Since 2005 when the State Council decided to carry out a special rectification of false and illegal advertisements, the publicity department of the Party's Committee and such government functionary departments as industry and commerce as well as press and publicity at all levels have coordinated with each other and intensified the crack-down of false and illegal advertisements, and consequently, the false and illegal advertisements have been effectively kept within limits and the advertising order in newspapers and periodicals gradually has turned for the better. However, some newspapers and periodicals still fail to carry into effect the relevant provisions and continue to publish illegal advertisements with false contents and inferior taste, which has violated the requirements of the socialist spiritual civilization, injured the legitimate rights and interests of customers, and has triggered strong dissatisfaction of the masses and seriously affected the public creditability of the news media. In order to stick to the correct orientation of advertisement publishing, purify the contents of newspaper advertisements, consolidate the achievements of rectifying the false and illegal advertisements, and establish a sound, civilized and orderly new order of advertisement publishing in newspapers and periodicals, we hereby notify the relevant matters regarding further effective implementation of the work plan of special rectification of false and illegal advertisements and intensification of the administration of advertising in newspapers and periodicals: 1. The advertisement publishing in newspapers and periodicals is an important part of the contents of the periodicals, so all publishers of newspapers and periodicals shall attach great attention to the administration of advertisement publishing in newspapers and periodicals, firmly establish the socialist concept of honor and disgrace and, based on the point of insisting in the correct orientation of publication, improve the examination system of advertising contents, strictly implement the standards for the content orientation of advertisement publishing, publish all kinds of advertisements according to law, firmly refuse to publish any false or illegal advertisement, so as to guarantee that the contents of advertisements are authentic and affirmative and that the language used in advertisements is good language and does not go against the social ethnics or injure the interest of the masses. 2. As of November 1, 2006, all newspapers shall suspend the publishing of any of the following advertisements: medical advertisements of such venereal diseases as condyloma acuminata, syphilis and chancroid, such diseases as psoriasis, Aids, cancer (malignancy), epilepsy, hepatitis B, autoimmune thyroid disease and lupus erythematosus as well as anodynia artificial abortion, which shall be implemented according to the new provisions after the revised Measure for the Administration of Medical Advertisement comes into force. 3. It is prohibitive to publish any advertisement with contents about obscenity, superstition and eroticism or with any inferior taste. It is prohibitive to publish or spread any telephone information centers' advertisements with unhealthy contents. It is prohibitive to publish any advertisement that teaches any gambling techniques. It is prohibitive to publish any advertisement of applicable criminal techniques such as introduction to automobile decyphering, skeleton keys and anesthetic medicines. The advertisements of medicines, health foods and disinfection and other daily articles shall not include any contents of elevating or intensifying the ability of sexual life or functions of sexual organs. 4. It is prohibitive to take advantage of the name or image of any army entity or person in the army or to use any army equipment or facility to engage in the advertising or publicity of medicines or medical treatment or to publish advertisements for any pharmaceuticals specially produced for the army or preparation confected by an army medical institution. 5. A printed advertisement shall not include any of the aforesaid categories of advertisements nor may it be published in the form of news report. No illegally printed advertisement may be distributed together with any newspaper. 6. The administrative department of press and publication as well as the sponsor of newspapers and periodicals shall, according to the requirements of the present Circular, carry out the self-examination and self-correction and make earnest rectification on the existing problems. Where any of the aforesaid false and illegal advertisements continues to be published, it shall be deemed as a violation of the prohibited contents as prescribed by the state, and the administrative department of press and publication shall give a punishment thereto according to Article 56 of the Regulation on the Administration of Publication and a notice of criticism shall be circulated. The sponsor of a newspaper or periodical shall investigate into the liabilities of relevant principals and directly liable principals. The administrative departments of press and publication and the sponsors of newspapers and periodicals in all regions shall take newspaper and periodicals as the contents subject to proofreading, do an earnest job in proofreading and handle any rule-breaking act found in the process of proofreading. The administrative organs for industry and commerce in all regions shall intensify the inspection and examination on the contents of newspapers and printed advertisements, do a good job in the relevant administration in collaboration with the administrative departments of press and publication, investigate into and punish all kinds of illegal advertisements and expose the typical cases in a timely manner. |
