	SUPPLEMENTARY PROVISIONS OF THE STATE BUREAU OF OCEANIC ADMINISTRATION FOR EXAMINATION AND APPROVAL FOR THE APPLICATIONS FOR THE USE OF SEA IN PROJECTS APPROVED BY THE STATE COUNCIL

In accordance with the requirements of the Measures for Examining and Approving the Applications for the Use of Sea in Projects Subject to the Approval of the State Council, the provisions for examining and approving the applications for the use of sea in projects that is subject to the approval of the State Council are hereby supplemented as follows:

It is provided in the Measures for Examining and Approving the Applications for the Use of Sea in Projects Subject to the Approval of the State Council that, the applications for the use of sea in projects to be submitted to the State Council shall be accepted by the oceanic administrative department at the county where the project is located (in case there is no oceanic administrative department at the country level or the sea area across different counties is under the jurisdiction of any one oceanic administration, the applications shall be accepted by the common oceanic administrative department at the next higher level), and after being examined and approved and with the consent of the people's government at the same level, be submitted level-by-level to the State Oceanic Administration. In the light of this provision, the applications for the use of sea in projects to be submitted to the State Council shall, after surviving the preliminary examination by the organ for acceptance, be confirmed by the people's government at the same level, with the government seal annexed to the column of preliminary examination opinion of the organ for acceptance in the Submission Form on the Examination and Approval of Sea Area Use. Meanwhile, other matters concerning the examination and approval of applications shall still be implemented pursuant to the Interim Measures for the Examination and Approval of Applications for Sea Area Use.
