NOTICE OF THE MINISTRY OF CIVIL AFFAIRS ON STRENGTHENING THE ADMINISTRATION OF FOREIGN AFFAIRES OF THE SOCIAL ORGANIZATIONS UNDER THE MINISTRY DIRECT ADMINISTRATION |

In order to further clarify the principles, procedures, disciplines, and codes of conduct for the foreign affairs of social organizations, and to firmly execute the foreign policies of the state, the administration of foreign affairs of the social organizations under the direct administration of this Ministry is hereby notified as follows in accordance with the directions of the Central Party and the State Council on strengthening the administration of social organizations and the requirements of the Ministry of Foreign Affairs on the administration of foreign affairs:
I. PRINCIPLES TO BE OBSERVED IN SOCIAL ORGANIZATIONS' VISITS FOR BUSINESS PURPOSES
(1) A visit shall be paid for definite business purposes and include substantial contents, the principles of corresponding business, appropriate qualification, capable personnel, adequate fund, and exercise of economy shall be abided by in the determination of the visit group and the composition thereof.
(2) As a general principle, there shall be no more than 5 persons in one visit group; the period for visit of one country (region) shall be limited to 3 to 5 days; there shall be no more than 2 countries (regions) in one visit, and the maximum time the group stays abroad shall not exceed 12 days; no additional country may be visited and the time of staying abroad may not be extended without approval. Where it is really necessary, additional instructions shall be requested for. And staff members temporarily employed shall not be dispatched abroad for business purposes.
(3) As a general principle, the principal of one social organization (general secretary or holding a higher position) shall not go with the group for visit, and one organization shall not form separate groups during the same period or within a short period to visit the same country (region) or any country nearby. It shall be avoided that visits be concentrated to a few hot countries (regions), and the exchange with foreign parties in sensitive fields shall be strictly controlled.
(4) Participation in international meetings shall be under scrutiny, and shall be limited to the international meetings that China is obliged to participate provided for by the relevant international organizations, or those bearing significance to China and being important to China's civil affairs undertakings.
(5) International meetings that involve sensitive political issues in absent of corresponding countermeasures shall not be participated. And one had better not participate in various international meetings held by the organizations, groups, and individuals with political backgrounds.
(6) Social organizations shall be strictly controlled from organizing visit groups from the regions and departments other than their own. In special circumstances, it must be reported to the Ministry of Civil Affairs for approval.
II. PROCEDURES FOR THE EXAMINATION AND APPROVAL OF SOCIAL ORGANIZATIONS' VISITS FOR BUSINESS PURPOSES
(1) A social organization shall file a request for instructions 2 months prior to the intended visit for business purposes, prepare all the materials needed, which shall specify the cause, aim, inviter, visitors, schedule arrangements, time of stay, trip routes, and fund source, and shall contain the opinions signed by the major principal of the organization.
(2) The request for instructions for a visit shall be first submitted to the department (bureau) in charge of the involved trade for opinions, and then be submitted to the department of foreign affaires, which shall handle submission for examination and approval.
(3) With respect to the cadres at the division level and below among the visiting persons of the social organization, the request for instructions shall be submitted by the Department of Foreign Affairs, and after examination, to the ministry leaders in charge of the involved trade and of foreign affaires for examination and approval; with respect to the cadres at the department (bureau) level, the request shall be submitted, after examination and approval by the aforesaid leaders, to the executive meeting of the minister for examination and decision; with respect to cadres at the ministry level, the request shall be submitted by the Ministry of Civil Affaires in conjunction with the Ministry of Foreign Affairs (or the Office of Hong Kong and Macao Affairs under the State Council, or the Office of Taiwan Affaires under the State Council) to the State Council for examination and approval.
(4) The political examination of the visiting persons of the social organization shall be carried out by the Department of Personnel and Education of the Ministry of Civil Affairs by referring to the relevant provisions of this Ministry on the political examination of the personnel of public institutions going abroad (exiting the border) (No.1 [2000] of the Ministry of Civil Affairs), the relevant formalities for exit passports (passes to Hong Kong, Macao, and Taiwan), and visas shall be processed by the Department of Foreign Affairs in a unified way.
III. POINTS OF ATTENTION WHEN SOCIAL ORGANIZATIONS HOLD INTERNATIONAL MEETINGS AND CARRY OUR FOREIGN COOPERATION
(1) International meetings held in China shall be under scrutiny, have a clear aim, involve appropriate business, pursue substantial effects, and be based on actual capacities. The scope shall be limited to the international meetings that China is obliged to hold pursuant to the articles of association of international organizations, that concern the maintenance of the state interests of China, and that are of importance to promote the national economy, the civil affairs undertakings, and the social development. International meetings involving international and domestic sensitive issues shall be strictly controlled; and no international meeting shall be held if the cooperative foreign party has unclear backgrounds or any political intent adverse to China.
(2) Where a social organization really needs to hold an international meeting in China, it shall file a request for instructions and submit it to the Department of Foreign Affairs after examination by the department (bureau) in charge of the trade involved, and the Department of Foreign Affairs shall submit the request for approval pursuant to relevant provisions. The request for instructions shall indicate the necessity and aim of the meeting, the sponsoring and assisting entities, the time and venue of the meeting, the topic or main contents, the range of the participants, the level and scale of the meeting, whether Taiwan and other sensitive issues are involved, and the fund source of the meeting, and shall contain relevant background introductions if necessary.
