FOREIGN SATELLITE TV CHANNEL DISTRIBUTION IN CHINA APPROVAL ADMINISTRATIVE MEASURES (TRIAL) |

Article 1. These Measures are hereby formulated to strengthen the administration of the landing of overseas satellite TV channels.
Article 2. These Measures shall apply to the administration of the landing within the territory of the Peoples' Republic of China, by the means of satellite transmission, of the radio and television media established outside the mainland of the People's Republic of China.
Article 3. The State Administration of Radio, Film and Television (hereinafter referred to the SARFT) shall be responsible for the centralized administration of the landing of overseas satellite TV channels, and shall apply the system of examination and approval to the landing of overseas satellite TV channels.
Articles 4. Upon the approval of the SARFT, overseas TV satellite channels may land within the prescribed scope such as the foreign-related hotels of three-star level or above, the foreign-related apartments specially provided to overseas persons for office, resident, etc. and other specific scope.
Article 5. An overseas satellite TV channel applying for landing shall meet the following conditions:
(1) The contents broadcasted shall not go against the provisions of the laws, regulations and relevant rules and systems of China;
(2) Having the strength to rank first three in comprehensive strength and audience rating among the television media of its own country (region).
(3) Having the strength to conduct "mutually beneficial and profitable" cooperation with China, promising and actively assisting in the overseas landing of Chinese radio and television programs.
(4) Being friendly to China, and actively promoting the friendly exchange and cooperation of Chinese and foreign radio and television; and
(5) Agreeing to uniformly transmitting the programs of its channel through the agency designated by the SARFT, and promising not to land within the territory of China through any other ways.
Article 6. The overseas satellite TV channel shall file the application for landing with the agency designated by the SARFT first, and fill in the Satellite TV Channel Memo according to the requirements, submit the certifications of contents provided for in Article 5 of these Measures, other materials that need special explanations and the viewing equipments such as decoders, etc.
Article 7. The agency designated by the SARFT shall, after collecting all the application materials provided for in Article 6 of these Measures, submit them to the SARFT for examination and approval.
Article 8. Where the application materials are incomplete, the applicant shall supplement the materials within two weeks from receiving the relevant notification, and the application shall be deemed being given up after the expiration of that period if no supplement is made.
Article 9. The SARFT shall make examination and approval of the applications for landing of overseas satellite TV channels once every year, from July to September of each year.
Article 10. Where an overseas satellite TV channel that has been approved to land within the territory of China fails to sign the agreement with the agency designated by the SARFT within 90 days after the SARFT has approved it, it shall be deemed to automatically give up the qualification for landing.
Article 11. In principle, one overseas satellite TV agency may only approve one of its channels to land within the prescribed scope. No overseas satellite TV channels of news may be approved to land within the territory of China, neither may the satellite TV channels launched overseas by domestic radio and television agencies and the relevant departments and organization be approved to land within the territory of China. A special report for approval shall be required where there is a special need.
Article 12. An overseas satellite TV channel approved to land must entrust the agency designated by the SARFT as an exclusive agent to handle all the relevant matters of its landing within the territory of China.
Article 13. An overseas satellite TV channel approved to land must abide by the provisions of the Chinese government on the administration of overseas satellite television, may not broadcast any TV program containing the contents against the laws, regulations and policies of China, and may not carry out any publicity for its TV channel and the relevant receiving equipments within the territory of China without authorization.
Article 14. If the contents broadcasted by an overseas satellite TV channel approved to land violate the laws, regulations and rules of China and cause bad effect, the broadcasting shall be stopped, and apart from that the bad effect shall be eliminated within the same broadcasting scope.
Article 15. If the contents broadcasted by an overseas satellite TV channel approved to land violate the provisions of laws and regulations of China for 3 times in one year, the qualification for landing shall be cancelled. The overseas satellite TV channel of which the qualification for landing has been cancelled may not file the application for landing within 3 years.
Article 16. These Measures shall come into force as of February 1, 2002.
