(Order of the State Council of the People's Republic of China (No. 396), December 20, 2003: Promulgated by Order No. 265 of the State Council of the People's Republic of China on May 23, 1999; Revised according to the Decision of the State Council on Amending the Regulation on National Awards for Science and Technology on December 20, 2003. The amendment was the following: Paragraph 2, Article 13 of the Regulations on National Awards for Science and Technology is modified as: "Two classes of awards including the first grade award and the second grade award shall be granted to the National Award for Natural Sciences, National Award for Technological Invention and the National Award for Science and Technology Progress; individuals who make particularly great scientific discovery or technological invention, and individuals or organizations that make outstanding contribution in the process of completing scientific and technological projects, plans or items, which are of special great significance, may be granted top award. CHAPTER I GENERAL PROVISIONS
Article 1. The present Regulation is hereby formulated for the purpose of encouraging the citizens or organizations that have made outstanding contributions to the science and technology progress, mobilizing the activity and creativity of the personnel of science and technology, and accelerating the development of science and technology, as well as improving the comprehensive national strength.
Article 2. The State Council shall establish the following national awards for science and technology:
(1) Top National Award for Science and Technology;
(2) National Award for Natural Sciences;
(3) National Award for Technological Inventions;
(4) National Award for Science and Technology Progress; and
(5) International Science and Technology Co-operation Award of the People's Republic of China.
Article 3. The policy of respecting knowledge and intellectuals shall be carried through in the granting of national science and technology awards.
Article 4. The state upholds the seriousness of the national awards for science and technology.
No organization or individual may illegally interfere with the appraisal and granting of the national awards for science and technology.
Article 5. The administrative department for science and technology of the State Council shall be responsible for organizing the appraisal of state awards for science and technology.
Article 6. The state sets up the National Office of Science and Technology Awards, which shall retain relevant experts and scholars concerned to form an appraisal committee to be responsible for the appraisal of state awards for science and technology in accordance with this Regulation.
The members of the National Office of Science and Technology Awards shall be nominated by the administrative department for science and technology of the State Council and reported to the State Council for approval.
Article 7. The registration formalities for non-state funds for science and technology awards to the public shall be handled at the administrative departments for science and technology. The specific measures for it shall be prescribed by the administrative department for science and technology of the State Council.
No fees may be charged in the granting of awards by using the non-state funds established, upon registration, for the science and technology awards.
CHAPTER II THE ESTABLISHMENT OF THE NATIONAL AWARDS FOR SCIENCE AND TECHNOLOGY
Article 8. The following scientists shall be granted the national top awards for science and technology:
(1) Making great breakthroughs in modern science and technology fronts or having preeminent establishments in science and technology development; and
(2) Producing great economic or social benefits in the innovation of science and technology and the transformation of new technical know-how into productive force, as well as the industrialization of high technology.
The number of persons being granted the national top awards for science and technology shall be no more than 2 persons per annum.
Article 9. The National Award for Natural Sciences shall be granted to the citizens who make great scientific discoveries in setting forth the natural phenomena, characteristics and laws in the basic research and basic aspects of applied research.
The great scientific discoveries mentioned in the preceding paragraph shall meet the following conditions:
(1) Not having been discovered or elaborated by any forerunner;
(2) Having great scientific value; and
(3) Having been recognized by the natural science group both domestically and overseas.
Article 10. The national award for technological inventions shall be granted to citizens who have made great technological inventions on products, craftworks, materials and their systems, etc., by using scientific and technological knowledge.
The great technological inventions mentioned in the preceding paragraph shall meet the following conditions:
(1) Not having been discovered or publicized by any forerunner;
(2) Being advanced and creative; and
(3) Having created obvious economic and social benefits after being put into practice.
Article 11. The National Award for Science and Technology Progress shall be granted to the following citizens or organizations that have made outstanding contributions in applying and popularizing advanced technical know-how to complete major scientific and technological projects, plans, or items, etc.:
(1) Creating obvious economic benefits in actualizing technology development projects for completing great innovation of science and technology and transformation of new technical know-how into productive force;
(2) Engaging in the basic work of science and technology and scientific and technological cause for public interest for a long period of time in actualizing projects for public interest and having created prominent social benefits proved by practice;
(3) Having made great scientific and technological contributions for advancing the construction of national defense modernization and safeguarding the national security in actualizing projects for national security;
(4) Ensuring the projects to reach the international advanced levels in actualizing major engineering projects.
The National Award for Science and Technology Progress to major engineering projects mentioned in item (4) may only be granted to organizations.
Article 12. The international science and technology co-operation award of the People's Republic of China shall be granted to the following foreigners or foreign organizations who have made great contributions to the Chinese scientific and technological undertaking:
(1) Having made great scientific and technological achievements in the research and development through cooperation with Chinese citizens or organizations;
(2) Having especially prominent effects in imparting advanced science and technology to Chinese citizens or organizations and training intellectuals;
(3) Having made great contributions in promoting the international science and technology exchange and cooperation between China and foreign countries.
Article 13. The national top awards for science and technology or the international science and technology co-operation award of the People's Republic of China are not classified into any different grades.
