REPLY OF THE COMMISSION OF LEGISLATIVE AFFAIRS OF THE STANDING COMMITTEE OF THE NATIONAL PEOPLE'S CONGRESS ON THE ISSUE OF WHETHER JUDGES CAN BE APPOINTED OR REMOVED AT THE EXPIRY OF EACH SESSION

The letter of July 11 (No. 85 [2003] of the Political Department of the Supreme People's Court) by the Political Department of your Court has been received. Upon research, we hereby give our reply as follows:

In accordance with the Constitution and the Organic Law of the People's Courts, the term of office for the president of a people's court at any level shall be the same as that for the people's congress at the corresponding level. While the term of office for the deputy president, chief judge, deputy chief judges, judges, and members of the judicial committee shall not be restricted by that for the people's congress, therefore, they need not be re-appointed at the expiry of each session of the people's congress at the corresponding level.
