	OFFICIAL REPLY OF THE STATE COUNCIL ON ESTABLISHING TRANS-TERRITORY INDUSTRIAL PARK BETWEEN ZHUHAI AND MACAO

Your request for instructions on establishing Zhuhai/Macao Trans-territory Industrial Park and the relevant supplementary report have been received. We hereby give the following reply:

1.We approve the establishment of Zhuhai/Macao Trans-territory Industrial Park. The Zhuhai/Macao Trans-territory Industrial Park is situated between the Maoshengwei of Gongbei of Zhuhai and the Qingzhou of northwest Macao, including two parks, namely, the Zhuhai Park and the Macao Park. The Industrial Park is formed through reclaiming land from the sea by Zhuhai of Guangdong province and the Macao Special Administrative Region separately. The total area of the initial project is about 0.4 sq. km., of which the Zhuhai Park area is about 0.29 sq. km., and the Macao Park area is about 0.11 sq. km.. There is a watercourse of 15 meters wide or so between the two Parks as the seclusion, connected by a specially opened port channel. In case there is necessity to enlarge the area thereof in the future, it shall be reported for approval according to the prescribed procedures.

2.Under the precondition of unified planning, the Zhuhai Park and the Macao Park shall be administered respectively by the Zhuhai municipal people's government and the government of Macao Special Administrative Region. The ownership of the land reclaimed from the sea of the Macao Park area shall be owned by the state, and the land use right shall belong to the Macao Special Administrative Region, who shall make judicial and administrative rule accordingly. In the future, if the Macao Special Administrative Region wants to reclaim land from the sea, it shall still report it as an individual case to the State Council for approval after negotiation with the people's government of Guangdong province and the relevant departments of the State Council. The Zhuhai Park area shall make use of beach land and reclaim land from the sea in accordance with the provisions of the relevant laws and regulations.

3. The Zhuhai/Macao Trans-territory Industrial Park shall bring into full play the advantages of the position of the area, laying focus on the development of industry, giving attention concurrently to such two or more functions as the logistics, entrepot trade and the product exhibition and sale, etc.. The Zhuhai Park area, which is regarded as the extension area of the Zhulai bonded zones, shall be supervised by the customs, and implement the policy of bonded zones. If the final products produced in the Zhuhai Park area are sold at home, the relevant provisions on the sale of goods of the bonded zones in domestic market shall be followed for the sale. Where the final products produced by the Macao Park area are transported to the Mainland, the origin of the products shall be determined in accordance with the relevant rules for origin under the framework of the Mainland/Macao Closer Economic Partnership Arrangement. In case the products produced in the two Parks are exported overseas, the origin of the products shall be determined according to the rules of origin of the import country or region.

4. After completing the establishment of the Zhuhai/Macao Trans-territory Industrial Park, the Zhuhai frontier administration line shall be extended forth from the present frontier line to the Zhuhai Park frontier line, and facilities such as the seclusion, surveillance, and administration shall be established at the place where the Zhuhai Park area adjoins the Macao frontier line. And a frontier defense checkpoint will be established at the place where the two Parks joint the channel, to handle the formalities for frontier defense inspection on entry-exit frontier of the persons or vehicles that come and go between the two Parks. The relevant formalities for the coming-and-going of the goods between the two Parks shall be gone through in accordance with the provisions on the administration of the bonded zones. The staffing of the checking organs of the Zhuhai Park area and the relevant issues shall be reported for approval additionally according to the prescribed procedures.

5. To build the Zhuhai/Macao Trans-territory Industrial Park is an important act for bringing into play the advantage of "One Country, Two Systems", and strengthening cooperation and mutual development between the Mainland and Macao within the framework of Mainland/Macao Closer Economic Partnership Arrangement. All the parties concerned shall make concerted efforts to cooperate, organize carefully, plan and prepare thoroughly, quicken up the construction, and make every effort to get remarkable effect as soon as possible. The Zhuhai Park area may not be officially operated until it has been checked and accepted by the Customs General Administration together with the relevant departments. The customs in the two regions shall cooperate with each other closely, and do a good job for supervision together.
