The Circular of the General Administration of Customs, the Ministry of Foreign Trade and Economic Cooperation, and the General Administration of Quality Supervision, Inspection and Quarantine on Further Clarifying the Issues Relating to Lifting the Customs Control over the Non-conversion Import Equipment Supplied by Foreign Parties under Processing Trade (Docket No.420 [2001] Shu-Fa-Fa hereinafter referred to Circular) and the Emergent Circular of the General Administration of Customs, the Ministry of Foreign Trade and Economic Cooperation, and the General Administration of Quality Supervision, Inspection and Quarantine on Lifting the Control over "Non-conversion Equipment" (Docket No.1 [2002] Shu-Fa-Chuan, hereinafter referred to Emergent Circular) have provided for the relevant procedures for lifting the customs control over the non-conversion import equipment supplied by foreign parties under processing trade. Considering the important role that processing trade plays in foreign trade, foreign investment attraction, industrial structure adjustment, and creation of employment opportunities etc, and in order to keep the consistency of policies and to better promote the development of processing trade, the issues of lifting the customs control over the non-conversion import equipment supplied by foreign parties under processing trade are hereby notified as follows:
I. For the non-conversion import equipment, supplied by foreign parties in processing trade, that are imported after January 1, 1998, if such equipment are kept in the original enterprise to undertake processing trade after expiration of the period of customs control, the enterprise may be exempted from the License for Import of Mechanic and Electronic Products and the Certificate of Inspection and Quarantine in the formalities for lifting the customs control, and may go through those formalities directly with the customs.
II. For the non-conversion import equipment, supplied by foreign parties in processing trade, that are imported after January 1, 1998, if the enterprise applies for returning those equipment out of China or abandoning them, or lifting the customs control in advance or discontinuing to use them in that enterprise after expiration of the period of customs control, the relevant provisions of the Circular and Emergent Circular shall still be followed in processing of the formalities for lifting the customs control.
