CHAPTER I GENERAL PROVISIONS
Article 1. The present Detailed Rules are formulated according to the Regulation on National Awards for Science and Technology (hereinafter referred to as the Regulation on Awards) for the purpose of doing a good job in national science and technology awards and ensuring the appraisal quality of national awards for science and technology.
Article 2. The present Detailed Rules shall be applicable to such activities as the recommendation, appraisal, and award granting of the Top National Award for Science and Technology, National Award for Natural Sciences, National Award for Technological Inventions, National Award for Science and Technological Progress and International Science and Technology Co-operation Award of the People's Republic of China (hereinafter referred to as International Science and Technology Co-operation Award).
Article 3. The policies of "respecting work, knowledge, intellectuals and creations" shall be carried through in the granting of national awards for science and technology so as to encourage collaboration and cooperation in tackling crucial problems, encourage self-initiated innovation, encourage the climbing up to the pinnacle of science and technology, promote the integration of scientific research, technological exploitation and economic and social development, promote the commercialization and industrialization of scientific achievements, and accelerate the implementation of the strategy of developing the country by relying on science and education, revitalizing the country by developing human resources and sustainable development.
Article 4. The recommendation, appraisal, and granting of national awards for science and technology shall be based on the principles of openness, fairness and justness and shall not be unlawfully interfered by any organization or individual.
Article 5. The national awards for science and technology shall be granted to those citizens or organizations who have made prominent creative contributions in such aspects as scientific discovery, technological invention and the promotion of scientific and technological progress. For citizens or organizations who are awarded for a same item, an order shall be arranged according to their contributions.
No working personnel, who only engages in the organization management or assistant services in any project of scientific research or technological exploitation, may be a candidate of any national award for science and technology.
Article 6. The national awards for science and technology are an honor granted by the state to its citizens or organizations. The certificates of awards shall not be the immediate basis to determine the ownership of scientific and technological achievements.
Article 7. The National Committee of Science and Technology Awards shall take charge of the macro-administration and guidance of national awards for science and technology.
The Ministry of Science and Technology shall take charge of the organizing work for the appraisal of national awards for science and technology. The National Office of Science and Technology Awards (hereinafter referred to as the Office of Awards) shall take charge of the daily work thereof.
CHAPTER II AWARDING SCOPE AND APPRAISAL STANDARD
Section I Top National Award for Science and Technology
Article 8. The expression "Making great breakthroughs in modern science and technology fronts or having preeminent establishments in science and technology development" mentioned in item (1), paragraph 1of Article 8 in the Regulation on Awards refers to that a candidate has made such a serial or particularly great discovery in basic research or the basic area of applied research that he has enriched and developed the relevant theories in this subject, leads to breaking-through development in this subject or fields of relating subjects, is generally recognized by people working in the same field home and abroad, and has made particularly great contributions to the scientific and technological development and social progress.
Article 9. The expression "Producing great economic or social benefits in the innovation of science and technology and the transformation of new technical know-how into productive force, as well as the industrialization of high technology" mentioned in item (2), paragraph 1, Article 8 in the Regulation on Awards refers to that a candidate has made a series of or a particularly great technological invention in scientific and technological activities, especially in the field of new and high technology, and at the same time, has actively promoted the market-oriented transformation of scientific achievements, realized the industrialization thereof, and has achieved a big leap in the development of technology in this field, has helped the industrial restructuring, created great economic or social benefits, and made particularly great contributions to promoting economic and social development and ensuring national security.
Article 10. Any candidate for the Top National Award for Science and Technology shall love his motherland, have good scientific ethics, and is still active in the modern scientific and technological fronts and is engaged in scientific research or technological exploitation.
Section II National Award for Natural Sciences
Article 11. The expression "not having been discovered or elaborated by any forerunner" mentioned in item (1), paragraph 2, Article 9 in the Regulation on Awards refers to that this discovery of natural science is put forward for the first time both home and abroad or the scientific theory thereof is elaborated for the first time both home and abroad, or the major treatise is published for the first time both home and abroad.
Article 12. The expression "having great scientific value" mentioned in item (2), paragraph 2 of Article 9 in the Regulation on Awards refers to: (1) this discovery is creative in the scientific theory or doctrine, or is new in research methods or means; and (2) the said discovery has great significance in promoting the development of the subject or has great influence on the economic construction and social development.
