NOTICE OF THE MINISTRY OF INFORMATION INDUSTRY ON INTERPRETATIONS OF THE APPLICATION OF THE LEGAL PROVISIONS CONCERNING THE REQUIREMENTS FOR OPERATORS PROVIDING DOMAIN NAME REGISTRATION SERVICE

SUBJECT : QUALIFICATION FOR OPERATION; DOMAIN NAME REGISTRATION SERVICE PROVIDER

"Anyone wishing to provide domain name registration service shall meet the following requirements" provided in Article 12 of the China Measures for the Administration of Internet Domain Names, specifically means that the provider shall:

1. be an enterprise legal person or institution legal person who has been registered with the administrative department of industry and commerce and has a license for an internet content provider (ICP);

2. have a registered capital of not less than 1,000,000 Yuan, have more than 5 technical persons engaging in domain name registration service and more than 10 persons engaging in customer service;

3. have good credit standing, special domain name server (DNS) which can support the registration of domain names in the domain name database, have a sound mechanism for withdrawal from the domain name registration service, which shall guarantee that its DNS shall normally operate for at least six months after its withdrawal from the domain name registration service market;

4. have a relatively well prepared business development plan, a mechanism for the administration of customers' registration and alteration of registered data, and a 24-hour customer phone service, and have a relatively scientific and rational technical plan;

5. have measures for safeguarding the physical security of the DNS and protecting the DNS from net attacks, have sound mechanisms for early warning, warning and restoration, have a sound mechanism for operation maintenance in shifts, and have strict and applicable mechanisms for the removal and filter of offending domain names and for the back-up of domain names data, and remove or check offending domain names at least once a day and back up domain names data at least once a week; and

6. have a cooperative agreement with the relevant domain name administrative organ as well as customer service agreements.

Those meeting the above-mentioned requirements and having submitted the relevant materials to this Ministry for archival purposes shall be published regularly by this Ministry.
