND THE MINISTRY OF LAND RESOURCES CONCERNING THE PROFESSIONAL QUALIFICATION CERTIFICATION FOR LAND REGISTRATION AGENTS

In accordance with the Interim Provisions on the Professional Qualification System for Land Registration Agents (No. 116 [2002] of the Human Resources Department and Ministry of Land and Resources) issued by the Human Resources Department of the State Council and the Ministry of Land and Resources, and the demand of practical work, a decision has been made upon deliberation to conduct land registration agent qualification certification for the technical professionals who have long been engaged in land registration or agency thereof and have both high theoretical level and rich practical experience. The relevant issues are hereby notified as follows:


I. CONDITIONS OF APPLICATION

An applicant shall have long been engaged in land registration or agency by the day of distribution of the present Notice, assume a senior professional technical position, observe laws, disciplines and professional ethics, enjoy good health, have not reached the age of 70, and meet the conditions in both (1) and (2) of the following conditions.

(1) Meeting one of the three conditions as follows:

1. Completion of technical secondary education before December 31st 1978, and at lease 25 years of accumulative engagement in land registration or agency or the relevant business;
2. Completion of junior college education before December 31st 1983 and at least 18 years of accumulative engagement in land registration or agency or the relevant business; or
3. Completion of undergraduate education before December 31st 1987 and at least 15 years of accumulative engagement in land registration or agency or the relevant business.

(2) Meeting two of the following conditions at the same time:

1. As a principal technical officer, having drafted at lease one norm, rule or provision which is promulgated and implemented by the state;
2. As a principal technical officer, having completed at lease one initial land registration case at the prefecture level or above;
3. As a principal technical officer, having completed at lease ten land registration agency cases during the transformation of large enterprises;
4. As a principal technical officer, having made, in the ministerial-level land registration project or the relevant agency operation, at lease one research achievement which have been applied in actual work;
5. Being a principal technical officer of the project which is awarded the state-level prize for scientific and technological progress in the field of cadastral management;
6. Being a principal technical officer of two or more projects which are awarded the second-class or higher prizes at the provincial or ministerial-level for science and technological progress;
7. Having independently completed two or more papers (at least 2000 words each) on land registration, agency, or other related fields, which have been published in the newspaper(s) or magazine(s) with Uniform Domestic Magazine Number (CN), or on the overseas newspaper(s) and magazine(s) with International Standard Serial Number (ISSN); and/or
8. Having independently written at lease 30,000 words in a monograph on cadastral management, land registration, etc. which is published by an officially recognized press and obtains an International Standard Book Number (ISBN).


II. ORGANIZATION FOR CERTIFICATION

The Ministry of Personnel and the Ministry of Land Resources will jointly establish a leadership team on the professional qualification certification for land registration agents (hereinafter referred to the Leadership Team; see the list of members in Attachment 1), which is in charge of the certification of professional qualification for land registration agents throughout the country. An office (in the Ministry of Land Resources) is set up under the Leadership Team.


III. PROCEDURE FOR CERTIFICATION

(1) A professional technical person who meets the conditions of application may file to the organization where he or she belongs an application, which will, after being examined and consented to by the said organization, be submitted to the land resources administration department of the province, autonomous region, or municipality directly under the Central Government where the organization is located.

(2) The land resources administration departments of all provinces, autonomous regions, and municipalities directly under the Central Government will conduct preliminary examination over the qualification of applicants within their respective localities, and with the verification and approval of the personnel administration department at the same level, submit to the Office of the Leadership Team the list of qualified persons surviving the preliminary examination and the application documents.

(3) An applicant for certification shall submit the following documents:

1. The Application Form of the People's Republic of China on Professional Qualification Certification for Land Registration Agent in duplicate (see Attachment 2);
2. Photocopies of the following certification documents: the certificate of school education (degree), the certificate of senior professional technical position, the certificate of prize(s), the major signed documents certifying the prize-winning project(s), the document on the appointment of principal technical officer for relevant projects, the cover of the norm, rule or provision and the page for the list of drafters, the work report on the initial land registration projects at the prefecture level or above, the research report on the ministerial-level land registration project or the relevant agency operation, and the first page of the papers or monograph; and
3. Original documents: Proof of the professional ethics in the land registration or agency business issued by the unit where the applicant is working at, Proof of being in-charge of the technical issues of any award-winning projects issued by the award-winning units, Land registration business norms, rules or regulations description materials issued by the State, proofs of research achievements of a ministerial-level project on land registration or agency operation

(4) The Office of the Leadership Team verifies the list of qualified persons surviving the preliminary examination submitted by each locality and department, proposes the list of certified persons, and submits it to the meeting of the Leadership Team for discussion.

(5) The list of qualified persons discussed and adopted by the meeting of the Leadership Team and receiving no objection during its pre-announcement will be announced to the public upon the approval of the Ministry of Personnel and the Ministry of Land Resources.


IV. DEADLINE AND REQUIREMENTS FOR APPLICATION

(1) The land resources departments (bureaus) and the personnel departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government shall submit the list of qualified persons surviving the preliminary examination and the application documents to the Office of the Leadership Team before November 31st 2003.

(2) The state applies totality control to the certified persons. Priority should be given to recommending the professional technical persons who meet the conditions of application and have engaged in the front line of land registration agency.

(3) The land resources departments (bureaus) and the personnel departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government shall, during the examination and verification of the qualification of the applicants, check the originals of all certificates, achievements, etc. that are designated as the conditions of qualification. During the submission of applications to the Office of the Leadership Team, the originals and photocopies of the relevant documents shall be submitted in accordance with the present Notice; the person in charge of the personnel division of the organization where the applicant belongs should sign opinions on the authenticity of the submitted documents and annex the seal of the organization.

(4) A person who has obtained other professional qualification certificate(s) through appraisal or certification or works as a civil servant may not apply for the professional qualification certification for land registration agent.

(5) All localities should strengthen the leadership, uphold the standard, tighten the requirements, and handle well the application, examination and verification. An organization or person found to have neglected his / her duty or committed fraud or falsification will be disqualified for the application right or the application qualification.
