Article 1. In order to enable the meteorological forecast to serve the economic and national defense construction, social development and people's life better, and strengthen the administration on the issue and publishing and broadcast of meteorological forecast, as well as regulate the activities thereof, the present Measures are hereby formulated in accordance with the Meteorological Law of the People's Republic of China.
Article 2. The present Measures shall be observed when undertaking activities of issuing and publishing and broadcasting meteorological forecast within the territory of the People's Republic of China or in other sea areas within the jurisdiction of the People's Republic of China.
Article 3. The competent meteorological department under the State Council shall be responsible for the administration on the issue and publishing and broadcast of meteorological forecast nationwide. Local competent meteorological departments at different levels are responsible for the administration on the issue and publishing and broadcast of meteorological forecast within their own districts under the leadership of the competent meteorological departments at a higher level and the people's governments at the corresponding level£®
Article 4. The local people's governments above the county level and the relevant departments thereof shall positively support the competent meteorological departments to establish and perfect the various channels for issuing and publishing and broadcasting meteorological forecast so as to ensure that the meteorological forecast be issued and published and broadcast in time and accurately.
Article 5. The state applies a unified system for the issue of meteorological forecast. Meteorological offices and stations subordinate to the competent meteorological departments at different levels shall£¬in compliance with their functions and duties, issue meteorological forecast to the general public in time through radio and television stations, newspapers and websites designated by the people's governments at different levels.
Meteorological offices and stations subordinate to the competent meteorological departments at different levels shall establish and perfect working systems of publishing and broadcasting meteorological forecast, and of urgently adding and inserting severe weather alerts or supplementary or corrected meteorological forecast to and into other ongoing programs.
Article 6. The radio and television stations and newspapers designated by the people's governments at different levels shall arrange for particular fixed time slots or space of a page every day, publishing and broadcasting meteorological forecast.
The radio and television stations designated by the people's governments at different levels shall add to and insert into other ongoing programs the major severe weather alerts or supplementary or corrected forecast according to the meteorological change and need.
Where other media need to publish and broadcast meteorological forecast, they shall sign agreements for the publishing and broadcast with the meteorological offices or stations subordinate to the local competent meteorological departments, and the two parties shall provide and publish and broadcast meteorological forecast on the basis of the agreement.
Article 7. The competent meteorological departments above the provincial level shall, in compliance with their functions and powers, organize to issue timely or publicize by a designated spokesman to the society the meteorological forecast that has a vital bearing on economic and national defense construction, social development, and people's life.
Article 8. The competent meteorological departments above the provincial level shall implement registration system for gathering news on information such as the meteorological forecast that has a vital bearing on economic and national defense construction, social development, and people's life.
Article 9. The meteorological offices or stations subordinate to the local competent meteorological departments shall be responsible for issuing the meteorological forecast within their areas of responsibility for forecast service. The areas of responsibility for forecast service shall be determined according to the relevant provisions of the competent meteorological department under the State Council.
In case the meteorological forecast provided by a meteorological office or station exceeds the area of responsibility for the corresponding forecast service, the meteorological office or station shall use the real time meteorological forecast provided by the meteorological offices or stations subordinate to the competent meteorological departments within the exceeded areas of responsibility.
Article 10. The media shall be encouraged to publish and broadcast meteorological forecast positively. The media must use the real time meteorological forecast provided by the local meteorological offices or stations subordinate to the competent meteorological departments when publishing or broadcasting meteorological forecast, and indicate the name of the offices or stations issuing the forecast and the time of the issue. The media shall not rebroadcast or reprint the meteorological forecast from other sources in any form.
The meteorological forecast is a kind of meteorological technological achievement. The entity making and issuing it shall have ownership over it, which shall also be protected by the relevant laws and regulations.
No media may change the contents of the meteorological forecast without the consent of the meteorological offices or stations that issue the forecast.
Article 11. The state encourages the relevant entities of science and research and teaching, academy groups and individuals to make research on and probe into the technology and measures for meteorological forecast and weather forecast. The research conclusions and opinions thereof may be provided to the meteorological offices or stations subordinate to the competent local meteorological departments for consideration in the formulation of meteorological forecast and weather forecast, or for their exchange at the specialized technological meetings, but shall not be publicized openly to the society in any form.
Article 12. The relevant departments of the State Council and the meteorological offices or stations subordinate to other relevant departments of the provinces, autonomous regions, and municipalities directly under the Central Government shall provide special meteorological forecast for their own use.
Article 13. If anyone violates the provisions of the present Measures and is under any of the following acts, the relevant competent meteorological departments may order it to correct, or give it warnings, and may impose a fine of less than RMB 10,000 Yuan concurrently:
(1) Publishing and broadcasting meteorological forecast without authorization and permission;
(2) Providing the meteorological forecast it obtained to other media without authorization;
(3) Rebroadcasting or reprinting meteorological forecast without authorization and permission; or
(4) Changing the contents of the meteorological forecast without authorization, which leads to bad social effect or a certain influence.
Article 14. In case the work staff members of the meteorological offices or stations subordinate to the competent meteorological departments at different levels fail to issue meteorological forecast in time required and cause serious consequences due to their derelict of duty, the competent meteorological departments they are subordinate to shall give them administrative punishment according to law. If a crime is constituted and serious losses are caused to state interests or the life and property of the people, their criminal liabilities shall be prosecuted for according to law.
Article 15. In case the radio and television stations designated by the people's governments at different levels fail to publish and broadcast meteorological forecast in time prescribed, or fail to add or insert the major severe weather alerts and supplementary or corrected meteorological forecast to and into other ongoing programs in time prescribed, their entities shall impose an administrative punishment on the person directly liable according to law. If it leads to injuries or death or great property loss and constitutes a crime, he/she shall be prosecuted for criminal liabilities according to law.
Article 16. The term "media" mentioned in the present Measures refers to the radios, televisions, newspapers and periodicals, internets, telephone and integrated voice service, mobile communications, wireless call and other information carriers open to the general public.
The term "meteorological forecast" mentioned in the present Measures refers to the severe weather alerts, routine medium and short-term weather forecast, short-term weather forecast, and pre-evaluation on weather change, etc., which may be publicized to the general public.
Article 17. The present Measures shall be implemented as of February 1, 2004, and the Interim Measures for the Administration on the Issue of Weather Forecast (Order No.1 of China Meteorological Administration) which were formulated by China Meteorological Administration on July 11, 1992 shall be repealed simultaneously.