Article 13. The expression "having been recognized by the natural science community both home and abroad" mentioned in item (3), paragraph 2 of Article 9 in the Regulation on Awards, refers to that the major treatise has been published in any academic publication which is circulated both home and abroad or it has been a year since its publication in the form of a monograph, and the significant scientific conclusion thereof has been openly quoted or applied by people working in the same field both home and abroad in any important international academic conference or in any openly circulated academic publication, especially in a key academic publication or academic monograph.
Article 14. A candidate for the National Award for Natural Sciences shall be the main author of the relevant scientific and technological treatise and shall meet any of the following conditions:
(1) Putting forward the overall academic idea and research scheme;
(2) Discovering significant scientific phenomenon, characteristic and law, and elaborating the scientific theory and doctrine thereof; or
(3) Putting forward research methods or means, solving key difficult academic problems or experimental technology cruxes, and systematically collecting and comprehensively analyzing key basic data, etc.
Article 15. The number of people to be granted the first grade award or second grade award of the National Award for Natural Sciences in a single item shall not be any more than 5, as a general rule, with the top award as an exception. The specific number of people to be granted the top award shall be decided by the National Committee of Science and Technology Awards after appraisal by the National Appraisal Committee of Awards for Natural Sciences.
Article 16. The awarding grades of the National Award for Natural Sciences shall be decided by taking into comprehensive consideration of the scientific discoveries which are made by the candidates. The appraisal standard is as follows:
(1) Anyone who has made any breakthrough in science and whose discovered natural phenomenon, uncovered scientific law, raised academic opinion or the research methods are generally acknowledged and widely cited by the academia both home and abroad and thus promotes the development of this subject or relating subjects, or has significant influence on the economic construction and social development may be granted the first grade award;
(2) Anyone who has made important progress in science and whose discovered natural phenomenon, uncovered scientific law, raised academic opinion or the research methods thereof are generally acknowledged and widely cited by the academia both home and abroad and thus promotes the development of this subject or the branch subjects thereof or has important influence on the economic construction and social development may be granted the second grade award.
Anyone who makes any particularly significant scientific discovery with outstanding originality, particularly significant scientific value and significant impact on the academia both home and abroad may be granted the top award.
Section III National Award for Technological Inventions
Article 17. The products as mentioned in paragraph 1, Article 10 of the Regulation on Awards include all kinds of instruments, facilities, appliances, tools, parts and new biological products, etc. The craftworks as mentioned in the said paragraph include all kinds of technological means in such fields as industry, agriculture, medical treatment and sanitation, and national security. The materials as mentioned in the said paragraph include new substances that are obtained by all kinds of technological means. The systems as mentioned in the said paragraph refer to the technological colligation of products, craftworks and materials.
The awarding scope of National Awards for Technological Inventions shall not include any technology that depends exclusively on personal experience, skill or technique and is impossible to be re-actualized.
Article 18. The expression "not having been discovered or publicized by any forerunner" mentioned in item (1), paragraph 2, Article 10 of the Regulation on Awards refers to that this technological invention is initiated both at home and abroad, or, though the said technology exists home or abroad, the major technological content thereof has not yet been published or publicized in any kind of open publications, media or other public information channels, nor has it been openly applied.
Article 19. The expression "being advanced and creative" as mentioned in item (2), paragraph 2, Article 10 of the Regulation on Awards refers to that this technological invention, as compared with identical technologies which already exist in China or abroad, is innovative in technological thoughts, principle or means thereof and has substantial technical features and actualized prominent progress, and such aspects as main performances (properties), technological and economic indexes, scientific and technological level and the role and significance in promoting scientific and technological progress are comprehensively better than other identical technologies.
Article 20. The expression "having created obvious economic and social benefits after being put into practice" mentioned in item (3), paragraph 2, Article 10 of the Regulation on Awards refers to that this technological invention is mature, has been applied for more than one year and has produced good application effects.
Article 21. A candidate of the National Award for Technological Inventions shall be an independent accomplisher of the overall or part of the creative technological content of this technological invention.
The number of people to be granted the first grade award or second grade award of the National Award for Technological Inventions in a single item shall, generally, not exceed 5, with the top award as an exception. The specific number of people to be granted the top award shall be decided by the National Committee of Science and Technology Awards after appraisal by the National Appraisal Committee of Awards for Technological Inventions.
