According to the relevant provisions of the International Convention on the Harmonized Commodity Description and Coding System, into which the Chinese government has entered, concerning the rights and obligations of the contracting states, the present public announcement is hereby made as follows:
The import and export tariff schedules and the statistic catalogs of the customs of China shall adopt the International Convention on the Harmonized Commodity Description and Coding System version 2002 (hereinafter referred to the Harmonization System or HS) formulated and promulgated by the World Customs Organization from January 1, 2002.
The World Customs Organization formulate the Explanations to International Convention on the Harmonized Commodity Description and Coding System (hereinafter referred to the Explanations to Harmonization System or Explanations to HS) for the purpose that the contracting states may understand and execute the Harmonization System uniformly, the Explanations are the only interpretation of the commodities involved in the scope of commodity categories of the Harmonization System.
According to the Harmonization System, the General Administration of Customs has formulated the Explanations to the Customs Import and Export Tariff Policy - Catalogs Statistic Commodities and Categories (hereinafter referred to the "Explanations for the Tariff Policy " or the "Explanations to the Statistic Catalogs") as one of the legal basis for the classification of tariff schedules or the classification of statistics catalogs of the import and export commodities by the customs.
