CHAPTER I GENERAL PROVISIONS

Article 1. The present Measures are hereby formulated in line with the spirit of the decision of the State Council for Chinese Academy of Sciences to carry out the experiment of knowledge innovation program, as well as the overall planning of this Academy in the stage of carrying forward the experiment of knowledge innovation program in an all-round way, and with a view to further strengthening the construction of scientific and technological innovation contingent, and promoting the smooth carryout of the experimental work of knowledge innovation program.


Article 2. In order to further promote international scientific and technological cooperation and exchanges, give impetus to the development of a group of key disciplines, enhance the academic status and competitive strength of this Academy in the world, this Academy decides to continue implementing the plan on absorbing distinguished foreign talented people in the stage of carrying forward the experiment of knowledge innovation program in an all-round way.


Article 3. The plan on absorbing distinguished foreign talented people is embodied in two forms, namely, absorbing distinguished talented people who return to China to work on the long-term basis (hereinafter referred to "distinguished talented people"), and recruiting overseas famous scholars who return to China to work for a short term (hereinafter referred to "famous scholars").


Article 4. To absorb talented people, the consolidation of academic level, scientific ethics and serving the homeland must be adhered to, and the principles of setting up positions in light of the needs, recruiting staff publicly, making assessment strictly, retaining the best ones, managing the staff by contract, and making dynamic adjustments shall be complied with.



CHAPTER II TARGETS AND CONDITIONS

Article 5. During the stage of carrying forward the experiment of knowledge innovation program in an all-round way, that is, from 2001 to 2005, this Academy plans to absorb about 500 distinguished foreign talented people.


Article 6. An absorbed distinguished talented person shall be a citizen with Chinese nationality or an expert or scholar who is willing to give up his foreign nationality and comes to China or returns to China to reside. Meanwhile, he shall also meet the following basic conditions:

(1) Holding a doctoral degree;

(2) Having 2 or more consecutive years of scientific research experience abroad after obtaining the doctoral degree, and usually having obtained the title of assistant professor or higher or other corresponding position abroad;

(3) Having independently presided the research of a topic (project) or participated as a main backbone in the whole process of the research and having made marked achievements;

(4) Being considerably influential in the academic areas both home and abroad, being able to grasp the development trend of his own disciplinary area, having long-term strategic conception, and able to lead a team to engage in research in international science frontier and make innovation achievements at the international level;

(5) Having deep academic attainments in his own disciplinary area, having made research achievements at international level, having published 3 or more influential theses in important core publications, which were included or cited in SCI or EI; or possessing key inventions (patents), and in mastery of the key technology in this disciplinary area which may influence hi-tech industrialization; and

(6) Having the spirit of devotion by basing himself within the country and facing the outside world, and by carrying out the pioneering work with arduous efforts for the development of China's scientific and technological undertaking and the national economic construction.


Article 7. In order to adapt to the strategic demands of the State as soon as possible, we shall, aiming at the situation on some new disciplines and interdisciplinary talented people in urgent need, recruit some famous scholars to return to China for a short term in flexible ways. A famous scholar shall meet the following basic conditions:

(1) Having obtained the title of assistant professor or higher or other corresponding position abroad;

(2) Having profound academic attainments within his own disciplinary area, having high prestige and important influence in the international academic area, and being able to grasp disciplinary development trend and to render innovative ideas;

(3) Being able to lead a team to make innovation achievements at the international advanced level;

(4) Having obtained important research achievements recognized internationally in the same area, and having published a number of theses with important influence in the generally recognized authoritative publications of his own disciplinary area; or possessing key inventions (patents), and in mastery of core and key technology which may influence hi-tech industrialization; and

(5) Being able to work in China for 4 months or longer each year.



CHAPTER III REQUIREMENTS FOR SETTING UP POSITIONS

Article 8. The positions of the absorbed distinguished foreign talents must be set up by combining scientific and technological targets with the disciplinary construction of the innovation base, and with the disciplinary distribution of the whole Academy, so as to meet the demand for talented people in new disciplines, cross disciplines, key disciplines, major projects to be tackled, key laboratories and key scientific projects; and with the Academy's planning on major directional projects.

The positions of the recruited famous scholars shall be set up in the "Scientists Team" supported by the Academy or be incorporated into the "Innovation Team" under planned management of the Academy. The said team shall have good basis for work and conditions for experiments, and have a research group composed of domestic excellent young scientists who are active in this area. It shall also have powerful research strength in this disciplinary area, have made high-level research achievements, and be expected to make a new breakthrough in the near future by recruiting famous scholars or scholar groups.



CHAPTER IV POSITION DUTIES

Article 9. The duties of an absorbed distinguished foreign talents on his position are:

(1) to correctly grasp the dynamic and development trend of the discipline, to render fundamental, strategic and prospective research distribution and projects, and to lead a group to engage in the scientific research at international level in his own disciplinary area;

(2) to actively promote international academic exchanges, to create conditions for facing world science and technology, and to engage in reciprocal cooperation and research;

(3) to take part actively in social competition by facing the key strategic demands of the State and international scientific and technological frontier, and to try to undertake the projects of key scientific and technological plans of the State; and

(4) to make, during the term of employment, scientific research achievements with domestic and international attention, to educate excellent talents for the innovation entity, to build up a scientific and technological contingent with continuous innovation ability. The recruited famous scholars shall manage to train an international-standard group and make scientific innovation achievements of the first level in the world.



