SUBJECT : Modifying certain provisions of Decree-Law No. 73 of9/9/1983 (concerning the possession and trade of goods, commodities and products

The Chamber of Deputies has adopted,
The President of the Republic promulgates the law worded as follows:

Article 1
Article 21 of Decree-Law No. 73 of 9/9/83 is abrogated and replaced by the following text:
The Courts of Appeal concerned shall pronounce judgment on the infringements recorded in the "Mohafazat" where the infringement took place, and the simplified procedure for "flagrante delicto" shall apply to this effect. Their decisions shall not be open to any channel of recourse except for correction of a material error. The amount of the fine decided by judgment may not, in any case whatsoever, be less than the minimum limit.

Article 2
The amounts of the fines mentioned in articles 23, 24, 25, 26, 29, 30, 31, 32, 33, 34, 35 and 36 of Title VII and 37 of Title VIII of Decree-Law No. 73 of9/9/83 are modified so that the minimum and maximum limits of each of these fines are increased two hundred fold (1)

(1) Article 42 of Law No. 490 of 15 February 1996 stipulates:
The minimum and maximum limits of the penalties passed by courts and mentioned in articles 23, 24, 25, 26, 29, 30,31,32, 33, 34, 35, 36 and 37 of Decree-Law No. 73 of9/9/1983 (concerning the possession and trade of goods, commodities and products). amended by article 2 of Law No. 723 of 24/7/19912, shall be increased tenfold.

Article 3
In case of contravention of the provisions of Titles I, II, III et IV of Decree-Law No. 73/83, the commodities, materials, goods and products concealed or object of an attempted concealment by fraudulent methods or false declaration, or those which are of the type and category of goods object of the contravention, wherever they lie, shall be seized and confiscated for the benefit of the State (Ministry of

Economy and Commerce). The judgment may sentence the confiscation of the quantity seized, totally or partially according to the case. It may also forbid the contravener to exercise trade, permanently or temporarily.

Article 4
The present law shall go into force upon its publication
