The State Environmental Protection Administration decided at its executive meeting to make the following revisions to the Measures for the Administrative Penalties for Environmental Protection (Order No. [1999] 7 of the State Environmental Protection Administration):
1. The "environmental inspection institute" mentioned in Article 10 shall be revised as "environmental supervisory organ". After the revision, Article 10 shall read as follows:
"Article 10 The administrative department in charge of environmental protection may, within the scope of its functions and powers, authorize an environmental supervisory organ to impose administrative penalties. The authorized environmental supervisory organ shall, within the scope of authorization, impose administrative penalties in the name of the authorizing administrative department in charge of environmental protection.
The authorizing administrative department in charge of environmental protection shall make supervision on the authorized environmental supervisory organ' acts of imposing administrative penalties and shall be responsible for the legal effects of such acts."
2. The limits of the amount of a fine imposed by local environmental protection authorities as specified in Article 17 shall be recalled. After such revision, Article 17 shall read as follows: "Article 17 The limits of authority of the administrative departments in charge of environmental protection at different levels for imposing fines shall be determined according to the laws, regulations, and regional regulations and rules concerning environmental protection."
The present Amendment shall come into force as of the date of promulgation.