Article 22. The awarding grades of the National Award for Technological Inventions shall be comprehensively appraised according to the technological inventions which are made by the candidates. The appraisal standard is as follows:
(1) Any significant technological invention that is initiated both in China and abroad, has unique technological thoughts, has significant innovation in major technology, reaches the leading level among identical technologies in the aspect of technological and economic indexes, and thus has promoted technological progress in relating fields and has brought about prominent economic benefits or social benefits may be appraised as the first grade;
(2) Any significant technological invention that is initiated both home and abroad, is novel in technological thoughts, has relatively large innovation in major technology, reaches the advanced level among identical technologies in the aspect of technological and economic indexes, and has thus promoted technological progress in this field and has brought about obvious economic benefits or social benefits may be appraised as the second grade.
Any particularly significant technological invention with particularly outstanding originality, with obviously better technology economic index as compared to the identical technologies or products both home and abroad and with significant economic or social benefits may be appraised as the top award.
Section IV National Award for Science and Technology Progress
Article 23. The expression "technology development projects" mentioned in item (1), paragraph 1, Article 11 of the Regulation on Awards refers to the projects in which the production and popularized application of products, technologies, craftworks, materials, designs and biological species with significant market utility value have been accomplished in the process of science research and technological exploitation.
Article 24. The expression "projects for public interest" mentioned in item (2), paragraph 1, Article 11 of the Regulation on Awards refers to the projects in which significant achievement and the application and popularization thereof have been obtained in such basic work of science and technology as standard, measurement, scientific and technological information, scientific and technological archives, scientific and technological popularization and such public-interest cause of science and technology as environmental protection, medical treatment and sanitation, the investigation and reasonable utilization of natural resources, the monitor, forecasting, prevention and treatment of natural disasters.
Article 25. The expression "projects for national security" mentioned in item (3), paragraph 1, Article 11 of the Regulation on Awards refer to the projects in which scientific and technological achievement has been made in army construction, scientific research of national defense, national security and relating activities and is exclusively applied for purpose of national defense and national security in a specific period and has great significance in promoting the construction of national defense modernization, enforcing the strength of national defense and safeguarding national security.
Article 26. The expression "major engineering projects" mentioned in item (4), paragraph 1, Article 11 of the Regulation on Awards refers to such projects as key, comprehensive capital construction projects, scientific and technological projects and national defense projects which have been listed into the national economy and social development plan.
Article 27. The award for major engineering projects of the National Award for Science and Technology Progress is granted to organizations only. Any citizen who has made any scientific discovery or technological invention in completing a major engineering project and meets the conditions as set forth in the Regulation on Awards and the present Detailed Rules may be separately recommended for the National Award for Natural Sciences or National Award for Technological Inventions.
Article 28. A candidate for the National Award for Science and Technology Progress shall meet any of the following requirements:
(1) Making important contributions to designing the comprehensive technological scheme of a project;
(2) Making significant technological innovation in a key technology or in the process of solving difficulties;
(3) Making creative contributions in the process of achievement transformation and popularized application; or
(4) Making important contributions to the industrialization of high technology.
Article 29. A candidate entity of the National Award for Science and Technology Progress shall be the major accomplisher which provides such conditions as technology, facilities and personnel in the process of project development, exploitation, production, application and popularization, and has played such functions as organization, management, and collaboration for the project accomplishment.
No government department at any level shall be the candidate entity of the National Award of Science and Technology Progress as a general rule.
Article 30. The number of people to be granted the first grade award of the National Award for Science and technology Progress in a single item shall not exceed 15, and the number of entities shall not exceed 10.The number of people to be granted the second grade in a single item shall not exceed 10, and the number of entities shall not exceed 7. The number of people and entities to be granted the top award is not limited. The specific number of people and entities to be granted the top award shall be decided by the National Committee of Science and Technology Awards after appraisal by the National Appraisal Committee of Awards for Science and Technology Progress.
