It is a long-term political task of strategic significance for China to provide medical technical aid to foreign countries. Foreign medical aid teams are one of the important forces for implementing China's diplomatic line in the medical and health sector. These measures are formulated with a view to ensuring the smooth fulfillment of the foreign medical aid missions and strengthening the administration of foreign medical aid workers. Article 2. The foreign medical aid workers mentioned in the present Measures refer to the professional technical personnel in the health sector who are assigned foreign aid missions to provide professional technical services such as medical treatment, disease prevention and medical care in accordance with the present Measures, and the administration and logistics personnel to that end. Article 3. The Ministry of Health is in charge of the administration of the aforesaid workers. The administration of the workers who are outside the health sector may be implemented by referring to the present Measures. CHAPTER II SELECTION AND TRAINING Article 4. The workers selected for foreign medical aid missions should meet the following conditions: (1) being patriotic and career-dedicated, complying with the laws and disciplines, and having high moral standards; (2) being physically and mentally healthy, and capable of fulfilling the medical posts for a consecutive period; (3) having the professional technical qualification at the intermediate level or above in principle (for the medical professional personnel); and (4) knowing foreign languages to a certain extent; Article 5. The Ministry of Health decides upon the list of provinces, autonomous regions and municipalities directly under the Central Government for undertaking the dispatch and assigns the dispatch missions in accordance with the provisions of the agreements between the Chinese Government and the governments of the aid-receiving countries on the dispatch of foreign medical aid workers. The departments (bureaus) of health of the provinces, autonomous regions and municipalities directly under the Central Government organize the selection in accordance with the dispatch missions. Article 6. The selection of foreign medical aid workers may be conducted either through the organizational mechanism, or by means of qualification examination or open job invitation on the basis of voluntary applications and overall appraisal. Article 7. In the course of selecting foreign medical aid workers, priority should be given to the selection of the team (group) leader, who will participate and play a role in organizing the team. Article 8. Couples are allowed to work on foreign medical aid missions together if they meet the conditions for selection. Those foreign medical aid workers who are competent professionally and popular among the aid-receiving countries are encouraged to work in foreign countries time after time or for long terms. Article 9. Before undertaking their foreign aid missions, the foreign medical aid workers should receive comprehensive and intensive trainings, which will be organized and implemented by the Ministry of Health and the departments (bureaus) of the provinces, autonomous regions and municipalities directly under the Central Government. The trainings shall cover items such as China's diplomatic guideline and policies, the administrative rules on foreign medical aid missions, the disciplines concerning foreign affairs and finance, the instructions for secret keeping and overseas work. Article 10. The foreign medical aid workers should receive intensive trainings on foreign languages and relevant knowledge, which will be organized and implemented by the departments (bureaus) of the provinces, autonomous regions and municipalities directly under the Central Government, and last for no less than 4 to 6 months. The said trainings should be arranged by special persons, with sites, trainers and textbooks guaranteed. A person may not be dispatched unless he / she has passed the training test. CHAPTER III ADMINISTRATION AND SUPERVISION Article 11. The administration of personnel files is a component of the personnel administration. To ensure the continuous, complete and standardized personnel files of the foreign medical aid workers, the Ministry of Health will establish the work files for the said works during their foreign missions, complete and record the items of work management, appraisal, promotion of professional titles, etc.. After the foreign medical aid workers have returned, the Ministry of Health shall hand over such files to the organizations where the workers belong so as to put their work files into their personnel files. Article 12. The Talent Exchange & Service Center under the Ministry of Health takes charge of the administration of work files for foreign medical aid workers, in light of the jurisdiction for personnel administration. The departments (bureaus) of the provinces, autonomous regions, and municipalities directly under the Central Government should pay sufficient attention to this work, and provide services for foreign medical aid workers. Article 13. The secret keeping system of the state and the principle of classified administration will be applied to the work files of foreign medical aid workers. The collection, authentication, classification, filing of the documents for work files and the consultation and lending of such files shall conform to the relevant provisions on the administration of personnel files. No department or organization may arbitrarily alter, replace or destroy the documents for work files. Article 14. Upon the expiration of the term of work for the foreign medical aid workers, an overall appraisal should be conducted jointly by the medical team, the dispatch undertaking organization, the Chinese embassy (consulate) in the foreign country and the department in charge of health. Article 15. The aforesaid appraisal will mainly cover the aspects of moral standards, ability, diligence and achievement of the foreign medical aid workers, who will be rated with marks. The appraisal result, which may fall into any of the four grades, namely, "superexcellent", "excellent", "competent" and "incompetent", will be decided upon according to the marks of each worker. The workers graded "superexcellent" will be rewarded with material interests, while those graded "incompetent" will be dealt with accordingly. Article 16. The Ministry of Health commends the individuals and groups who show outstanding performance in fulfilling the foreign medical aid missions. Various localities should, in accordance with their real situations, establish the relevant commending and rewarding system for foreign medical aid missions. Article 17. The Ministry of Health is in charge of the promotion of professional titles for foreign medical aid workers during their foreign missions. The Talent Exchange & Service Center under the Ministry of Health undertakes the appraisal and examination of professional titles. Any worker who meets the conditions for applying for professional tile promotion during his / her foreign aid medical mission may submit his / her application in accordance with the designated procedures. Those passing the appraisal and examination will receive the Certificate of Professional Technical Qualification sealed by the Ministry of Health, which is effective nationwide. Article 18. The term of foreign mission(s) of a foreign medical aid worker who has yet to be promoted as an urban doctor to the rank of doctor-in-charge or associate professor of treatment will be simultaneously counted as a period of service of the same length in a medical institution sponsored by the government at the county level or in a town (township) clinic, if the said worker has not completed the accumulative term of service therein prescribed to be a must for the promotion. Article 19. The departments (bureaus) of health of the provinces, autonomous regions, and municipalities directly under the Central Government should assist the organizations where the foreign medical aid workers have worked before their foreign missions in the hiring of those members. The term of hiring may not be less than that of their foreign missions. For those that fail to be hired due to various reasons, the local departments should properly settle their domestic employment for a term equivalent to that of their foreign missions, and actively arrange appropriate positions for them. Article 20. During the period of pre-mission trainings and foreign missions, the domestic salaries of the foreign medical aid workers should be paid continuously, and interests such as welfare benefits and subsidies should also be provided by the organizations where the said staff have worked before their foreign missions. The living expenses, holidays and family visits during their foreign missions will be implemented in accordance with the relevant provisions. Article 21. The Ministry of Health is in charge of buying personal accident insurance for the foreign medical aid workers every year. CHAPTER IV SUPPLEMENTARY PROVISIONS Article 22. The authorities of all provinces, autonomous regions, and municipalities directly under the Central Government should formulate the implementation rules of their localities according to the real conditions of their work. Article 23. The present Measures come into force as of the day of their distribution. The power to interpret the present Measures remains with the Personnel Department of the Ministry of Health. |
