Goods under China's foreign economic and technical assistance (hereinafter referred to as assistance goods) refer to the various kinds of production and living goods that are purchased domestically by agencies designated by the Chinese Government with the assistance fund provided by the Chinese Government and that are delivered to the governments of the recipient countries. It is an important condition for the successful implementation of the foreign assistance projects to guarantee the quality of the assistance goods and to maintain the normal order of customs examination. The relevant matters on strengthening the administration of quality supervision and customs examination over assistance goods are hereby notified as follows:
I. Assistance goods must be submitted to the relevant agencies of entry and exit inspection and quarantine for the inspection of origin and the customs examination, strictly in accordance with the Measure for the Administration of Inspection of Goods Supplied under Foreign Assistance (No.113 [1998] of the General Administration of Quality Supervision, Inspection and Quarantine).
II. From January 1, 2003, any foreign assistance goods that have passed the inspection of origin and the customs examination and that are under special clearance upon decision through consultation by the Ministry of Foreign Trade and Economic Cooperation (MOFTEC) and the General Administration of Quality Supervision, Inspection and Quarantine (GAQSIQ), will be issued the release order by the agency of entry and exit inspection and quarantine in a unified way, and the words "assistance goods" will be indicated in the Remarks on the release order.
III. From January 1, 2003, all the customs shall examine and release the assistance goods with the notification on foreign assistance project issued by MOFTEC and provided by the enterprises undertaking foreign assistance projects, and with the release order with the remarks "assistance goods" issued by the agencies of entry and exit inspection and quarantine.
The undertaking enterprises of foreign assistance projects must voluntarily bring the assistance goods into the quality supervision and customs control system of the state, strictly according to the aforesaid provisions, and they are severely prohibited from avoiding the inspection and customs control, and from secretly carrying non-assistance goods out of China by any means. Otherwise, any such act will be, upon verification, severely treated according to the relevant laws and regulations.