Article 31. A project which is accomplished by a candidate person or entity of the National Award for Science and Technology Progress shall meet the following conditions:
(1) Outstanding originality in technological innovation: The project shall have important innovation in technology, especially have self-initiated innovation in the field of new and high technology; shall form a predominant technology and famous brand product in the corresponding industry or apply new and high technology to equip and reform the traditional industry so as to enhance the added value of products by means of technological innovation, elevating the traditional industry and add technological content to the industry; shall be very difficult, and have solved the heated, crux and key problems in the industrial development; and shall be a leader of the industry in respect of comprehensive technological level and technology economic index;
(2) Outstanding economic or social benefits: The developed project shall have brought about great economic or social benefits through the implementation of a comparatively large-scale application for more than one year, realized the market value or social value of the technological innovation and made a great contribution to the economic construction, social development and national security; and
(3) Conspicuous Role in Promoting the Scientific and Technological Progress of the Industry: The project shall have a high level of transformability, comparatively strong exemplification, pace-setting and proliferation capability, have promoted the adjustment, optimization and upgrading of the industrial structure and the renovation and upgrading of products, and have a great influence on the industrial development.
Article 32. The awarding grades of the National Award for Science and Technology Progress shall be comprehensively appraised according to the projects which are accomplished by candidate persons or entities. The appraisal standard is as follows:
(1) The Category of Technology Development Projects
Any project which is significantly innovative in key technology or system integration, is technologically difficult, and has reached the advanced level in the aspect of overall technological level and major technological and economic indexes among international identical technologies or products, is fairly competitive in the market and has a high level of transformation possibility, has produced great economic benefits and has a significant influence on the technological progress and industrial structure optimization may be appraised as the first grade award.
Any project which is comparatively innovative in key technology or system integration, is technologically very difficult, has reached the same level as international identical technologies or products in the aspect of overall technological level and major technological and economic indexes, is fairly competitive in the market and has a comparatively high level of transformation possibility, has produced comparatively big economic benefits and has a comparatively big influence on the technological progress and industrial structure adjustment may be appraised as the second grade award.
(2) The Category of Projects for Public Interest
Any project which significantly innovative in key technology or system integration, is technologically difficult, has reached the advanced level in the aspect of overall technological level and major technological and economic indexes among international identical technologies or products, and is widely applied in the industry, has produced significant social benefits and has a significant influence on the scientific and technological development and social progress may be appraised as the first grade award.
Any project which is comparatively innovative in key technology or system integration, is technologically difficult, has reached the same level as international identical technologies or products in the aspect of overall technological level and major technological and economic indexes, and is applied in a comparatively large range in the industry, has produced comparatively big social benefits and has a comparatively big influence on the scientific and technological development and social progress may be appraised as the second grade award.
(3) The category of Projects for National Security
Any project which is significantly innovative in key technology or system integration, is technologically very difficult, has reached the advanced level in the aspect of overall technological level and major technological economic indexes among international identical technologies or products, has produced extremely remarkable effects of application and has a significant influence on the national defense construction and national security safeguard may be appraised as the first grade award.
Any project which is comparatively innovative in key technology or system integration, is technologically difficult, has reached the same level as international identical technologies or products in the aspects of comprehensive technological level and major technological and economic indexes, has produced remarkable application effects and has a comparatively big influence on the national defense construction and national security safeguard may be appraised as the second grade award.
(4) The Category of Key Engineering Projects
Any project which, through collaboration and cooperation in tackling crucial problems, is significantly innovative in key technology or system integration and system administration, has big technological difficulties and project complexity, has reached the advanced level in the aspect of overall technological level and major technological and economic indexes among international identical projects, has produced significant economic benefits or social benefits, has a significant influence on the promotion of the scientific and technological development in this field and has a great strategic significance on the economic construction, social development and national security may be appraised as the first grade award.
Any project which, through collaboration and cooperation in tackling crucial problems, is comparatively innovative in key technology or system integration and system administration, has comparatively big technological difficulties and project complexity, has reached the same level as international identical projects in the aspect of overall technological level and major technological and economic indexes, has produced comparatively big economic benefits or social benefits, has a comparatively big influence on the promotion of the scientific and technological development in this field and has a strategic significance on the economic construction, social development and national security may be appraised as the second grade award.
Any project which is extremely innovative in technological originality, has produced extremely prominent economic benefits or social benefits and plays a particularly obvious role in promoting the scientific and technological progress in the industry may be appraised as the top award.
Section V International Science and Technology Co-operation Award
Article 33. The expression "foreigners or foreign organizations" mentioned in Article 12 of the Regulation on Awards refers to the foreign scientists, engineering technological personnel, personnel of scientific and technological management, and organizations of scientific and technical research, development and management, etc. that have made important contributions to the Chinese scientific and technological cause in the bilateral or multi-lateral international scientific and technological cooperation.
