Your Request for Instruction on Whether an Administrative Organ Who Handles a Case May Impose Punishment on Delinquent Parties by Applying Judicial Interpretations in Its Own Name (No.83 [2003] of the Administration for Industry and Commerce of Jilin Province) has been received. And we hereby make the following reply upon deliberation:
The Judicial Interpretation refers to the interpretation made by the supreme judicial department of the state on concrete issues concerning application of laws during the process of law application. And the interpretation shall be binding to all levels of judicial departments for their application of laws. The administrative departments may refer to the relevant judicial interpretations when handling cases, but it is not appropriate for them to apply them directly.
