Article 1. The present Measures are formulated in accordance with the Regulation of the People's Republic of China on Certification and Accreditation and the Measures for the Administration of Compulsory Product Certification Bodies, Inspection Institutions and Laboratories and other relevant provisions for the purpose of regulating the inspection activities of the compulsory products certification inspectors, and ensuring the effectively carryout of the work for compulsory products certification. Article 2. The compulsory product certification inspectors mentioned in the present Measures shall refer to those who are appointed by the designated compulsory product certification bodies and inspection institutions to make inspection on the production enterprises that have obtained or that apply for a compulsory products certification. Article 3. The present Measures shall be applicable to the application for, training, examination, registration of and supervision over the compulsory products certification inspectors. Article 4. The state applies the uniform qualification registration system on compulsory product certification inspectors. Article 5. The State Certification & Accreditation Commission (hereinafter referred to as the SCAC) shall be responsible for the work of establishing a uniform qualification registration system on compulsory product certification inspectors and supervising over it. The China National Auditor and Training Accreditation Board shall undertake the examination of the professional knowledge and ability of compulsory product certification inspectors and their qualification registration. Article 6. No one who fails to obtain the qualification registration of a compulsory product certification inspector may undertake any activity of compulsory products certification inspection. Article 7. Anyone who applies for the qualification registration of a compulsory product certification inspector shall be a full-time or part-time employee hired by a compulsory products certification body or inspection institution. Article 8. The compulsory product certification inspectors shall include inspectors and senior inspectors. Article 9. Anyone who applies for the qualification registration of a compulsory product certification inspector (hereinafter referred to the registration applicant) shall meet the following conditions: (1) Having the educational background of junior college or over recognized by the state; (2) Having full-time work experiences of at least six years if the registration applicant has junior college background or having full-time work experiences of at least 4 years if the registration applicant has 4-year university or college educational background; (3) Having at least 2 years professional experience of relevant product certification if the applicant applies for the qualification registration of an inspector; and (4) Having held the qualification of an inspector for 3 years or more if the applicant applies for the qualification registration of a senior inspector or having completed the whole compulsory product certification inspection or follow-up inspection activities for no less than six times or having the experience of acting as the leader of an inspection team for no less than four times. Article 10. A registration applicant shall have the following professional knowledge and ability: (1) Having basic theoretical knowledge and practical experiences of corresponding technical fields; (2) Having mastered the laws and regulations, technical standards and other relevant provisions concerning compulsory product certification; (3) Being familiar with the corresponding product standards, inspection methods and inspection standards; (4) Being familiar with the corresponding process of product design, production, installation and services; (5) Being familiar with the basic theories of quality control and requirements for quality guarantee capacity of a production enterprise and being able to master the key process for product quality control of the production enterprise; (6) Having mastered the standards and methods of inspection and being capable of making inspection on quality assurance ability of a production enterprise in combination with the characteristics of the products; and (7) Having mastered the relevant knowledge and provisions on compulsory products certification. Article 11. Any compulsory product certification inspector who applies for undertaking the inspection on the production enterprises of overseas products shall have the corresponding foreign language ability. Article 12. The professional division of the qualification registration of a compulsory product certification inspector shall be made in light of the detailed rules for the implementation of the compulsory product certification prescribed by the SCAC. Forms such as materials examination, written examination, interview, on-site testing or the combination of the aforesaid methods shall be adopted for making appraisal on the professional knowledge and ability of a registration applicant. Article 13. The registration applicant who complies with the provisions of Articles 9 and 10 of the present Measures and who is found to be qualified upon appraisal shall be issued a qualification registration certificate of compulsory product certification inspector. The period of validity of the qualification registration certificate of a compulsory product certification inspector shall be three years. Article 14. A registration applicant may take part, at his/its free will, in the training on professional knowledge and ability, which is carried out by the institution undertaking the training of compulsory product certification inspectors approved by the SCAC. The institution undertaking the training of compulsory product certification inspectors shall comply with the relevant laws and regulations on the administration of relevant certification training institutions. Article 15. The personnel who have obtained the qualification registration certificate of compulsory product certification inspector shall complete two compulsory product certification inspections as well as 8 hours of professional training and study each year, and shall be subject to the annual confirmation of the China National Auditor and Training Accreditation Board. Article 16. The designated compulsory product certification bodies and the inspection institutions shall establish a management system on compulsory product certification inspectors and make strict management on the selection, vocational training, and annual examination on compulsory product certification inspectors, and report the aforesaid management conditions to the SCAC for archival purposes. Article 17. The SCAC shall make supervision and inspection on compulsory product certification inspectors by taking such ways as questionnaires and special inspections. Article 18. Any entity or individual shall have the right to report to the SCAC and local certification administrative department on any act of law violation and irregularities of any compulsory product certification inspectors in the inspection activities. The SCAC and local certification administrative department shall investigate into and deal with it in time and keep secrets for the person making the report. Article 19. A compulsory product certification inspector is prohibited from conducting the following acts: (1) Undertaking compulsory product certification inspection activities without obtaining qualification registration; (2) Undertaking inspection activities to which the inspector himself does not have professional knowledge and ability; (3) Issuing false or untrue inspection conclusions; (4) Continuing to undertake inspection activities without annual confirmation or failing to pass the annual confirmation; (5) Accepting monetary gifts and other unjust interests of the inspected production enterprises; and (6) Other acts in violation of the relevant provisions on compulsory products certification. Article 20. The China National Auditor and Training Accreditation Board shall give corresponding punishment to anyone who fails to comply with the requirements for qualification registration continually or violates the code of conduct for compulsory product certification inspectors, and shall report to the SCAC in time and make announcement after making the decision on suspension or revocation of the qualification registration certificate. Article 21. Those who violate the present Measures shall be subject to punishment in accordance with the relevant laws, administrative regulations and departmental rules on certification and accreditation. Article 22. The China National Auditor and Training Accreditation Board shall formulate relevant supplementary provisions on qualification registration for the work of qualification registration of compulsory products certification inspectors in special fields according to the provisions on compulsory product certification system, and carry out the corresponding qualification registration work after reporting and putting on archives at the SCAC. Article 23. The power to interpret the present Measures shall remain with the State Certification & Accreditation Administration. Article 24. The present Measures shall come into force as of March 1st, 2005. |
