PROVISIONS ON THE ADMINISTRATION OF PRESSWORK PRINTING
 
(Order of the General Administration of Press and Publication and the Ministry of Public Security of the People's Republic of China (No.19 (2003), July 18, 2003: The Provisions on the Administration of Undertaking of Presswork Printing, which were adopted, after deliberation, at the 3rd executive meeting of the General Administration of Press and Publication, and with consent of the Ministry of Public Security, are hereby promulgated and shall take effect as of September 1, 2003)

CHAPTER I GENERAL PROVISIONS

Article 1. In order to regulate the printing activities of printing operators, to perfect the administrative system of the undertaking of printing, and to promote the healthy development of the printing industry, the present Provisions are enacted in accordance with the Regulations on the Administration of Printing Industry.


Article 2. To engage in printing activities, a printing operator shall establish and perfect the management rules, such as the rule of printing verification, of printing registration, of presswork keeping, of presswork delivery, and destroying of the inferior products generated in printing activities.


Article 3. In the execution of the management rules of printing verification, printing registration, presswork keeping, presswork delivery, and destroying of inferior products, a printing operator shall appoint special personnel to carry out strict control and shall establish archives and files for future reference.


Article 4. The legal representative or major principal of a printing operator shall organize the implementation of the management rules of the enterprise or entity.


Article 5. The administrative department in charge of publication (hereinafter referred to publication departments) and the public security departments of the local people's governments at the county level and above shall direct the printing operators under their respective jurisdictions to establish management rules, and shall assume the supervision and inspection of the implementation of those management rules by the printing operators.


Article 6. A printing operator shall, if finding any illegal or criminal acts during printing activities, report to the local public security department or publication department in good time.



CHAPTER II SYSTEM OF PRINTING VERIFICATION

Article 7. A printing operator shall, when accepting an entrustment for printing the presswork of any kind, verify the certifications of the entrusting entity or person, and shall keep the corresponding duplications for future reference in accordance with the Regulations on the Administration of the Printing Industry and other regulations and rules.

The certifications mentioned in the preceding paragraph shall include the power of attorney for printing or the certificate of printing entrustment, the permit for printing, the License for Publishing, the Certification of Trademark Registration, the pattern of registered trademark, the contract of licensed use of registered trademark, the qualification certificate for advertisement operation, the business license, and the qualification certificate of the entrusting party.


Article 8. Where a printing enterprise accepts an entrustment to print books or periodicals, it must verify and keep the original Power of Attorney for Printing of Books and Periodicals which is in the unified format fixed by the publication department under the State Council, is uniformly printed by the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government, and is affixed with the official seal
of the publishing entity.

The Power of Attorney for Printing of Books and Periodicals must bear the special record seals of the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the publishing entity is located, and of the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the printing enterprise is located.


Article 9. Where a printing enterprise accepts an entrustment to print newspapers, it must verify the Permit for Newspaper Publishing uniformly manufactured by the publication department under the State Council and issued by the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government, and shall keep the duplication of the Permit for Newspaper Publishing.

Where a printing enterprise accepts an entrustment for printing extra editions or issues of newspapers or periodicals, it must also verify and keep the documents of approval of the publication department under the State Council for publishing the extra editions or issues.


Article 10. Where a publishing entity entrusts different printing procedures, such as typesetting, plate making, printing (including re-printing and additional printing), and binding, to different printing enterprises, it must issue the Power of Attorney for Printing of Books and Periodicals to those different printing enterprises that accept the entrustments.


Article 11. Where a printing enterprise accepts an entrustment for printing internal reference publications, it must verify and keep the Permit for Printing of Internal Reference Publications that is uniformly printed by the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government, and issued by the publication department of the local people's government at the county level or above.

Where a printing enterprise accepts an entrustment to print any internal reference publications with religious contents, it must verify and keep the document of approval of the department of religious affairs, and the Permit for Printing Internal Reference Publications issued by the publication department of the of the people's government of the province, autonomous region, or municipality directly under the Central Government.


Article 12. Where a printing enterprise accepts an entrustment to print overseas publications, it must verify and keep the document of approval of the publication department of the of the people's government of the province, autonomous region, or municipality directly under the Central Government, and the legal certifications of the relevant copyrights; the overseas publications printed must all be transported to outside of China, and may not be issued or distributed within China.


Article 13. Where a printing enterprise accepts an entrustment to print the marks of a registered trademark, it must verify the Certificate of Trademark Registration or the duplication thereof signed by the administrative department of industry and commerce at the county level of the place where the trademark registrant is located, and shall check the pattern of the registered trademark supplied by the entrusting party; where the printing enterprise accepts an entrustment of a party licensed to use a registered trademark to print the mark of that registered trademark, it must also verify the contract of licensed use of the registered trademark.

Where a printing enterprise accepts an entrustment to print advertisement publicities, and the presswork used as product packaging, it must verify the business license of the entity or the resident identification card of the individual entrusting the printing; in the case of entrustment of any advertisement operator to print advertisement publicities, the enterprise must also verify the qualification certificate of that operator for advertisement operations.


Article 14. Where a printing enterprise accepts an entrustment to print overseas packaging presswork or other presswork, it must verify and keep the printing entrustment certificate of the entrusting party, and shall put on record in advance with the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government, and may undertake the printing only after the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government affixes the special record seal; the packaging presswork and other presswork printed must be all transported to outside of China, and may not be sold within China.


