	SUPPLEMENTARY PROVISIONS OF THE SUPREME PEOPLE'S COURT AND THE SUPREME PEOPLE'S PROCURATORATE ON IMPLEMENTING THE ACCUSATIONS DEFINED IN THE CRIMINAL LAW OF THE PEOPLE'S REPUBLIC OF CHINA (II)

	(Announcement of the Supreme People's Court and the Supreme People's Procuratorate (No. 12 [2003] of the Supreme People's Court), August 15, 2003: The Supplementary Provisions of the Supreme People's Court and the Supreme People's Procuratorate on Implementing the Accusations As Defined in the Criminal Law of the People's Republic of China (II) have been passed by the judicial committee of Supreme People's Court at the No.1283 meeting on August 6, 2003, and the tenth procuratorial committee of the Supreme People's Procuratorate at the seventh meeting on August 12, 2003, are hereby promulgated, and shall be implemented from August 21, 2003)

In order to determine the accusation uniformly, we hereby make the following supplement and modifications on the Provisions of the Supreme People's Court on Implementing the Accusations As Defined in the Criminal Law of the People's Republic of China, the Opinions of the Supreme People's Procuratorate on Applying the Accusations Prescribed in the part of "Specific Provisions" of the Criminal Law of the People's Republic of China, and in light of the provisions of the Amendments to the Criminal Law of the People's Republic of China (IV) (hereinafter refer to the "Amendment to the Criminal Law (IV) "):

Articles in the Criminal Law: Paragraph 2 Article 152 (Article 2 of the Amendments to the Criminal Law (IV))
Accusation: Crime of waste smuggling (abolishing the accusation of "Crime of solid waste smuggling" prescribed in the former item 3, Article 155 of the Criminal Law)

Articles in the Criminal Law: Paragraph I of Article 244 (Article 4 of the Amendments to the Criminal Law (IV))
Accusation: Crime of employing child labor to engage in the critically dangerous work

Articles in the Criminal Law: Article 344 (Article 6 in the Amendments to the Criminal Law (IV))
Accusation: Crime of illegally lumbering and destroying the key plants protected by the State; Crime of illegally purchasing, transporting, processing and selling the key plants protected by the State, the key plant produce protected by the State (abolishing the accusation of the Crime of illegally lumbering, destroying the valuable trees)

Articles in the Criminal Law: Paragraph 3, Article 345 (Paragraph 3, Article 7 of the Amendments to the Criminal Law (IV)
Accusation: Crime of illegally purchasing and transporting unlawfully felled and denuded trees (abolishing the accusation of the Crime of illegally purchasing unlawfully felled and denuded trees)
