Article 1. These Provisions are hereby formulated with a view to providing, with their reasonable requirements well taken care of, a favorable treatment to overseas Chinese who come back to China to visit their relatives.
Article 2. Baggage brought in by overseas Chinese (including their spouses of foreign nationality accompanying them) who come back to visit their relatives in China for the first time within a year is exempt from customs duty pursuant to the variety and quantity specified in the Table of Limits for Duty-Free Articles Brought in by Overseas Chinese Coming Back to Visit Their Relatives in China (hereinafter referred to as the Table of Limits), which is attached to these Provisions. As for children below 16 years of age accompanying the above-mentioned overseas Chinese, they are also eligible for duty-exemption treatment by choosing any one of the items under the fifth category, in addition to all the items under the first category of the Table of Limits.
Overseas Chinese who come back to visit their relatives in China for the second time within a year are entitled to get duty-exemption treatment for items ranging from the first to the third category of the Table of Limits.
Article 3. If overseas Chinese coming back to visit their relatives in China bring in articles which exceed the limits as specified in the Table of Limits, they shall be returned to the place where they come from, except those articles intended for personal use, which can be released upon the customs examination and approval and the payment to customs duties.
Article 4. Baggage to be taken out by overseas Chinese coming back to visit their relatives in China shall be allowed for exit, if they are not articles prohibited for export and if they are for personal use and are of reasonable quantities.
Article 5. Overseas Chinese coming back to visit their relatives in China are not allowed to bring into or take out of China any articles prohibited for import and export.
Article 6. Baggage for personal use and of a reasonable quantity brought in by overseas Chinese who come back to settle down in China is exempt from customs duty against Permits for Settle-Down of Overseas Chinese in China issued by public security bureaus under provinces, autonomous regions and municipalities directly under the Central Government. Each household is allowed to bring in only one private car, which is subject to customs duty.
Article 7. These Provisions are also applicable to baggage brought in or taken out by Chinese of foreign nationality coming back to China to visit their relatives, Chinese citizens going out to visit their relatives abroad, and foreign nationals domiciled in China.
Article 8. Items not listed in these Provisions shall be dealt with in accordance with relevant customs legislations.
Article 9. These Provisions shall come into force as of October 15, 1985.