(3) The principle of benefiting China shall be earnestly carried out in participating international organizations. Where a social organization intends to participate in any international organization, it shall file a request for instructions and submit it to the Department of Foreign Affairs after the department (bureau) in charge of the trade involved presents its opinions, and the Department of Foreign Affairs shall submit the request, first to the leaders in charge of the trade involved and of foreign affairs, then to the Ministry of Foreign Affairs for examination and approval. The request for instructions shall indicate the reasons for participation, the nature, purpose, and attitudes towards China of that organization, whether Taiwan issues are involved, the current members, and the activities of that organization, and shall attach detailed background materials such as the articles of association of that organization.
(4) With respect to a foreign-related cooperative project, a social organization shall notify the relevant department (bureau) in charge of the trade involved in advance, the agreement of the cooperative project shall, after being examined by the said department (bureau), be submitted to the Department of Foreign Affairs, and after the Department of Foreign Affairs submits the agreement to the ministry leaders in charge of the trade involved and of foreign affairs for examination and approval, the legal representative of the social organization shall sign the agreement with the cooperative party and shall organize the implementation thereof. The executing entity shall notify the department (bureau) of the trade involved about the progress of the project.
(5) Where a social organization is to cooperate with any foreign (overseas) fund in a project, the request shall be submitted to the Department of Foreign Affairs after the department (bureau) of the trade involved presents its opinions, and the Department of Foreign Affairs shall, after submitting the request to the ministry leaders in charge of the trade involved and of foreign affaires for examination, submit it to the Ministry of Foreign Affairs for examination and approval. Social organizations are prohibited from communicating and cooperating with any foreign (overseas) religious social organizations or those with religious natures.
(6) Social surveys shall be under scrutiny, and social organizations are prohibited from carrying out any social surveys jointly with foreign (overseas) parties. Where it is really necessary, the social organization shall file a request for instructions and submit the request to the Department of Foreign Affairs after the department (bureau) of the trade involved makes the examination, and the Department of Foreign Affairs shall submit the request to the Secrecy Committee of the Ministry or the State Statistics Bureau for examination and approval.
IV. DISCIPLINES ON FOREIGN AFFAIRS OF SOCIAL ORGANIZATIONS
(1) The visiting group of a social organization and the members thereof must strictly abide by the foreign disciplines on affairs and the code of conduct of foreign-related persons. Before the visit, they shall listen to the instructions of the ministry leaders, and the Department of Foreign Affairs shall arrange to inform the visiting members the matters of attention and the requirements of foreign affairs disciplines. If the visit involves any sensitive political issues, a plan of countermeasures shall be drafted in advance, and shall be submitted to the Department of Foreign Affairs after being examined by the department (bureau) of the trade involved, the Department of Foreign Affairs shall make examination and approval, and determine the unified stands expressed to foreign parties.
(2) During the visit, nobody may visit any additional country (region) without authorization, or make a detour, or express any stand or incite the foreign party to make invitation without authorization, or sign any agreement or make any promise beyond the authorized scope. In the event of any urgent and special circumstances and problems, the visiting member shall request for instructions in good time from domestic authorities or the local embassy or consulate of China, and may not do anything they are not authorized to do.
(3) Unhealthy tendencies in the activities of going abroad (exiting the border) shall be firmly stopped, the financial systems concerning foreign affairs shall be strictly abided by, disguised tours to abroad (exiting the border) by using public fund shall be eliminated, and no entity or individual of social organizations may seek private benefits by taking advantage of visits. A social organization shall afford its own visit expenses (including clothing expenses and incidental expenses), and may not apportion such expenses to any relevant entities or individuals. Any violator shall be severely dealt with pursuant to relevant provisions.
(4) The group and personnel dispatched abroad shall, within 15 days after they come back to China, submit a visit summary report to the department (bureau) in charge of the trade involved and the Department of Foreign Affairs. The personnel going abroad for whom the passports (passes) are handled by this Ministry shall submit their identity cards or pay security deposit when drawing the passports (passes), and shall return the passports (passes) to the Department of Foreign Affairs, within 10 days after they return to China, to exchange for their identity cards or security deposit. If anyone needs to borrow the passport (pass), the leader of the entity to which that person belongs to shall sign for the formalities for borrowing. If that person fails to return the passport (pass) within the prescribed time limit, formalities will not be processed the next time when the entity to which that person belongs applies for visiting abroad (exiting the border). It is strictly prohibited to go abroad (exit the border) for personal purposes by taking an official business passport (pass).
(5) Any foreign-related matters (including those related to Hong Kong, Macao, and Taiwan) of a social organization shall be notified to the department (bureau) in charge of the trade involved and the Department of Foreign Affairs, and the Department of Foreign Affairs shall undertake the relevant handling. No entity or individual may make self assertion or do anything as they like without authorization. The major principal of a social organization shall earnestly assume the responsibilities and make strict control. In the event of any violation of the foreign affairs disciplines, except that the liable person shall bear the consequences, the major principal of the social organization to which that persons belongs shall also be investigated for liabilities.
