BUSINESS SCOPE AND RULES

According to the Measures for the Administration of the Representative Offices of Law Firms of Hong Kong and Macao Special Administrative Regions in the Mainland, the representative offices of Hong Kong law firms in the mainland and the representatives thereof may only engage in the following activities not involving the mainland legal affaire:

(1) Providing the parties with the legal consultations of Hong Kong Special Administrative Region, Macao Special Administrative Region, and other countries other than China in which the lawyers of that law firm have been approved to practice, and the consultations on the relevant international treaties and international customs;

(2) Accepting the commissions of the parties or of the law firms in the mainland to handle the legal affaires of the areas in which the lawyers of that law firm have been approved to practice;

(3) On behalf of the parties from Hong Kong and Macao Special Administrative Regions, commissioning the law firms in the mainland to handle the legal affaires of the mainland;

(4) Keeping long-term commission relationships with the law firms in the mainland to handle legal affaires through contracts; and

(5) Providing information relating to the influence of legal environment of the mainland.

A representative may not engage in other legal services or for-profit activities other than those above mentioned. A representative office may not retain any Chinese practicing lawyers.

Hong Kong and Macao law firms, other organizations or individuals may not engage in any legal services within China in the name of consultation companies or other names.

Those violating the aforesaid provisions shall be punished pursuant to law.