CHAPTER V ORGANIZATIONAL STRUCTURE

Article 10. The Academy shall form a leading team for "Absorbing Distinguished Foreign Talented People under the Knowledge Innovation Program" (hereinafter referred to the "leading team"), which shall be composed of the leaders of the Academy, relevant experts and the leaders of relevant departments. The Academy shall also invite the leaders of competent departments of the Ministry of Finance and the Ministry of Science and Technology to be responsible for examining the plans of each recruiting entity on annual absorption of distinguished foreign talented people, and determining the selected persons. The office of the leading team shall be set up in the personnel and education bureau to be responsible for the daily work.



CHAPTER VI PROCEDURES OF RECRUITMENT

Article 11. The recruitment procedures for absorbing distinguished foreign talented people are:

(1) In the first quarter of each year, each recruiting entity proposes its demands in positions, and report to the office of the leading team. After the leading team has granted approval, the Academy uniformly announces the recruitment information;

(2) The recruiting entity arranges for preliminary examination. The recruiting entity forms a recruitment committee (composed of 7-11 experts, including no less than 1/2 of experts out of the Academy, and a certain proportion of young experts and management experts) to hold the preliminary examination on the applicants strictly according to the prescribed conditions. Whoever obtains 2/3 or more votes shall be regarded as having passed the preliminary examination; and the recruiting entity submits the materials of the candidates who have passed the preliminary examination to the office of the leading team. A famous scholar who has already had a close cooperative relationship with the recruiting entity may be recommended by 2-3 overseas famous experts in the same area, and be directly reported by the recruiting entity to the office of the leading team; and

(3) The office of the leading team reviews the materials of the candidates; each competent bureau organizes an experts team to re-examine the materials of the candidates, and meanwhile distributes the materials to 3 or more domestic and foreign experts in the same area for deliberation; the leading team makes final examination on those who have passed the re-examination, reports to the Ministry of Finance for approval and then announces the recruitment result publicly.



CHAPTER VII MANAGEMENT OF TALENTED PEOPLE

Article 12. For absorbing distinguished foreign talents, the system of employment for a fixed three years shall be adopted. During the employment, both parties' responsibilities, rights and obligations shall be specified in the concluded contract. The employee's scientific research achievements made during his work in the Academy shall be treated in accordance with the relevant laws and regulations of the State on intellectual property.


Article 13. The appraisal systems mainly aiming at scientific innovation, technical innovation, economic benefits and social benefits shall be separately established in light of the research area and work nature of the absorbed distinguished foreign talented people, so as to make qualitative and quantitative mid-term assessment and final evaluation on the absorbed talented people:

(1) Whoever fails to work at his position stipulated in the contract shall be cancelled of his qualification as a candidate, and the Academy shall take back the expenses allocated to him; whoever fails to meet the requirements of the plan indicated in the result from the mid-term assessment and is expected to be unable to achieve the target on time shall be suspended from his research plan, be cancelled of his qualification as a candidate, and the Academy shall take back his apartment and remaining expenses. The expenses taken back by the Academy must be reported to the Ministry of Finance, and be dealt with in accordance with relevant financial rules of the State;

(2) After the end of the employment, the recruiting entity shall organize 7-9 experts to form a appraisal team, and make initial evaluation on their work; all competent bureaus shall make comprehensive evaluation on their work, and choose 20% excellent ones. The leading team shall make final determination on the result from the evaluation. Whoever evaluated to be excellent may be given certain follow-up supports; on the contrary, whoever evaluated to be unqualified shall be treated in accordance with the Contractual Management Regulation, and be circularized to the whole Academy.



CHAPTER VIII MEANS OF SUPPORT

Article 14. A distinguished talented person may, during his employment, obtain a lump sum of special fund amounting to 2 million Yuan (including 1,730,000 Yuan for the scientific undertaking, and 270,000 Yuan for basic construction). Apart from enjoying the treatments prescribed by the State including wages, welfares, medical treatment, etc., he may enjoy position allowance for distinguished talented people in accordance with the provisions. A famous scholar may, during his employment, obtain a lump sum special fund of 1 million Yuan (all of which are for the scientific undertaking).


Article 15. During the employment period, whoever has made achievements in researching and developing hi-techs, commercializing scientific and technological achievements or developing hi-tech industry shall be distributed property proceeds in accordance with the "Notice of the General Office of the State Council on Transmitting and Distributing Some Provisions of the Ministry of Science and Technology and Others on Promoting the Commercialization of Scientific and Technological Achievements" (No. 29 [1999] Promulgated by the General Office of the State Council).



CHAPTER IX MANAGEMENT OF EXPENSES

Article 16. The recruiting entity shall conclude a contract with each absorbed distinguished foreign talented person and submit it to the Academy for examination. The Academy shall, in light of the actual situation on allocation of the expenses, apply to the Ministry of Finance for using the money.


Article 17. Upon approval of the Ministry of Finance, the expenses shall be fully allocated according to the relevant procedures.


Article 18. Each recruiting entity shall guarantee the self-raised expenses for absorbing distinguished foreign talented people. The special expenses for absorbing distinguished foreign talented people and the expenses raised by each entity itself shall be used along with each other, mainly for such aspects of the absorbed talented people as personnel management, scientific research, apparatus and equipment, and housing subsidies.


Article 19. The special funds for absorbing distinguished foreign talented people shall be used and managed strictly in accordance with relevant provisions in the financial rules of the State and the "Measures of Chinese Academy of Sciences on Management of Experimental Funds for the Knowledge Innovation Program (Revised Version) ", and shall be subject to the supervision of the accounting department.



CHAPTER X SUPPLEMENTARY PROVISIONS

Article 20. The present Measures shall come into force in 2001. The "Administrative Measures of Chinese Academy of Sciences on Absorbing Distinguished Foreign Talented People", which were printed and distributed on May 24, 1999, shall be abrogated simultaneously.
