	DECISION OF THE MINISTRY OF CONSTRUCTION ON AMENDING THE PROVISIONS FOR THE ADMINISTRATION OF PREVENTION AND CONTROL OF TERMITES IN URBAN HOUSES

	(Order of the Ministry of Construction of the People's Republic of China (No. 130), July 20, 2004: The Decision of the Ministry of Construction on Amending the Provisions for the Administration of Prevention and Control of Termites in Urban Houses, which was discussed and adopted at the 41st executive meeting of the Ministry of Construction on July 13, 2004, is hereby promulgated, and shall come into force on the date of promulgation.)

The Ministry of Construction decides to make the following amendments to the Provisions for the Administration of Prevention and Control of Termites in Urban Houses (Order No. 72 of the Ministry of Construction):

I. Article 7, Article 8 and Article 15 are deleted.

II. Article 13 is amended as: "A real estate development enterprise shall, when selling commodity houses or making advance sales, show the purchasers for the purpose of this project the "Contract on Prevention of Termites" or other testimonials on prevention of termites in houses. The "Letter of Warranty on the Quality of the Dwelling House" it provides must include the warranty contents on the quality of prevention of termites.

A construction entity shall, when going through the house ownership registration formalities, show the real estate administrative department the testimonials on preventing termites in houses in accordance with these Provisions."

III. Paragraph 1 of Article 14 is amended as: "Where any termite damage occurs to a former house or a house whose term of prevention and guaranteed control of termites has already expired, the house owner or user or the house management entity shall entrust a termite prevention and control entity to eliminate the termites."

IV. Article 16 is amended as: "Whoever violates Article 6 of these Provisions to engage in the business of preventing and controlling termites, shall be ordered by the real estate administrative department of the local people's government at the county level or above where the houses are located to make a correction, and may be fined 10,000 Yuan up to 30,000 Yuan, in addition."

V. Article 19 is amended as: "Where any real estate development enterprise violates Paragraph 1 of Article 13 of these Provisions, it shall be ordered by the real estate administrative department of the local people's government at the county level or above where the houses are located to make a correction within a time limit, and may be fined 20,000 Yuan up to 30,000 Yuan, in addition.

Where a construction entity fails to follow these Provisions concerning the prevention and control of termites, it shall be ordered by the real estate administrative department of the local people's government at the county level or above where the houses are located to make a correction within a time limit, and may be fined 10,000 Yuan up to 30,000 Yuan, in addition."

VI. Article 20 is amended as: "Where a house owner or user or a house management entity violates Article 14 of these Provisions, the person who is held liable may be fined 1,000 Yuan by the real estate administrative department of the local people's government at the county level or above where the house is located."

In addition, the sequence of some clauses shall be adjusted accordingly.

This Decision shall come into force on the date of promulgation. The Provisions for the Administration of Prevention and Control of Termites in Urban Houses are amended in accordance with this Decision, and are promulgated once again.
