CUSTOMS RULES CONCERNING CONTROL OVER OUTWARD AND INWARD BAGGAGE AND ARTICLES CARRIED BY OUTGOING TOURISTS

Article 1. With a view to promoting tourism development, considering the reasonable needs for outgoing tourists, and strengthening control over goods and articles restricted by the State from import and export, these Rules are hereby formulated pursuant to the Rules governing Supervision and Control over Baggage and Articles of Inward and Outward Passengers of Customs of the People's Republic of China.


Article 2. The term "outgoing tourists" means Chinese residents who are members of tourist groups organized by tourism administrative organization for visiting abroad.


Article 3. Outward and inward baggage and articles carried by outgoing tourists shall be dealt with in accordance with the regulations concerning the short-term passenger whose baggage and articles shall be limited to the personal necessities for the journey, under the Article 17 and Article 27 of the Rules governing Supervision and Control over Baggage and Articles of Inward and outward Passengers of Customs of the People's Republic of China. For the consumer durables specially controlled by the Customs i.e. articles under item 3,4,5 in the list of Category of Inward and Outward Baggage and Article Carried by the Passengers, the importation of which shall not be permitted, except those exported against the Customs approval when leaving the territory.


Article 4. Tourism agent (or company) authorized by the State Tourism Administration to conduct such business shall fill out and affix stamp to a list of name and passport number of those holding with passport among the tourist groups, and surrender fit to the Customs for verification by the head of the tourist groups when leaving the territory.


Article 5. Upon their exit, outgoing tourists shall make a declaration to the Customs in oral or by filling in as specified the Declaration Forms for Passengers' Baggage (hereinafter referred to as Declaration Forms).For those holding with passport, the head of tourist groups shall submit to the Customs their declaration forms, passports and together with lists of members of the tourist groups. They will not be released without the Customs endorsement and examination.

Article carried by those holding with passports mentioned-above at the time of their entry shall be released after the Customs examination against the out-ward declaration forms of the marks endorsed on the bottom page of the passports.

Articles carried by those with special pass certificate shall be completed Customs formalities against the personal Certificates.


Article 6. Smuggling acts in violation of present Rules and other acts violating the supervision and control stipulations of the Customs shall be dealt with by the Customs in accordance with the Regulation for Imposing Administrative Penalties under the Customs Law of the People's Republic of China.


Article 7. The present Rules shall enter into force as of January 15,1991.
