NATIONAL JUDICIAL EXAMINATION RULES
 
(Order of the Ministry of Justice (No. 98 [2005]), July 29, 2005: adopted at the executive meeting of the Ministry of Justice on July 19, 2005, which shall come into force as of September 1, 2005)

Article 1. The present Rules are formulated according to the National Judicial Examination Implementation Measures (Trial) in order to regulate the order of the examination room where the National Judicial Examination is held.


Article 2. The examinees that sit in the National Judicial Examination shall observe the present Rules.


Article 3. An examinee shall enter into the designated examination room upon the strength of the examination permit and his valid identity certificate. Anyone without an examination permit or identity certificate shall not take the examination.

After an examinee enters into the examination room, he shall take his seat according to the number on the examination permit and put the examination permit and his identity certificate on the top left corner of the desk


Article 4. An examinee shall not carry along with him any book, notes, newspaper, draft, electronic article or communication tool to sit in the examination except for the necessary stationeries.


Article 5. Except for an active serviceman, no examinee may take the examination in uniform. No examinee may take any weapon to sit in the examination.


Article 6. All examinees shall enter into the examination rooms 15 minutes before the examination starts.

No examinee may enter into the examination room after the examination has started for 30 minutes.

No examinee may hand in his paper within 60 minutes after the examination starts.


Article 7. An examinee shall fill in his name, and fill in and smear the examination permit number within the prescribed time limit and shall answer questions or smear the answer card with the prescribed pen.


Article 8. An examinee shall observe the following examination disciplines:

(1) No one may smoke or make any noise in the examination room or have any other act that may influence any other person;

(2) No one may pass any message by way of whispering to each other, glancing left or right or gesturing to each other in the examination room;

(3) No one may pry into any other person's answer sheet (card) or look up any other material;

(4) No one may exchange his answer sheet (card) with any other person;

(5) No one may copy any other person's answer sheet (card) or allow any other person to do so;

(6) No one may answer the examination paper beyond the prescribed time limit;

(7) No one may carry his examination paper or answer sheet (card) out of the examination room; and

(8) No one may have any other act that may disturb the order of the examination room.


Article 9. An examinee shall fill in or smear the corresponding content on the answer sheet (card) according to the relevant provisions and shall not sign his name at any place not for signing his name or make any mark thereon.


Article 10. Where an examination paper (answer card) is damaged or contaminated or crumpled due to the reason of an examinee, it shall not be changed.

Where the score cannot be given or read or is inaccurate due to the failure to recognize the examination permit number or name of an examinee because he has damaged the answer sheet (card), failed to clearly fill in or smear the answer sheet or fails to fill in his name or the examination permit number, the responsibility shall be born by the examinee himself.


Article 11. Where an examinee has any question about the content of the examination paper, he shall not require the invigilator to interpret it. However, in the case of a mistaken distribution of the examination paper or indistinct handwriting, an examinee may raise his hand and make an inquiry after obtaining the agreement of the invigilator.


Article 12. Where an examinee hands in his examination paper in advance, he shall raise his hand to inform the invigilator and, upon the agreement thereof, leave the examination room. After one leaves the examination room, he shall not linger on or make any noise near the examination room.


Article 13. When the time for examination is up, an examinee shall instantly stop answering questions and turn over the examination paper and answer sheet (card) by putting them facing downwards on the desk and wait for the invigilator to verify and collect them before their departure.


Article 14. Any examinee that violates any provision of the present Rules shall be given the corresponding treatment according to the relevant provisions on treatment for disciplinary breach.


Article 15. The present Measures shall come into force as of September 1, 2005.
