	DECISION OF THE STATE ADMINISTRATION FOR INDUSTRY AND COMMERCE ON ADJUSTING THE RELEVANT CLAUSES IN THE RULES ON THE SUPERVISION AND ADMINISTRATION OF ADVERTISEMENTS IN ACCORDANCE WITH THE NEWLY AMENDED "DETAILED RULES FOR THE IMPLEMENTATION OF THE REGULATION ON THE ADMINISTRATION OF ADVERTISEMENTS"

	(Order No. 21 of the State Administration for Industry and Commerce in 2005, September 28, 2005: The Decision on Adjusting the Relevant Clauses in the Rules on the Supervision and Administration of Advertisements in accordance with the Newly Amended "Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements", which was deliberated and adopted at the executive meeting of the State Administration for Industry and Commerce of the People's Republic of China, is hereby promulgated.)

After the "Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements" (hereinafter referred to as the "Detailed Rules") are amended and promulgated, the relevant clauses in the rules presently in force on the supervision and administration of advertisements regarding the application of the former Detailed Rules need to be adjusted in accordance with the corresponding clauses in the Detailed Rules now in force. We hereby decide to adjust the relevant clauses in the following rules as follows:

I. MEASURES FOR THE ADMINISTRATION OF COSMETICS ADVERTISEMENTS

1. In Article 11, "shall be penalized in accordance with Article 19 of the Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements (hereinafter referred to as the Detailed Rules)" is amended as "shall be penalized in accordance with Article 17 of the Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements (hereinafter referred to as the Detailed Rules)".

2. In Article 12, "shall be penalized in accordance with Article 26 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 24 of the Detailed Rules".

3. In Article 13, "shall be penalized in accordance with Article 22 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 20 of the Detailed Rules".

4. In Article 14, "shall be penalized in accordance with Article 23 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 21 of the Detailed Rules"; and "shall be penalized in accordance with Article 20 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 18 of the Detailed Rules".

5. In Article 15, "shall be penalized in accordance with Article 27 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 25 of the Detailed Rules".

II. MEASURES FOR THE ADMINISTRATION OF MEDICAL ADVERTISEMENTS

1. In Article 14, "shall be penalized in accordance with Article 19 of the Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements (hereinafter referred to as the Detailed Rules)" is amended as "shall be penalized in accordance with Article 17 of the Detailed Rules for the Implementation of the Regulation on the Administration of Advertisements (hereinafter referred to as the Detailed Rules".

2. In Article 15, "shall be penalized in accordance with Article 22 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 20 of the Detailed Rules".

3. In Article 16, "shall be penalized in accordance with Article 20 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 18 of the Detailed Rules"; and "shall be penalized in accordance with Article 23 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 21 of the Detailed Rules".

4. In Article 17, "shall be penalized in accordance with Article 26 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 24 of the Detailed Rules".

5. In Article 18, "shall be penalized in accordance with Article 27 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 25 of the Detailed Rules".

6. In Article 19, "shall be penalized in accordance with Article 28 of the Detailed Rules" is amended as "shall be penalized in accordance with Article 26 of the Detailed Rules".

III. MEASURES FOR THE ADMINISTRATION OF LIQUOR ADVERTISEMENTS

In Article 11, "Whoever violates Article 5 of these Measures shall be penalized in accordance with Article 27 of the Detailed Implementation Rules for the Administration of Advertisements", is amended as "Whoever violates Article 5 of these Measures shall be penalized in accordance with Article 25 of the Detailed Implementation Rules for the Administration of Advertisements".
