	CIRCULAR OF THE STATE ENVIRONMENTAL PROTECTION ADMINISTRATION ON THE RELEVANT ISSUES CONCERNING THE VERIFICATION ON THE COLLECTION OF SEWAGE CHARGES

Since the promulgation of the "Circular on the Relevant Work of Verification on the Collection of Sewage Charges" (No.64 [2003] of the State Environmental Protection Administration) on April 15, 2003 by this Administration, all the local departments of environmental protection have earnestly carried it out and brought forward suggestions on its improvement. We hereby make the following notice concerning the verification on the collection of sewage charges, in combination with the requirements of the relevant work with respect to the collection of sewage charges including the application for permission of pollutant discharge and the environmental statistics etc.:

I. All the pollutant discharge entities and individual businesses (hereinafter referred to the "dischargers") shall observe the provisions of the Environmental Protection Law and other laws and regulations, and apply for permission and make registration of their pollutant discharge according to the facts on January 1 to 15 each year.

II. The administrative departments in charge of environmental protection at the county level and above, who are responsible for the administration of collection of sewage charges, and their subordinate environmental supervision organs shall ask the dischargers to apply for permission according to their particular circumstances and make registration.

1. The ordinary pollutant discharge entities such as industrial enterprises, etc., shall fill out and submit the "Statistical Form for the Application for Permission and the Registration of Pollutant Discharge (For Trial Implementation) ".

2. Other pollutant discharge entities including small enterprises, Tertiary Industry, individual businesses, animal production farms, government organs, and institutions, etc., may fill out and submit the Brief Statistical Form for the Application for Permission and the Registration of Pollutant Discharge (For Trial Implementation). The local departments of environmental protection may simplify the Form according to the demand of actual work, for convenience of application.

3. The construction entities shall fill out and submit the "Statistical Form for the Application for Permission and the Registration of the Pollutant Discharge in Construction (for Trial Implementation) ".

4. Sewage treatment entities including urban sewage treatment plants, centralized wastewater or sewage treatment facilities in industrial parks, and other independent sewage treatment entities, etc., shall fill out the Statistical Form for the Application for Permission and the Registration of the Pollutant Discharge by Sewage Treatment Plants or Sewage Farms (for Trial Implementation).

5. Special entities for solid waste disposal, including rubbish disposal yards, plants for centralized disposal of dangerous wastes, plants for centralized disposal of medical treatment wastes, and other entities for special disposal of solid wastes, etc., shall fill out and submit the "Statistical Form for the Application for Permission and the Registration of the Pollutant Discharge by Entities for Special Disposal of Solid Wastes (for Trial Implementation) ".

III. The environment supervision organs responsible for the collection of sewage charges shall make examination and verification on the "Statistical Form for the Application for Permission and the Registration of Pollutant Discharge (for Trial Implementation) " submitted by the dischargers before February 10 each year. To those dischargers meeting the requirements, the environment supervision organs shall send back the "Statistical Form for the Application for Permission and the Registration of Pollutant Discharge (for Trial Implementation) " having been examined and verified. If the dischargers fail to meet the requirements, or there are mistakes or omissions in the Statistical Forms, the environment supervision organs shall instruct them to submit again or supplement the lack within a prescribed time limit.

IV. In case a discharger needs to make alteration on pollutant discharge or in case of occurrence of pollution accidents, etc., which leads to the emergent change of pollutant discharge, the discharger shall, 3 days before the alteration or within 3 days after the change, fill out and submit the corresponding "Application Form for Monthly Alteration of Pollutant Discharge (for Trial Implementation) ", explain the reasons for the alteration, and go through the application formalities for the alteration.

V. From 2004, the Notice for Payment of Sewage Charges (for Trial Implementation) shall be printed and worked out by the environmental protection bureaus or offices of all provinces, autonomous regions, and municipalities directly under the Central Government in accordance with the pattern attached in the present Circular and upon the demand of the actual work of the corresponding provinces.