Article 34. Any foreigner or foreign organization to be granted the International Science and Technology Co-operation Award shall meet any of the following requirements:
(1) Having made significant scientific and technological achievement in the research and development cooperation with Chinese citizens or organizations, and has played an important role in promoting the economic and social development of China and achieving prominent economic benefits or social benefits;
(2) Having made important contributions in such aspects as imparting advanced scientific technologies to Chinese citizens or organizations, having put forward important suggestions and solutions for scientific development or trained science and technology intellectuals or management intellectuals, having promoted the development of the scientific and technological cause in China, and having produced prominent social benefits or economic benefits; or
(3) Having made important contributions to boosting the scientific and technological exchange and cooperation between China and other countries or international organizations, and having played an important role in promoting the science and technology development of China.
Article 35. The number of awards of the International Science and Technology Co-operation Award shall not exceed 10 annually.
CHAPTER III APPRAISAL ORGANIZATIONS
Article 36. The main obligations of the National Committee of Science and Technology Awards are:
(1) Inviting relevant experts to form the National Appraisal Committee of Awards for Science and Technology;
(2) Examining and approving the appraisal results of the National Appraisal Committee of Awards for Science and Technology;
(3) Supervising the recommendation, appraisal and demurral disposal of national awards for science and technology;
(4) Providing policy advice and suggestions to perfect the work of national awards for science and technology; and
(5) Studying and solving other big problems that arise in the appraisal of national awards for science and technology.
Article 37. The National Committee of Science and Technology Awards is composed of 15~20 committee members. The post of director shall be assumed by the Minister of Science and Technology and there shall be 1~2 deputy directors and one secretary general. Committee members of the National Committee of Science and Technology Awards shall be composed of famous experts or scholars in such fields as science and technology, education and economy and leaders in the administrative departments. Candidate members shall be nominated by the Ministry of Science and Technology and shall be reported to the State Council for approval.
The National Committee of Science and Technology Awards shall adopt an appointment system in which each term lasts 3 years.
Article 38. There are national appraisal committees of such science and technology awards as the National Award for Natural Sciences, National Award for Technological Inventions, National Award for Science and Technology Progress and International Science and Technology Co-operation Award under the leadership of the National Appraisal Committee of Science and Technology Awards. The main obligations thereof are:
(1) Taking charge of the appraisal of any national award for science and technology;
(2) Reporting appraisal results to the National Committee of Science and Technology Awards;
(3) Dealing with relevant problems which arise in the appraisal of any national award for science and technology; and
(4) Providing consultation opinions to perfect the work of national awards for science and technology.
Article 39. Each national appraisal committee of awards for science and technology shall have, respectively, 1 director, 2 ~ 4 deputy directors, 1 secretary general and several committee members. The candidate members thereof shall be suggested by the Ministry of Science and Technology to the National Committee of Science and Technology Awards and the post of secretary general shall be assumed by the director of the Office of Awards.
The national appraisal committees of awards for science and technology shall adopt an appointment system, in which each term lasts 3 years and no one may be appointed for two consecutive terms.
Article 40. Special project groups shall be established within the Appraisal Committees of the National Award for Technological Inventions and Science and Technology Progress to take charge of the appraisal of any secret project concerned with national defense or national security and report the appraisal results to the appraisal committees.
Article 41. According to the requirement of appraisal work, each appraisal committee of national awards for science and technology may establish several appraisal groups to carry out preliminary appraisal of the relevant candidate persons and projects of the national awards for science and technology and the preliminary appraisal results shall be reported to the corresponding appraisal committee of national awards for science and technology.
Article 42. Each appraisal group shall have 1 group leader, 1 ~ 3 deputy leaders and several members. The group leader shall, as a general rule, be assumed by a member of the corresponding appraisal committee of national awards for science and technology. Appraisal groups shall apply an appointment system to their members. The qualification for the appointment of members shall be determined by the Ministry of Science and Technology.
Members of each appraisal group shall be selected from qualified candidates by the Office of Awards according to the specific recommendation of national awards for science and technology in the current year, and shall be examined by the secretary general of the corresponding appraisal committee and reported to the director of the corresponding appraisal committee for approval. Members of the appraisal groups shall be rotated in light of a certain proportion annually.
