	CIRCULAR OF THE MINISTRY OF CONSTRUCTION AND THE MINISTRY OF RAILWAYS ON FURTHER OPENING THE RAILWAY CONSTRUCTION MARKET

The establishment of a unified, open, competitive and orderly architecture market system is an important task to perfect the socialist market economic system and the basic guarantee to promote the opening and reform of the construction industry and enhance the market competitive capacity of enterprises. In order to continuously perfect the qualification management system of enterprises in the construction industry, further set up reform objectives of the construction industry in conformity with the requirements for developing the market economy, and suit the demands of railway construction, the Ministry of Construction and the Ministry of Railways have decided to further open the railway construction market. We hereby notify as follows:

I. THE OPENING SCOPE OF THE RAILWAY CONSTRUCTION MARKET IN THE NEAR FUTURE

(1) Design: A designing institute with the first-rate design qualifications of highways (including highways, particularly huge bridges and particularly huge tunnels) may engage in the designing work of railway roadbeds, bridges and tunnels. A designing institute with the first-rate design qualifications of coal (mines) may engage in the designing work of railway tunnels. A designing institute with the design qualifications of city tracks may engage in part of the designing work for the front and back parts of railway stations.

(2) Construction: An enterprise with the special-grade qualifications of highway construction may undertake the construction of railway civil engineering projects. An enterprise with the special-grade qualifications of water conservancy and hydroelectricity construction may undertake the construction of railway roadbeds or tunnels. An enterprise with the special-grade qualifications of mine construction may undertake the construction of railway tunnels.

(3) Supervision: A first-rate supervision enterprise that has undertaken the supervision of an expressway project may engage in the supervision of railway civil engineering projects. A first-rate supervision enterprise that has undertaken a large-scale mine project may engage in the supervision of railway tunnel projects. A first-rate supervision enterprise that has undertaken the supervision of a city track project may engage in the supervision of railway projects.

II. OTHER RELEVANT MATTERS

An enterprise with the first-rate design qualifications of highways, coal mines, metallurgical engineering or municipal engineering, which is allowed to enter into the railway construction market this time, shall participate in the bidding of survey and design in light of the first-rate design qualifications of railways. An enterprise with the special-grade construction qualifications of highways, water conservancy and hydroelectricity projects or mines shall participate in the bidding of the general contracting for railway projects or the general contracting for construction in light of the special-grade qualifications of railway construction. An enterprise with the first-rate supervision qualifications of highways, mines (industrial and mining projects) or city track projects, shall participate in the bidding of railway supervision in light of the first-rate qualifications of railway supervision.
