Article 1. In order to strengthen the administration of price supervision and inspection licence and standardize the behaviors of the price supervision functionaries, the present Measures are formulated in accordance with the Regulation on Price Supervision issued by the State Development and Reform Commission in Order No. 1 (2003). Article 2. A price supervision functionary shall conduct price supervision and inspection activities on the strength of the price supervision and inspection licence. The term "price supervision functionaries" mentioned in the present Measures refers to the persons who specifically engage in the work of price supervision and investigation in the price supervision institutions of the administrative department for price of the government. Article 3. The administrative department for price of the State Council shall be responsible for the administration of price supervision and inspection, formulate the uniform national price supervision and inspection licence system; the administrative departments for price of the government of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the administration of the price supervision and inspection licence within their respective administrative areas and shall do a good job in the evaluation of the price supervision and inspection personnel, the issuance of the licences to them and the administration of supervision of their work. Article 4. The price supervision and inspection licence is the proof to permit the functionaries' fulfillment of the tasks of price supervision and inspection. A functionary shall meet the following conditions in order to obtain the price supervision and inspection licence: (1) He shall have the position of price supervision in a price supervision institution; (2) He shall abide by the laws and regulations on price, and have good political qualifications and a strong sense of responsibility; and (3) He shall have mastered the professional knowledge for engaging in the price supervision and inspection work and shall have good professional proficiency. Article 5. A price supervision functionary shall not be issued a price supervision and inspection licence unless he has accepted training, attended the examination and passed the examination, and has met the required conditions upon verification. A price supervision functionary without the price supervision and inspection licence may not carry out the task of price supervision and inspection. Article 6. A price supervision functionary shall show his price supervision and inspection licence when he carries out a price supervision and inspection task and shall proceed in accordance with the prescribed procedures, he may require the relevant entities and individuals to offer the price information and the pertinent materials, the entities and individuals under supervision and inspection shall cooperate with the supervision functionary. Article 7. When a price supervision functionary conducts a price supervision and inspection, he shall comply with the laws and regulations, strictly stand by the work disciplines and scrupulously abide by the professional ethnics, and shall not commit any of the following acts: (1) Carrying out the investigation activities beyond the prescribed duties in violation of the Regulation on Price Supervision; (2) Concealing, making a false report of, forging or altering the price data information of the entities under supervision and inspection; (3) Disclosing or offering to others the price information of the entities or individuals under supervision and inspection without authorization; or (4) Other acts in violation of the Regulation of Price Supervision. A functionary who has committed any of the above-mentioned acts shall be given a criticism and education by the administrative department for price of the people's government of the same level; if the circumstances are serious, his price supervision and inspection licence shall be withdrawn by the organ that issued the price supervision and inspection licence, which may, furthermore, suggest the organ where he holds a position or the relevant supervisory organ to give him an administrative sanction. Article 8. The administrative department for price of the State Council shall be responsible for the organization of the examination and issuance of the licences for the price supervision functionary within this entity. The administrative departments for price of all provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the examination and issuance of the price supervision and inspection licences within their respective administrative areas, and shall report the number and name list of the issued licences to the administrative department for price of the State Council for archival purposes. The price supervision and inspection licences shall be uniformly made by the price supervision institution of the administrative department for price of the State Council according to the prescribed pattern. Article 9. The price supervision and inspection licence is a special certificate, which is limited to the use by the person who obtains it, shall not be used as a replacement of other certificates, and shall not be forged, lent or destroyed without authorization. If the licence is lost, the holder shall file a timely application to the original issuing organ for the issuance of a new licence, a new licence shall be issued if no discrepancy is found in the examination of the application, and the code of the new licence shall be the same as the previous one. Where a price supervision functionary leaves the position of price supervision, he shall hand in the price supervision and inspection licence in time. Article 10. The power to interpret the present Measures remains with the State Development and Reform Commission. Article 11. The present Measures shall be implemented as of August 1, 2003. |
