In accordance with the provisions in the Notice the General Office of the State Council on Printing and Distributing the Provisions of the State Administration For Industry and Commerce on Establishment of Functions, Internal Offices and Personnel Structure (No. 57 [2001] of the General Office of the State Council), one of the main duties of the administrative organs of industry and commerce is to "organize the supervision of market competition acts in accordance with the law, and to investigate and punish such illegal economic acts as monopoly, unfair competition, smuggling, pyramid selling and pyramid selling in disguised forms. ". In the process of investigating the smuggling cases in the field of circulation and punishing the parties concerned, the administrative organs of industry and commerce may, in accordance with the relevant provisions in the Reply on the Issue of How to Determine the Nature and Punish the Acts of Selling Imported Commodities without Lawful Sources (No. 57 [2000] of the State Administration For Industry and Commerce), punish the parties who sell imported commodities without lawful sources.
