SUPPLEMENTARY PROVISIONS FOR THE PROVISIONS OF FOREIGN INVESTMENT IN CIVIL AVIATION (IV)

According to the Supplementary Agreement VII to Mainland and Hong Kong Closer Economic Partnership Arrangement and the Supplementary Agreement VII to Mainland and Macao Closer Economic Partnership Arrangement, which were approved by the State Council, we hereby supplement the Provisions on Foreign Investment in the Civil Aviation Industry (Order No.110 of the Civil Aviation Administration of China, the Ministry of Foreign Trade and Economic Cooperation and the State Planning Commission) as follows:


I. Hong Kong and Macao service providers are allowed to provide aircraft maintenance services in the Mainland by making sole investment or holding controlling shares.


II. Hong Kong and Macao service providers mentioned in the present Provisions shall meet the definitions and the corresponding requirements in the "Mainland and Hong Kong Closer Economic Partnership Arrangement" and the "Mainland and Macao Closer Economic Partnership Arrangement" respectively.


III. The power to interpret these Supplementary Provisions shall remain with the Civil Aviation Administration of China, Ministry of Commerce of the People's Republic of China and the National Commission of Development and Reform according to their respective functions.


IV. These Supplementary Provisions shall come into force as of January 1, 2011.
