NOTICE OF THE MINISTRY OF COMMERCE ON THE UNIFORM ADOPTION OF THE E-NETWORKED APPROVAL / ADMINISTRATION SYSTEM FOR PROCESSING TRADE

In order to implement the directive of the leaders of the State Council on realizing networked supervision/administration of the processing trade, and to realize as soon as possible the mutual accessibility between the processing trade approval/administration system of the Ministry of Commerce and the supervision/administration systems of all relevant administrative departments, thus streamlining the procedures for enterprises, improving the efficiency of approval/administration of the processing trade, perfecting the functions of the approval system on statistical analysis and data collection, and dynamically tracing the evolution trend of the processing trade, the Ministry of Commerce has made a decision that the processing trade approval/administration organs of the foreign economic and trade administrative departments at all levels (hereinafter referred to the approval organs) and the enterprises of various processing trades (hereinafter referred to the enterprises), shall, for the approval and the submission of processing trade contracts respectively, uniformly try out the network edition of the e-networked approval/administration system for processing trade (hereinafter referred to the new approval system) from September 10, 2003, which will be put into official use as of October 1 2003. The approval organs and the enterprises may use the new approval system free of charge, with exemption for the network use fee and the system operation maintenance fee. The relevant matters are hereby notified as follows:


I. NEW APPROVAL SYSTEM

E-submission and e-approval of application data are adopted in the new approval system. A enterprise may enter the foreign economic and trade exclusive net through internet and submit its data to the database of China International E-commerce Center (hereinafter referred to the E-commerce Center); the approval organ may, through the exclusive net, read from the database of the Center the application date submitted by the enterprise, and return the after-approval data to the said database; the enterprise can learn about the approval result from the database.

The new format of the Record List for the Manufactured Exports and the Consumption of the Corresponding Materials Imports is adopted at both approval and enterprise terminals of the new approval system, where the Application Form on Domestic Sales of the Bonded Materials Imported for in Processing Trade, the Record List on Application for Homemade Materials, the Record List on Non-evaluated Equipment in Processing Trade and the Certificate of Approval on Non-evaluated Equipment in Processing Trade are added.


II. DATA RETRIEVAL FUNCTION OF THE NEW APPROVAL SYSTEM

The data collection and the composite retrieval functions of the new approval system have been improved; a website (http://jmsa.ec.com.cn/jmsa/index.htm) for exclusive use of retrieval has been set up. An approval organ may, in accordance with their respective scope of powers, retrieve any part of the approval data collected thereby or by its subordinate organs.


III. INSTALLATION OF THE NEW APPROVAL SYSTEM AND TRAINING ON THE APPLICATION

The approval organs at the provincial level shall, in conjunction with the E-commerce Center (or representative offices thereof), be in charge of the trainings for the system operation staff of the approval organs and the enterprises. The Center or the representative offices thereof shall be in charge of the installation of new systems for the approval organs at all levels. The Center and the local representative offices thereof should work closely with the approval organs, strengthen technical support and services and take effective measures to ensure the normal operation of the System. In late September, the Department of Mechanical and Electrical Products and the Department of Information, both under the Ministry of Commerce, are to establish a joint survey group, which will head to major provinces and cities to consult the opinions of the administrative organs and the enterprises, so as to make further adjustment and improvement and to prepare for the comprehensive promotion and application of the system.


IV. SYSTEM'S SAFETY SETUP

Since the enterprises reach the internal database of the E-commerce Center through public net, a decision has been made to adopt the common form of "Safety Certification Letter" so as to ensure the safety of the System's database. The medium for "Safety Certification Letter" may be provided by an enterprise on its own, or be purchased by the E-commerce Center without remuneration at the entrustment of the enterprise. The E-commerce Center will produce "Safety Certification Letters" on a one-time basis (completion within a week) and provide them to enterprises for permanent use.

The collection of information on the enterprises' safety certification letters may be conducted in three ways, namely, network delivery, on-the-spot handling in user-intensive areas, and paper document submission. All approval organs shall notify the enterprises of their respective localities to complete the submission of relevant materials within a time limit. The local administrative departments in charge of processing trade may conduct on-the-spot handling with the support of the Center and the local representative offices thereof. The Letters should be distributed to the users as soon as they are produced.


V. CONVERSION OF THE HISTORICAL DATA OF THE OLD APPROVAL SYSTEM

The conversion of data from the old system to the new one shall be handled well during the promotion of the new e-approval system. First, the Center shall work out the conversion program, and after testing, convert the old-edition approval data of all approval organs to the new system's database for possible use. The specific operation scheme will be notified separately.

To ensure the smooth transition of approval operation for processing trade, the JM2.0 Edition Program will not be removed until the execution of processing trade contracts on such Program is completed.

The E-commerce Center should assist the writing of exclusive programs for data of the programs worked out by the local approval organs, and import such data to the database of the new approval system after the conversion.


VI. UPGRADING OF THE MINISTRY'S E-NETWORKED APPROVAL/ADMINISTRATION SYSTEM FOR PROCESSING TRADE, AND LAYING A GOOD FOUNDATION FOR THE NETWORKING

In order to make good preparations for the networked supervision and administration by connecting the contract-based processing trade systems of the enterprises and the relevant administrative departments outside the Ministry of Commerce, the relevant departments of the Ministry of Commerce will consult the opinions of the departments concerned within and outside the Ministry, accelerate the upgrading of the current e-networked approval administration system for processing trade, and work for the comprehensive networking with the departments outside the Ministry on an earliest possible date.
