NOTICE ON STRICTLY PROHIBITING THE ILLEGAL TRANSPORTATION, STORAGE AND DEAL OF REFINED OIL

During recent period of time, the smuggle of refined oil has been happening repeatedly in some regions, the illegal transportation, storage and deal of smuggled refined oil by some entities and individuals has seriously damaged the normal order of the refined oil import and export, and pinched the domestic refined oil market. In order to safeguard the healthy development of the petrochemical industry of our country, maintain the normative and orderly order of refined oil import and export, severely striking activities of illegal transportation, storage and deal of smuggled refined oil, according to the spirit of the 15th executive meeting of the State Council, and upon approval of the State Council, the General Administration of Customs, the National Development and Reform Commission, the Ministry of Public Security, Ministry of Commerce, the State Administration for Industry and Commerce, and the Legal Office of the State Council hereby make the following notice on relevant matters concerning strictly prohibiting the illegal transportation, storage, and deal of refined oil:

I. The transportation, storage or deal of refined oil by any entity or individual shall be subject to the approval of the relevant department in charge, with the legal and complete formalities for management.

II. Cases of smuggling refined oil found out by all the law enforcement departments shall be handled uniformly by transferring them to the customs according to the suppressing smuggling system.

III. Where any entity or individual transports, stores or purchases or sells refined oil without legal and complete formalities in inland water, territorial sea, boundary rivers, boundary lakes or prescribed coastal or boundary regions near the customs, the departments of customs, public security (frontier defence), and industry and commerce administrations shall confiscate the refined oil without legal and complete formalities in accordance with the provisions of this Notice, and they shall not let them pass just by imposing a fine.

IV. Where the departments of customs, public security (frontier defence), and industry and commerce administrations confiscate refined oil without legal and complete formalities, they shall sell it out to the petroleum wholesale enterprises subject to the China National Petroleum Corporation and China Petroleum & Chemical Corporation, the price for selling out shall not be lower than the factory price of the similar oil products of the domestic refineries, and the proceeds from the sale shall be turned over to the treasury prescribed by law.

V. All the districts and departments shall strengthen administration on entities and individuals who transport, store, and purchase and sell refined oil, and positively support the law enforcement activities of the departments of customs, public security (frontier defence), and industry and commerce administrations, and reply to the law enforcement departments in time for their request on relevant formalities for checking. For illegal enterprises investigated into and punished by the law enforcement departments, the relevant administrative departments shall order them to shut out and straighten out or revoke their qualification of business management.
