Regarding Request for Instructions on the Relevant Issues Concerning the Use of Newly-built Docks within the Open Ports (No. 48 (2001) of the People's Government of Guangdong Province, No. 335 (2002) of the General Office of the General Administration of Customs), it is hereby replied as follows:
I. The administrative departments for the ports of the provinces (the autonomous regions, the municipalities directly under the Central Government) shall take a lead in checking the production, safety, and supervision facilities of the new-built foreign trade operation areas or foreign-related docks within the open ports jointly with the relevant entities of border inspection, customs, inspection and quarantine. The qualified ports shall be reported to the people's government of the provinces (autonomous regions, and the municipalities directly under the Central Government) and to the General Administration of Customs for archival purposes. Where it is necessary to add an inspection organ, and to increase the number of inspection personnel, it shall be reported to the State Council for examination and approval via the people's government of the provinces (autonomous regions, and the municipalities directly under the Central Government).
II. The use of a new-built foreign trade operation area or foreign-related dock outside the open ports falls within the scope of opening a port wider to the outside world, it shall be reported to the State Council for examination and approval.
III. In order to further regulate the management and supervision of the ports in opening them to the outside world, the open scope of the open ports not within the designated ones shall be designated by the General Administration of Customs jointly with the Ministry of Public Security, the Ministry of Communications, the General Administration of Quality Inspection, and the people's governments where the Headquarters of the General Staff and commercial ports are located.