Article 43. The Ministry of Science and Technology may entrust relevant departments to take charge of the daily work of the appraisal groups of the National Award for Technology Inventions and Science and Technology Progress concerning national defense and national security.
Article 44. Any member of any appraisal committee of national awards for science and technology who are unable to attend a meeting for some reason so that the normal work of appraisal is affected may be replaced by a member of relevant appraisal groups who shall enjoy equal rights with any other member of the appraisal committee. The specific candidates shall be nominated by the secretary general of the appraisal committee and shall be subject to approval by the director of the corresponding appraisal committee.
Article 45. Any member of appraisal committees of national awards for science and technology and the appraisal groups thereof as well as relevant working personnel shall strictly keep secret for the technological content and appraisal of any project which is accomplished by any candidate person or entity.
CHAPTER IV RECOMMENDATION
Article 46. The recommendation of the recommended entities as mentioned in item (1), (2) and (3), Paragraph 1, Article 15 of the Regulation on Awards shall be under the charge of the administrative organization of science and technology thereof.
Article 47. The expression "other entities" mentioned in item (4), Paragraph 1, Article 15 of the Regulation on Awards refers to the public institutions directly under the State Council, relevant departments of the Central Committee and other specially designated organs, enterprises, public institutions and social organizations, etc. which meet the requirements of recommendation.
Article 48. The expression "technology experts" mentioned in item (4), Paragraph 1, Article 15 of the Regulation on Awards refers to winners of the Top National Award for Science and Technology, academicians of the Chinese Academy of Sciences and Chinese Academy of Engineering.
Article 49. For the national awards for science and technology the limited recommendation system shall be adopted. Any entity of recommendation shall make recommendation within the quota as determined by the Office of Awards in the current year.
Each winner of the Top National Award for Science and Technology may recommend one person (project) of his own major for the national Award for science and technology annually. Three or more academicians of the Chinese Academy of Science or Engineering may jointly recommend one person (project) of their own major for the national award for science and technology.
Any entity of recommendation who recommends for the top awards of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress, shall, before recommendation, solicit the consent of 5 academicians or more who are familiar with the said projects.
Article 50. Any entity or person of recommendation who recommends for the top awards of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress shall, according to provisions of the present Detailed Rules, strictly control the number of candidate entities or persons.
Where the number of candidates of any significant comprehensive natural science discovery or technological invention exceeds the quota as provided, the entity or person of recommendation shall provide sufficient explanations in the recommendation letter of national awards for science and technology.
Article 51. Any entity or person of recommendation who recommends any candidate entity or person for any national award for science and technology shall obtain the consent of the said candidate entity or person, and shall fill in the recommendation letter in uniform format which is made by the Office of Awards, and provide necessary certificates or evaluation documents. The recommendation letter and relevant materials shall be complete, genuine and reliable.
Article 52. Where any entity or person of recommendation considers that the appraisal justness may be affected by the participation of relevant expert or scholar in the appraisal, it may require the avoidance of the said expert or scholar and, when he or it makes recommendation, provide written explanations and relevant certifying documents. The number of experts who are required to avoid the appraisal shall not exceed 3 for each recommended project.
Article 53. Where any dispute arises in intellectual property right or with regard to which entity or person has accomplished the project, the said project shall not be recommended to participate in the appraisal of national awards for science and technology before the said dispute is solved.
Article 54. Any project, for which a license shall be obtained according to provisions of laws or administrative regulations, and which directly concerns personal or social security or public interests such as new varieties of animals or plants, foods, pharmaceutical products, genetic engineering technology and products, shall not be recommended to participate in the appraisal of national awards for science and technology before the approval of the administrative organ is obtained.
Article 55. Any project with the same technological content shall not be repeatedly recommended to participate in the appraisal of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress in the same year,
Article 56. If any candidate person or entity fails to be granted any award after appraisal, but after the completion of the project or work, he has made a new substantial development in forthcoming research and development activities and meets the conditions as set forth in the Regulation on Awards and the present Detailed Rules, may be recommended again in accordance with the provided procedure.
Whoever participates in the appraisal for 2 consecutive years and fails shall not be recommended again unless an interval of 1 year has elapsed.
