	CIRCULAR OF THE MINISTRY OF FOREIGN TRADE AND ECONOMIC COOPERATION AND THE STATE COMMISSION OF SCIENCE AND TECHNOLOGY ON ACCELERATION OF GRANTING IMPORT AND EXPORT TRADING RIGHT TO SCIENTIFIC RESEARCH INSTITUTES AND HIGH/NEW TECHNOLOGY ENTERPRISES

SUBJECT : RESEARCH INSTITUTES AND HIGH/NEW TECHNOLOGY ENTERPRISES; IMPORT AND EXPORT TRADING RIGHT

In order to implement the spirit of 1997 Working Meeting on National Foreign Economy and Trade, speed up granting import and export trading right to scientific research institutes and high/new technology enterprises so as to support their efforts in exportation of scientific and technological products, the relevant issues are hereby notified as follows:

I. FURTHER LIBERALIZE THE APPROVAL CRITERIA FOR GRANTING IMPORT AND EXPORT TRADING RIGHT TO SCIENTIFIC RESEARCH INSTITUTES AND HIGH/NEW TECHNOLOGY ENTERPRISES

1. Scientific research institutes directly affiliated to ministries and commissions under the State Council as well as locally affiliated scientific research institutes above the sub-departmental level are entitled to import and export trading right as long as they raise such applications, and it is no longer necessary to check the value of their export supplies.

2. Other scientific research institutes each with an annual sale over RMB 3 million yuan are all entitled to apply for their own import and export trading right.

3. According to the Circular of the State Council on Approval of the State High/New Technology Industrial Development Zones and Related Policy Provisions and the Circular of the State Commission of the Science and Technology on Printing and Issuing the Conditions and Methods of Accreditation for High/New Technology Enterprises outside the State High/New Technology Industrial Development Zones (Guokefahuozi No. [1996]018), high/new technology enterprises in and outside the State High/New Technology Industrial Development Zones shall be accredited accordingly, each with a total annual revenue over RMB 30 million yuan; or developmental-type high/new technology enterprises accredited by provincial commissions of science and technology, each with a total annual revenue over RMB 10 million yuan. These accredited enterprises are entitled to apply for import and export trading right.

II. PROCEDURE OF APPLICATION

Scientific research institutes directly affiliated to various ministries and commissions under the State Council may submit, through the ministries and commissions, their documents of application to the Ministry of Foreign Trade and Economic Cooperation and the State Commission of Science and Technology. Local scientific research institutes may submit the documents of application to the Ministry of Foreign Trade and Economic Cooperation and the State Commission of Science and Technology via the foreign economic relations and trade commissions (departments, bureaus) and science and technology commissions of provinces, autonomous regions, municipalities directly under the central government or cities under the central planning where the applicants are located. The formalities of applying for import and export trading right by high/new technology enterprises shall be handled with reference to the procedure of application for scientific research institutes.

III. APPROPRIATELY ENLARGE THE RIGHTS OF OVERSEAS CONTRACT ENGINEERING AND LABOR SERVICE COOPERATIONFOR SCIENTIFIC RESEARCH INSTITUTES AND HIGH/NEW TECHNOLOGY ENTERPRISES

Scientific research institutes and high/new technology enterprises each with an exchange earning through exportation over US $ 10 million may, with approval, be granted the right of overseas contract engineering as related to research and development and high/new technology as well as the labor service right to send technical personnel of design, installation, test and operation and after-sale service personnel abroad.

For scientific research institutes and high/new technology enterprises which apply for rights of overseas contract engineering and labor service cooperation, the various ministries and commissions under the State Council or the competent foreign economic and trade departments of provinces, autonomous regions, municipalities directly under the central government and cities under the central planning power shall submit their application to the Ministry of Foreign Trade and Economic Cooperation for approval.

IV. OTHER

For the items not covered by this circular, the circular on issuance of the 'provisional methods for granting import and export right to scientific research institutes for scientific and technological products' ([1993] waijingmaozhengfa no. 504) issued by the ministry of foreign trade and economic cooperation and the state commission of science and technology is still applicable .