Article 15. Where a printing enterprise designated by the public security department accepts an entrustment to print notices, announcements, work permits for major activities, passes, and tickets or certificates to be circulated and used in the society, that enterprise must verify and keep the certificate of the department in charge of the entity entrusting the printing and the permit for printing issued by the public security department.

Where a printing enterprise accepts an entrustment to print special certificates, such as certificates with or without par value for internal use by state organs, organizations, army troops, enterprises or public institutions, the letters of introduction with the entity's logo, the work certificates, membership certificates, entry certificates, diploma and degree certificates, certificates of education background, or other educational certificates, motor vehicle driver's licenses, and house title certificates, the enterprise must verify the certificate of printing entrustment of the entrusting entity and the resident identification cards of the individuals, and shall keep the duplications of the certificate of printing entrustment and the resident identification cards of the individuals.


Article 16. A printing operator shall appropriately keep the certificates that have been verified for 2 years for the check of the publication department and the public security department.

The certificates mentioned in the preceding paragraph include the original power of attorney for printing or the certificates of printing entrustment, the original permit for printing, the duplication of the License for Publishing, the duplication of the Certificate of Trademark Registration, the original pattern of the registered trademark, the duplication of the contract of licensed use of the registered trademark, the duplication of the qualification certificate of the advertisement operator, the duplication of the business license, and the duplication of the resident identification card.



CHAPTER III SYSTEM OF PRINTING REGISTRATION

Article 17. A printing operator shall, according to the type of presswork to be printed, register the names and addresses of the entity and the person entrusting the printing, the name, ID card number and contact phone number of the handling person, the name and quantity of the presswork, the original files to be printed (or electronic files), the negatives, and the time of delivery and the recipient, on the Register of Publication Printing, the Register of Packaging Presswork Printing, the Register of Other Presswork Printing, the Register of Special Typesetting, Plate Making, and Binding Services, or the Register of Duplicating and Printing (hereinafter referred to the Printing Registers).

A Printing Register shall be in triplication, and shall be uniformly printed by the publication department of the people's government of the province, autonomous region, or municipality directly under the Central Government, or by the publication department at the prefecture (city) level authorized thereby.


Article 18. A printing operator shall, at the end of each month, put on record the contents registered in the Printing Registers with the local publication department at the county level or above.



CHAPTER IV SYSTEM OF PRESSWORK KEEPING

Article 19. A printing operator shall keep in good conditions the original files (electronic files) to be printed, the proof sheets, the plates, the negatives, the semi-finished products, the finished products, and the samples of the presswork, and may not damage them.

A printing enterprise shall, within 2 years from the day on which the printing of a publication is finished, keep for further reference one copy of the sample of the publication entrusted for printing.


Article 20. A printing enterprise may not, without authorization, keep any samples or sample pieces of the notices, announcements, work permits for major activities, passes, and tickets or certificates to be circulated and used in the society, the special certificates, such as certificates with or without par value for internal use of state organs, organizations, army troops, enterprises or public institutions, the letters of introduction with the entity's title, the work certificates, membership certificates, entry certificates, diploma and degree certificates, certificates of education background, or other educational certificates, motor vehicle driver's licenses, and house title certificates, it printed; where it does need to keep any samples or sample pieces for the purpose of operation reference, it shall obtain the consent of the entity entrusting the printing, affix the mark of "sample" or "sample piece" on the copies kept, and shall keep them in good conditions and may not miss any of them.


Article 21. In execution of the system of presswork keeping, a printing operator shall clearly define the responsibilities for keeping, perfect the keeping system, rigidify the formalities for handover of keeping, and shall supply accurate data for further reference.



CHAPTER V SYSTEM OF PRESSWORK DELIVERY

Article 22. A printing operator must print according to the quantity specified in the power of attorney for printing or the certificate of printing entrustment, and may not print any additional pieces without authorization.

A printing operator shall, each time after finishing a kind of presswork, check the quantity of the presswork and the register records carefully, and shall, according to the contract stipulations, deliver all the finished presswork, original files (or electrical files), negatives, plates, and proof sheets, to the entity or individual entrusting the printing, and may not keep any of them without authorization.


Article 23. A printing operator shall establish the archives of the printing of presswork, and shall, each time after finish the printing of a kind of presswork, put on archives together the printing contract, the certifications verified for printing, and the relevant materials such as the corresponding duplications, orders for typesetting, orders for sending to print, sample books, samples, and sample pieces.



CHAPTER VI SYSTEM OF DESTROYING INFERIOR PRODUCTS GENERATED IN PRINTING ACTIVITIES

Article 24. A printing operator shall register the inferior products generated in the printing activities according to their actual number, shall destroy those that cannot be recovered and delivered, and shall register the names and quantities of the destroyed presswork, the time of destroy, and the liable persons. Among which, carriers of state secrets or special presswork shall be destroyed pursuant to the relevant provisions of the state.


Article 25. Where a printing operator uses electric methods in typesetting, pressing, or printing of carriers of state secrets, it shall handle the case in strict accordance with the relevant laws, regulations, or rules.



CHAPTER VII SUPPLEMENTARY PROVISIONS

Article 26. The present Provisions shall take effect as of September 1, 2003.
