CIRCULAR OF THE MINISTRY OF EDUCATION ON SIMPLIFYING THE APPROVAL PROCEDURES FOR SELF-FUNDED OVERSEAS STUDIES OF PERSONS WITH AT LEAST TERTIARY EDUCATION QUALIFICATION |

Since 1990, China has practiced the system of examining the qualifications of, and charging the higher education cultivation fee from, the persons holding junior college degrees or above who are pursuing self-funded overseas studies. By and large, various localities have demonstrated the sound and orderly implementation of this system. Throughout the country there have been more than 300,000 self-funded persons going abroad to further their studies, which from a certain perspective indicates the effect that the state has achieved in promoting overseas studies.
After its entry into the World Trade Organization (WTO), China has intensified the efforts in reforming its administrative approval system to fulfill the relevant commitments on trade in services and propel the transformation of government functions. The State Council promulgated the Decision on Canceling the First Set of Administrative Approval Items (No.24 [2002] of the State Council, hereinafter referred to the Decision) on November 1, 2002. In order to further implement the state guidelines of supporting overseas studies, encouraging return to china and granting freedom to come and go, we decide to simplify the procedures for approving self-funded overseas studies of the persons with junior college degrees or above, in accordance with the 77th item of the canceled administrative approval items in the above Decision. The relevant matters are hereby notified as follows:
I. Beginning from November 1, 2002, the higher education cultivation fee will no longer be charged against the university and college students and various types of persons holding junior college degrees or above but having not completed the service term, during their application for self-funded overseas studies; the examination of qualifications for self-funded overseas studies no longer conducted against the above persons; and the above persons no longer required to submit to the local entry-exit administrative organs the Certification of Qualification Examination for Self-funded Overseas Studies;
II. According to the principles and spirit of the Decision, all localities and institutions of higher learning shall refund to the parties or their entrusted legal representatives the higher education cultivation fee for self-funded overseas studies charged after November 1, 2002.
III. To ensure the smooth implementation of this policy, all localities and institutions of higher learning shall intensify their efforts on the relevant work in the spirit of being responsible to the parties applying for self-funded overseas studies and in accordance with the principles of being scientific, reasonable, fair and candid.
IV. The relevant matters involved before and after November 1, 2002 shall be handled in accordance with their respective policy boundaries. For the matters that have not been specified in the provisions, explanations may be given to the parties concerned and instructions shall be sought from the Ministry of Education as soon as possible so that we can conduct the uniform deliberation and handling.
V. All localities shall make proper arrangements for the staff of the former offices in charge of qualifications examination for self-funded overseas studies.
VI. All localities and institutions of higher learning shall handle the subsequent matters and the file keeping in strict compliance with the relevant policies and provisions.
