In order to promote a steady, healthy development of business of processing and assembling with materials provided (hereinafter referred to as processing with materials provided), and regulate the management over the business of processing with materials provided, after consulting with the Customs General Administration, the Ministry of Foreign Trade and Economic Cooperation has formulated this Catalogue Guiding the Categorizing Projects of Processing and Assembling Materials Imported (hereinafter referred to as the List). The relevant points are hereby notified as follows: 1. The List is the basis for approving the business of processing with materials provided. The List is classified into three categories of permitting, limiting and prohibiting, of which the category of limiting is sub-divided into limiting category A and B. Contents enlisted under the limiting category are mainly materials and parts imported or returning products of sensitive quotas-permit commodities, and projects of processing with materials provided which are liable to cause pollution, with narrow international marketing and liable to effect impact on export of commodities for general trade. Items for processing with materials provided under limiting and prohibiting categories are listed in the List. Items for processing with materials provided under permitting category is not specified in the List. 2. Projects of processing with materials provided under limiting category A shall be approved by the Ministry of Foreign Trade and Economic Cooperation (hereinafter referred to as the MOFTEC), and examined, approved and supervised (including approving the project agreements and the contracts for processing trade, same below) in accordance with the documents (the contents of approval include: operating units, processing productive enterprises and processing size) of the MOFTEC by the departments of the provinces, autonomous regions, municipalities directly under the Central Government and cities under separate planning (hereinafter referred to the departments of foreign trade and economic cooperation at the provincial level). (1) Business of processing with materials provided under limiting category A, which is carried out by a local operating unit, shall be reported to the MOFTEC for approval after examination and verification by the provincial departments of foreign trade and economic cooperation at the localities of the operating units; (2) Business of processing with materials provided under limiting category A, which is carried out by companies directly under the ministries and commissions or their branch companies, shall have to seek opinions, by the head offices of the companies, of the departments of foreign trade and economic cooperation at the provincial level at the localities where these processing productive enterprises are registered and report to the MOFTEC for approval. (3) Business of processing with materials provided under limiting category A, which is carried out by enterprises with foreign investment, shall be examined and approved and supervised by the departments of foreign trade and economic cooperation at the provincial level, which shall not be reported to the MOFTEC. 3. Projects of processing with materials provided under the limiting category B or under the permitting category, shall be examined, approved and supervised by the departments of foreign trade and economic cooperation at the provincial level at the localities where these operating units are registered. Business of processing with materials provided under limiting category B and under the permitting category carried out by companies directly under the ministries and commissions or their branch companies, shall be examined, approved and supervised by the departments of foreign trade and economic cooperation at the provincial level at the localities where these companies are registered. For the projects of processing with materials provided under limiting category B, the power of examination and approval shall not be transferred to a lower level. 4. For those regions (counties) where business of processing with materials provided are often carried out, and agreed by the departments of foreign trade and economic cooperation at the provincial level at the localities, the departments of foreign trade and economic cooperation of the regions and municipalities (counties) may examine and approve the projects of processing with materials provided under the permitting category carried out by the operating units at their localities. 5. Foreign trade and economic cooperation departments at different levels should be very strict and comply with the relevant regulations and requirements in examining, approving and supervising these projects of processing with materials provided. This List shall become effective on June 1, 1998. All regulations set in the past, which are not in conformity with this List shall be subject to this List. The MOFTEC is responsible for the interpretation of this List. Appendix: Catalogue Guiding Classification of Processing And Assembling Materials Imported CATALOGUE GUIDING CLASSIFICATION OF PROCESS AND ASSEMBLING MATERIALS IMPORTED "Classified guiding catalogue of preprocessing and assembling with materials provided from abroad" is divided into three categories, including permission, limitation and prohibition. Among them, limitation is classified into limitation A and limitation B. Permission is not specifically listed. Related commodities are classified according to the customs commodity item (i.e. four-figure number) or commodity number (i.e. eight-figure number) and their corresponding commodity names. I. PRODUCTS THAT ARE PROHIBITED FROM PROCESSING AND ASSEMBLING: A. Product provided from abroad is any of the following: (1) Prohibited the import of commodities to our country (including old dress, waste or old books containing obscene content, industry waste containing harmful or radioactive materials.) (2) Waste or old cars, motorbikes and their main parts B. Returned product is any of the following: (1) Chemicals that is easy to produce poison or commonly used by both the army and people (2) Commodities China has signed and promised in terms of the quantity of exports to foreign countries in the international conventions (3) Musk (05100030 musk) (4) Natural cow-bezoar (05100010 natural cow-bezoar) C. Product which other countries have banned from processing and assembling II. PRODUCTS THAT ARE LIMITED FROM PROCESSING AND ASSEMBLING A. LIMITATION A: 1.
