CIRCULAR OF THE MINISTRY OF COMMUNICATIONS ON INTENSIFYING THE SUPERVISION OF BUSINESS QUALIFICATION OF INTERNATIONAL SHIPPING TRANSPORTATION

According to the provisions of the Regulation of the People's Republic of China on International Marine Transportation (hereinafter referred to as the Regulation on International Marine Transportation), those enterprises that engage in the business operation of international shipping transportation shall meet the prescribed requirements and obtain a Business License of International Shipping Transportation as issued by this Ministry. Those enterprises that have obtained the qualification of business operation of international ship transportation shall strictly abide by the provisions of relevant laws and regulations of the state and the Regulation on International Marine Transportation and perform their operations according to law.

Those enterprises that meet the requirements of the qualification of business operation of international ship transportation shall, within 30 days before the expiration of the valid term of the Business License of International Ship Transportation, apply to this Ministry for extension via the local administrative department of communications of the province, autonomous region or municipality directly under the Central Government. Where any enterprise fails to handle the formalities for extension, it shall be deemed as an automatic quit and the said enterprise shall not engage in any business operation of international ship transportation any more. Those enterprises that no longer have the qualification to operate international ship transportation shall, with 15 days as of the termination of the qualification thereof, apply to this Ministry for writing off the qualification of business operation via the local administrative department of communications of the province, autonomous region or municipality directly under the Central Government and shall not engage in any business operation of international ship transportation.

The administrative departments of communications at all levels shall attach importance to the basic administration of the supervision of the international marine market, intensify the supervision and control of the market and regulate the business operation of the relevant enterprises. For those enterprises that fail to go through the formalities for extension or no longer have the qualification of operating international ship transportation, the local administrative department of the province, autonomous region or municipality directly under the Central Government shall report the relevant information on the enterprises to the Ministry of Communications, and this Ministry shall revoke the qualification thereof and write off the Business License of International Ship Transportation upon investigation and verification. The list of enterprises that engage in international ship transportation shall be updated on the website of this Ministry in a timely manner so as to facilitate the inquiry and supervision.

In order to further the archival filing of the enterprises that engage in international ship transportation and intensify the supervision of the qualification of business operation of international ship transportation, we hereby notify the relevant requirements as follows:

(1) The online archival filing system of international marine transportation is one of the important means for this Ministry and the relevant administrative departments of communications of local people's governments to obtain the relevant information on the industry and enterprises and the shipping capacity as well, and carry out effective supervision of the qualification of business operation of international ship transportation. The enterprises that engage in the international ship transportation shall attach great importance to the online archival filing.

(2) The enterprises that engage in the international shipping transportation shall, before July 30 of the curret year, according to the requirements of the Circular on Initiating the Online Archival Filing System of International Marine Transportation (No. 497[2004] of the Ministry of Communications), fill in the relevant information of the enterprises and vessels in a faithful and intact manner and carry into effect the updating of online archival filing by a special person in a timely manner.

(3) Under any circumstance as prescribed in Article 23 of the Regulation on International Marine Transportation, those enterprises that engage in the international ship transportation shall update the relevant information in the online archival filing system of international marine transportation within the prescribed period.
