	SUPPLEMENTARY PROVISIONS FOR THE PROVISIONS OF FOREIGN INVESTMENT IN CIVIL AVIATION (V)

According to the Economic Cooperation Framework Agreement (ECFA), we hereby supplement the Provisions on Foreign Investment in the Civil Aviation Industry (Order No.110 of the Civil Aviation Administration of China, the Ministry of Foreign Trade and Economic Cooperation and the State Planning Commission) as follows:

I. Taiwan service providers are allowed to provide aircraft maintenance services in the Mainland by making sole investment or joint venture investment. Taiwan service providers shall be legal persons, or, when several Taiwan service providers make joint venture investment, their principal investor shall be a legal person.

II. Taiwan service providers mentioned in the present Provisions shall meet the definition and the corresponding requirements in the ECFA.

III. The power to interpret these Supplementary Provisions shall remain with the Civil Aviation Administration of China, Ministry of Commerce of the People's Republic of China and the National Commission of Development and Reform according to their respective functions.

IV. These Supplementary Provisions shall come into force as of January 1, 2011.
