NOTICE OF THE STATE ADMINISTRATION OF FOREIGN EXCHANGE ON ADJUSTING POLICIES ON CHINESE CITIZENS' PURCHASE OF FOREIGN EXCHANGE FOR TOURS ABROAD

In accordance with the provisions of the Measures for Management of Chinese Citizens Tours Abroad promulgated by the State Council which provide that the foreign exchange needed for Chinese citizens' tours abroad shall be purchased by the tourists themselves, the State Administration of Foreign Exchange has decided that the personal expenses needed for Chinese citizens' tours abroad shall be, which used to be purchased by the travel agencies for the tourists, purchased by the Chinese citizens themselves, the relevant issues are hereby notified as follows:

I. The travel agencies that have been approved by the National Tourism Administration to operate the business of Chinese citizens' tours abroad (hereinafter referred to the group-organizing agencies) shall no longer purchase foreign exchange for personal expenses of the tourists, the tourists may take the relevant documents to purchase by themselves at the designated foreign exchange banks (hereinafter referred to the banks) which operate the business of residents' individual purchase of and payment in foreign exchange for private purposes.


II. A group-organizing agency shall, strictly in accordance with the name list of the tourists actually going abroad of each tour group, issue the Foreign Exchange Purchase Form for Chinese Citizens' Tours Abroad (hereinafter referred to the Foreign Exchange Purchase Form, see the attachment) to each tourist for their purchase of foreign exchange. The Foreign Exchange Purchase Form shall be in duplicate. The group-organizing agency shall keep the first one for the purchase of foreign exchange for group expenses, and give the second to the tourist for the purchase of foreign exchange.

The group-organizing agency shall also fill in the Foreign Exchange Purchase Form the number of the Name List of Groups of Chinese Citizens' Tours Abroad (hereinafter referred to the Name List) issued by the administrative departments of tourism.


III. The format of the Foreign Exchange Purchase Form shall be designed by the State Administration of Foreign Exchange, and be printed by the group-organizing agencies themselves.


IV. A tourist shall handle the procedures for purchase of foreign exchange for personal expenses at the bank by himself/herself before going abroad, and shall submit the following materials to the bank when purchasing foreign exchange:

(1) the Foreign Exchange Purchase Form (original) provided by the group-organizing agency to the tourist;

(2) the passport of the tourist for which the visa has been obtained, if the passport has no visa record, the copy of the group tour visa name list issued by the tour organizing agency to the tourist; and

(3) the copy of the Name List of this tour abroad provided by the group-organizing agency to the tourist.


V. A bank shall verify the authenticity of the following contents when handling the purchase of foreign exchange for the tourist:

(1) whether the tourist is the exact person as the owner of the passport;

(2) whether the contents filled in the Foreign Exchange Purchase Form are complete and clear, whether the seal of the group- organizing agency on the Foreign Exchange Purchase Form is in compatible with the seal kept by the bank in advance;

(3) whether the tourist had once failed to go abroad after purchasing foreign exchange;

(4) whether the name of the purchaser of foreign exchange is on the Name List provided by the group-organizing agency;

(5) whether the group-organizing agency is in the List of Travel Agencies Licensed to Operate Chinese Citizens' Tours Abroad promulgated by the National Tourism Administration; and

(6) whether the destination of the tour abroad is in accordance with the List of Destination Countries (Regions) of Chinese Citizens' Tours Abroad promulgated by the National Tourism Administration.

After completing the procedures for purchase of foreign exchange for the tourist, the bank shall indicate on the tourist's passport "foreign exchange sold" and "date of foreign exchange sale", and shall keep the documents mentioned in Article 4 for check.


VI. A bank shall comply with the standard for supply of foreign exchange to individuals for private purpose provided for by the State Administration of Foreign Exchange, and in accordance with the exchange rate of the current day of exchange and after deducting the foreign exchange equivalent to the RMB group expenses collected by the group-organizing agency, sell the remaining foreign exchange to the tourist as personal expenses.


VII. When a group-organizing agency handle the procedures for purchase of foreign exchange for group expenses of tours abroad, the RMB fund needed for the purchase of foreign exchange shall be submitted to the bank in the form of checks or bank transfer, and the following materials shall be submitted to the bank:

(1) the official letter of the group-organizing agency for application for exchange (listing in detail the number of the group, number of tourists going abroad, destination and amount of group expenses to be purchased);

(2) the Name List of the Groups of Chinese Citizens' Tours Abroad, which is actually used by the tour organizing agency, issued by the administrative department of tourism;

(3) the relevant contract signed by and between the group-organizing agency and the foreign agency in accordance with the Sample Contract between the Group-Organizing Agency of Tours Abroad and the Foreign Receipt Agency; and

(4) the first one of the Foreign Exchange Purchase Form kept by the group-organizing agency (the bank shall check the original and keep the copy).


VIII. A bank shall write off the foreign exchange purchased for group expenses by the group-organizing agency. The group-organizing agency shall, within 20 workdays after the tour group going abroad entered the border, submit the Name List with the border inspection seal to the bank for check, and shall copy it for record. In case of failure to go abroad due to proper causes, the group-organizing agency shall handle the procedures for returning the group expenses already purchased.


IX. Where any group-organizing agency fails to return the Name List to the bank within the prescribed period of time, or the Name List doesn't bear the border inspection seal, or the Name List is not compatible with the actual persons going abroad, and fails to handle the procedures for returning the group expenses already purchased, the bank shall stop handling the purchase of foreign exchange for group expenses for that agency, and shall circulate a notice to the local administration of foreign exchange of the place where it is located.


X. Where any content of Document No.3 [2001] and Document No.112 [2001] conflicts with the relevant articles of this Notice, this Notice shall prevail, and the other articles of those two documents shall remain valid.


XI. This Notice shall be implemented as of July 1, 2002. The State Administration of Foreign Exchange shall be responsible for the interpretation of this Notice.