Two classes of awards including the first grade award and the second grade award shall be granted to the National Award for Natural Sciences, National Award for Technological Invention and the National Award for Science and Technology Progress; individuals who make particularly great scientific discovery or technological invention, and individuals or organizations that make outstanding contribution in the process of completing scientific and technological projects, plans or items, which are of special great significance, may be granted top award.
The aggregate number of items of Award for National Natural Science, National Award for Technology Inventions, and National Award for Science and Technology Progress shall not exceed 400 annually.
CHAPTER III THE APPRAISAL AND GRANTING OF THE NATIONAL AWARDS FOR SCIENCE AND TECHNOLOGY
Article 14. The National awards for science and technology shall be appraised once a year.
Article 15. The candidates of the National awards for science and technology shall be recommended by the following entities or individuals:
(1) The people's governments of the provinces, autonomous regions, and municipalities directly under the Central Governments;
(2) The relevant departments of the State Council and the institutions directly under the State Council;
(3) The headquarters of the Chinese People's Liberation Army; and
(4) Other entities and technology experts who are qualified prescribed by the administrative department of science and technology of the State Council upon the determination of the administrative department of science and technology of the State Council.
The candidates of the National awards for science and technology recommended by the recommendation entities listed in the preceding paragraph shall be determined on the basis of the conclusions of appraisal on their science and technology achievements and the suggestions on the kinds and grades of awards made by the relevant technology experts concerned.
The measures for recommending candidates of the national awards for science and technology in Hong Kong, Macao, and Taiwan regions shall be prescribed by the administrative department for science and technology of the State Council.
The embassies or consulates of the People's Republic of China abroad may recommend the candidates of the International Science and Technology Co-operation Award of the People's Republic of China.
Article 16. The recommendation entities or individuals shall recommend the candidates of national awards for science and technology within the quotas; and shall fill in out the recommendation letters in uniform format, and provide real and reliable appraisal documents.
Article 17. The appraisal committee shall draw a conclusion on determination of the science and technology achievements, and propose suggestions on the nominees for the awards and the kinds and grades of the awards to the National Office of Science and Technology Awards.
The National Office of Science and Technology Awards shall, according to the suggestions of the appraisal committee, make decisions on the nominees for the awards and the kinds and grades of the awards.
The rules for the appraisal of National Science and Technology Awards shall be prescribed by the administrative department for science and technology of the State Council.
Article 18. The administrative department for science and technology of the State Council shall make examination and verification on the decisions of the Committee for National Science and Technology Awards on the nominees of the National Science and Technology Awards and the kinds and grades thereof, and report to the State Council for approval.
Article 19. The Top National Award for Science and Technology shall be submitted to the president for signing, and the certificates and prizes are issued thereby.
The certificates and prizes of National Awards for Natural Science, for Technology Inventions, and for National Science and Technology Progress shall be issued by the State Council.
The certificate of the International Science and Technology Co-operation Award of the People's Republic of China shall be issued by the State Council.
Article 20. The monetary amount of prizes for the Top National Science and Technology Award shall be determined by the State Council.
The monetary amount of prizes for National Awards for Natural Science, for Technological Inventions, and for Science and Technology Progress shall be prescribed by the administrative department for science and technology of the State Council together with the financial department.
The outlays for National Science and Technology Awards shall be allocated by the Central Finance.
CHAPTER IV PUNITIVE RULES
Article 21. In case any one plagiarizes or trespasses the discoveries, inventions or other science and technology achievements, or getting the Awards for National Science and Technology by fraudulent means, the awards shall be revoked by the administrative department for science and technology of the State Council after being reported to the State Council for approval, and the prizes shall be retrieved.
Article 22. Should any recommendation entity or individual provide any false data or documents to assist any other person to cheat the National Awards for Science and Technology, it/he shall be circulated a notice of criticism by the administrative department for science and technology of the State Council; if the circumstances are serious, its/his qualifications of recommendation shall be suspended or revoked; and the responsible person directly in charge and other person directly liable shall be imposed an administrative punishment according to law.
Article 23. In case any non-state fund for science and technology awards is established without registration and approval, the administrative department for science and technology shall have it banned.
In case the non-funds for science and technology awards to the public are established after registration, and fees are charged in the granting of awards, the administrative department for science and technology shall confiscate the fees charged, and impose a fine of one time up to three times the fees charged at the same time; if the circumstances are serious, the registration shall be revoked.
Article 24. In case any of the relevant personnel participating in the appraisal of national awards for science and technology is involved in any fraudulent practices or seeks for any private gains, he shall be subject to administrative punishment.
CHAPTER V SUPPLEMENTARY PROVISIONS
Article 25. The relevant departments of the State Council may set up ministerial level awards for science and technology according to the special circumstances of national defense and national security. The specific measures shall be prescribed by the relevant departments of the State Council, and reported to and put on the archival files of the administrative departments for science and technology of the State Council.
The people's governments of the provinces, autonomous regions, and municipalities directly under the Central Government may set up a provincial level award for science and technology. The specific measures shall be prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government and reported to and put on the archival files of the administrative department for science and technology of the State Council.
Article 26. This Regulation shall be implemented as of its promulgation, and the Regulation of the People's Republic of China on Natural Science Awards, the Regulation of the People's Republic of China on Invention Awards and the Regulation of the People's Republic of China on Science and Technology Progress Awards shall be repealed simultaneously.
