	NOTICE OF THE MINISTRY OF CONSTRUCTION ON QUALIFICATION CERTIFICATE OF MUNICIPAL PLANNING SERVICE OF FOREIGN-FUNDED ENTERPRISES

In order to implement the "Provisions on the Administration of Foreign-Funded Municipal Planning Service Enterprises" (hereinafter referred to the "Provisions"), we hereby give our notice regarding the relevant matters for foreign-funded enterprises to obtain the Qualification Certificate for Municipal Planning Service as follows:

I. TECHNICAL EQUIPMENT AND WORK PLACE

If a foreign-funded enterprise applies for the Qualification Certificate for Municipal Planning Service, it shall meet the following requirements in terms of technical equipment and work place:

(1) It has a certain number of computers, or averagely one computer for each professional;

(2) It has a digitizer (AO) or scanner, a wide-range (AO) mapper, and a high-resolution color printer;

(3) It has the softwares for computer-aided design (CAD) or geographic information system (GIS); and

(4) The average construction area in the work place for each person shall be no less than 10 square meters.

II. APPLICATION DOCUMENTS BY THE FOREIGN-FUNDED ENTERPRISE

The application documents submitted by a foreign-funded enterprise shall be in original, attached with two sets of photocopies. After the originals and photocopies have been checked by the organ which accepts the application documents that there is no error, the originals shall be returned to the applicant.

Documents of proof on professional qualification mean: the academic credentials, professional title certificates or registered municipal planner qualification certificates of the professionals retained in China's mainland, the academic credentials of retained foreign professionals, and the documents of proof issued by the competent government authority of the country or region where the foreign professional is located, or by an industrial association, a academic society, or a public notary institution on experience and achievements for rendering municipal planning service.

Technical equipment materials of an enterprise mean the statements on technical equipment arrangements and the purchase documents.

The application form for a "Qualification Certificate of Foreign-Funded Enterprise for Municipal Planning Service" may be obtained in advance from the construction department of the province or autonomous region where the enterprise is registered, or the planning bureau (planning commission) of the municipality directly under the Central Government where the enterprise is registered.

III. PROCEDURES FOR APPLYING FOR THE QUALIFICATION CERTIFICATE FOR MUNICIPAL PLANNING SERVICE

For the sake of facilitating foreign-funded enterprises to obtain the Qualification Certificate for Municipal Planning Service, and benefiting the construction departments of all provinces and autonomous regions, the planning bureaus (planning commissions) of all municipalities directly under the Central Government to strengthen the supervision and administration of the foreign-funded municipal planning service enterprises within their respective jurisdictions to undertake municipal planning service activities, all foreign-funded enterprise shall submit the application documents prescribed in Article 13 of the "Provisions" to the construction department of the province or autonomous region or the planning bureau (planning commission) of the municipality directly under the Central Government at the locality of the enterprise. The said construction department or the planning bureau (planning commission) shall, within thirty days as of acceptance of the application documents, submit the application documents to the Ministry of Construction after ensuring that there are no errors therein and after attaching its opinions. The Ministry of Construction shall, within thirty days after receipt of the checked application documents, make a decision on whether or not to grant the approval. If the application documents conform to Articles 6 and 13 of the "Provisions", A "Qualification Certificate of Foreign-Funded Enterprise for Municipal Planning Service" shall be issued; otherwise the Qualification Certificate shall not be issued, and the reason shall be informed. If the application is not approved, the Ministry of Construction shall meanwhile inform the State Administration for Industry and Commerce and the Ministry of Commerce by letter.

The construction departments of all provinces and autonomous regions, the planning bureaus (planning commissions) of all municipalities directly under the Central Government shall earnestly do well in accepting the foreign-funded enterprises' applications for obtaining the "Qualification Certificate for Municipal Planning Service", and shall do well in the check of the application documents as required by the "Provisions" and the present notice.

IV. ANNOUNCEMENT ON FOREIGN-FUNDED MUNICIPAL PLANNING SERVICE ENTERPRISES

If a foreign-funded municipal planning service enterprise is approved and is issued the "Qualification Certificate of Foreign-Funded Enterprise for Municipal Planning Service", the Ministry of Construction shall announce its name, address, legal representative, name list of the professionals, etc. on the website of the Information Center of the Ministry of Construction.
