MEASURES FOR THE EXAMINATION AND APPROVAL OF THE ENTRY AND EXIT OF MOVIES FILMS FOR DEVELOPMENT AND POST-PRODUCTION |

Article 1. These Measures are formulated according to the Regulation for the Administration of Movies with a view to regulating the development and post-production of movies films outside China and the processing of foreign movies films inside China.
Article 2. These Measures shall apply to the development and post-production outside China of the films and samples (hereinafter referred to Chinese movies films) of Chinese movies including Chinese-foreign joint movies produced inside China or such production inside China as the processing of the films, samples and film copies (hereinafter referred to foreign movies films) of the movies produced outside China.
Article 3. The State Administration of Radio, Film and Television (hereinafter referred to "SARFT") shall be liable for the administration of the processing and post-production of movies films inside or outside China.
Article 4. The entry and exit of movies films for processing and post-production shall be subject to the examination and approval of the SRAFT. Without approval, no one may leave China to process and post-produce any Chinese film or undertake the processing of any foreign film in China.
Article 5. To apply for leaving China to process or post-produce any Chinese movie film, one shall meet following conditions:
(1) The applicant shall have the License for Production of Movies or the License for Production of Movies Films (single film), and the project of the movie for which an application is filed which has been accepted; and
(2) It is really necessary to process and post-produce movie films outside China because of special technical requirements.
Article 6. To apply for leaving China to process or post-produce any movie film, one shall submit the following materials:
(1) The application for processing and post-producing movie films outside China;
(2) The License for Production of Movies or the License for Production of Movies Films (single film) and the copy of the Official Reply on accepting the project of a movie; and
(3) The content and longitude of the movie and technical standards under the special technical requirements.
Article 7. If a film processor undertakes the processing of a foreign movie, the content of the movie shall not violate the Regulation on the Administration of Movies and other laws or regulations of the State.
Article 8. Any film processor who undertakes the processing of a foreign movie shall submit the following materials:
(1) The film processor's application for processing the foreign movie;
(2) The copy of the film processor's Business License;
(3) The letter of intent by and between the foreign principal and the film processor; and
(4) The content of the foreign movie proposed to be processed.
Article 9. The examination and approval procedures shall be as follows:
(1) Any movie-producing unit that applies for leaving China to process and post-produce a movie or any film processor that applies for undertaking the processing of a foreign movie shall file a written application with the SARFT;
(2) The SARFT shall accept, within the time limit specified by the Administrative License Law, the written application that an applier filed; and
(3) If an acceptance is decided, the SARFT shall, within 20 days, make a decision on whether to grant an approval. If an approval is granted, the approval document shall be issued. If an approval is not granted, the reasons shall be explained and the applicant shall be notified in writing.
Article 10. Any applicant who has obtained the approval for leaving China to process and post-produce the films of a movie shall carry out the requirements stated in the approval document and follow the procedures with the customs for entering and leaving China on the strength of the same.
Article 11. Any applicant who has obtained the approval of processing a foreign movie shall transport the processed films, samples and film copies of a movie out of China.
Article 12. These Measures shall enter into force as August 1, 2004.
