Regarding "Request for Instructions on Raising the Rates for Litigation Fees" (No. 241 [2003] of 241 Jiangsu Higher People's Court) , we hereby give our reply as follows:
I. Pursuant to the plan of the Central Committee of the CPC on pressing ahead with the reform of judicial system, the Supreme People's Court has begun to amend the "Measures for the People's Courts to Charge Fees in Litigation" in an all-round way. At present, it is not proper to separately amend the exceptional rates in the aforementioned Measures. The issues proposed in your request for instructions will be taken into consideration when the Measures are amended.
II. Before the new Measures for Charging Litigation Fees come out, the people's courts at all levels must, when charging litigation fees, strictly execute the rates prescribed in the present "Measures for the People's Courts to Charge Fees in Litigation", and no entity or individual may discretionally raise the charging rates or enlarge the charging scope.
