	CIRCULAR OF THE MINISTRY OF FINANCE ON MODIFYING THE "MEASURES FOR THE ADMINISTRATION OF SUBSIDY FUND FOR FOREIGN INVESTMENT IN ENVIRONMENT CONSTRUCTION"

In order to further regulate the administration on subsidy fund for foreign investment in environment construction, this Ministry decides to make modification on the scope of use of the fund after deliberation, and hereby makes the following notice on the relevant issues concerned,

I. Article 4 of the "Measures for the Administration of Subsidy Fund for Foreign Investment in Environment Construction" (No. 174 [2002] of the Ministry of Finance) shall be modified as: The subsidy fund shall be used specially for the compensation, arrangement, and resettlement involving the land used by the enterprises with foreign investment, as well as the construction of the relative public establishment for improving foreign investment environment.

II. All the local financial departments shall strictly arrange for the use of the fund according to its purpose as prescribed, and no alteration or extension on the scope of use of the fund shall be permitted without approval.

III. The sources of the subsidy fund for foreign investment in environment construction shall come from the site use fees of enterprises with foreign investment at the central level, which are turned in to the Central Finance by all the provinces, autonomous regions, municipalities directly under the Central Government, and cities directly under State planning. The financial departments at all levels shall strengthen the management of collection of the site use fees of enterprises with foreign investment, so as to ensure that the financial revenue be brought into the treasury in time and in full amount.

IV. This Ministry shall take the income of site use fees of enterprises with foreign investment, which are turned in to the Central Finance by local governments, as the basis for making the fund budget.

V. The present Circular shall be implemented as of its promulgation. And Article 4 of the "Measures for the Administration of Subsidy Fund for Foreign Investment in Environment Construction" (No. 174 [2002] of the Ministry of Finance) shall be repealed simultaneously.
