DECISION OF THE MINISTRY OF JUSTICE ON AMENDING THE MEASURES FOR THE ADMINISTRATION OF RESIDENTS OF HONG KONG AND MACAO SPECIAL ADMINISTRATIVE REGIONS HOLDING THE LEGAL PROFESSION QUALIFICATION OF THE MAINLAND AND ENGAGING IN LEGAL PRACTICE IN THE MAINLAND (2006)

(No.99), December 28, 2005: The Decision of the Ministry of Justice on Amending the Measures for the Administration of Residents of Hong Kong and Macao Special Administrative Regions Holding the Legal Profession Qualification of the Mainland and Engaging in Legal Practice in the Mainland (hereinafter referred to as the Decision), which was adopted through discussion at the executive meeting of the Ministry of Justice on December 23, 2005, is hereby promulgated, and shall come into force as of January 1st, 2006. The Measures for the Administration of Residents of Hong Kong and Macao Special Administrative Regions Holding the Legal Profession Qualification of the Mainland and Engaging in Legal Practice in the Mainland (Order No.81 of the Ministry of Justice) shall be revised according to the Decision, and promulgated again.)

With a view to promoting the establishment of closer economic partnership between Hong Kong, Macao and the Mainland, and according to the Supplementary Agreement II of the Mainland/Hong Kong Closer Economic Partnership Agreement and the Supplementary II of the Mainland/Macao Closer Economic Partnership Agreement, we decide to make the following revision on the Measures for the Administration of Residents of Hong Kong and Macao Special Administrative Regions Holding the Legal Profession Qualification of the Mainland and Engaging in Legal Practice in the Mainland (Order No.81 of the Ministry of Justice):

I. Article 12 shall be revised as: "A Hong Kong or Macao resident who is allowed to engage in legal practice in the Mainland may practice in only one Mainland law firm, and shall not be engaged by any foreign law firm's representative office in China or representative office of a Hong Kong or Macao law firm in the Mainland at the same time."

II. This Decision shall be implemented as of January 1st, 2006. The Measures for the Administration of Residents of Hong Kong and Macao Special Administrative Regions Holding the Legal Profession Qualification of the Mainland and Engaging in Legal Practice in the Mainland (Order No.81 of the Ministry of Justice) shall be revised according to this Decision, and promulgated again