Article 57. Any overseas Chinese citizen or organization and any Chinese citizen in any foreign-funded organization in China, who independently or cooperatively achieves significant scientific and technological achievement, meets the conditions as set forth in the Regulation on Awards and the present Detailed Rules, and the main academic opinion, technological line of thought and research work of the achievement are put forward and accomplished by the Chinese citizen or organization which enjoys relevant intellectual property rights may be recommended as the candidate person or organization of national awards for science and technology.
Article 58. Any scientific and technological achievement that has produced a particular significance or great influence on the progress of science and technology, economic construction, social development and national security, may be recommended for national awards for science and technology at the opportune moment.
CHAPTER V APPRAISAL
Article 59. Any candidate entity and person who meets the conditions as set forth in Article 15 of the Regulation on Awards and the present Detailed Rules shall submit a recommendation letter and other relevant materials to the Office of Awards within the prescribed time limit. The Office of Awards shall take charge of the formal examination of the recommendation letter. For any recommendation material that disaccords with provisions, the Office of Awards may require the entity or person of recommendation to supplement and correct in a prescribed period. For anyone who fails to supplement or correct in the prescribed period or fails to accord with requirements after the supplementation and correction, the Office of Awards may refuse to submit the recommendation materials for appraisal and return the said materials.
Article 60. The Office of Awards shall publicize the list of candidate persons, entities and projects of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress, who have passed the formal examination on such media as the website of national awards for science and technology. If national defense or national security is concerned, it shall be publicized within a proper range.
Article 61. Any recommendation material that has passed the formal examination shall be submitted by the Office of Awards to the corresponding appraisal group for preliminary appraisal.
Article 62. The opinions of the relevant Chinese embassy / consulate or representative office overseas shall be solicited for the preliminary appraisal result of the International Science and Technology Co-operation Award.
Article 63. On condition of ensuring national security and the lawful interests and rights of the candidate persons and entities, the Office of Awards may invite overseas experts working in the same field to appraise and comment on the candidate persons, entities and projects, and submit the opinions thereof to relevant appraisal organizations.
Article 64. The candidate persons for the Top National Award for Science and Technology and International Science and Technology Co-operation Award who have passed the preliminary appraisal and the candidate persons or projects for the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress that have passed the preliminary appraisal without demurral or, in the case of demurral, whose demurral has been solved within the prescribed period, shall be submitted to the corresponding appraisal committee of national awards for science and technology for appraisal.
Article 65. The National Committee of Science and Technology Awards shall examine and approve the appraisal results of all appraisal committees of national awards for science and technology.
Article 66. The appraisal and voting rules of national awards for science and technology are as follows:
(1) The preliminary appraisal shall be carried out by way of network appraisal or conference appraisal, and the results thereof shall be obtained by registered ballots;
(2) All appraisal committees of national awards for science and technology shall carry out the appraisal by way of holding conferences and obtain the appraisal results by registered ballots;
(3) The National Committee of Science and Technology Awards shall examine and approve the appraisal results of all appraisal committees by means of conferences, wherein, the top awards of the Top National Award for Science and Technology, National Award for Natural Sciences, National Award for Technological Inventions, National Award for Science and Technology Progress and International Science and Technology Co-operation Award shall be subject to examination by registered ballots;
(4) The appraisal voting of the National Committee of Science and Technology Awards and all appraisal committees, appraisal groups shall be attended by a majority of 2/3 or more of all the members (2/3 included), and the result of voting shall be effective;
(5) Any candidate person of the Top National Award for Science and Technology or International Science and Technology Co-operation Award, and the top awards and first grade awards of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress shall be agreed to by a majority of 2/3 or more of all the members present at the meeting.
The second grade awards of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress shall be agreed to by a majority of 1/2 or more of all the members present at the meeting.
Article 67. The avoidance system shall be adopted for the appraisal of national awards for science and technology. Any appraisal expert who has an interest in any candidate person, entity or project as being appraised shall avoid the appraisal.
CHAPTER VI SUPERVISION AND DEMURRAL DISPOSAL
Article 68. The Supervision Committee of Science and Technology Awards which is established by the National Committee of Science and Technology Awards shall take charge of the supervision over the recommendation, appraisal and demurral disposal of national awards for science and technology.
The candidate members of the Supervision Committee of Science and Technology Awards shall be nominated by the Ministry of Science and Technology and shall be reported to the National Committee of Science and Technology Awards for approval.
Article 69. All appraisal committees of national awards for science and technology and the Office of Awards shall periodically make a working report about the recommendation, appraisal and demurral disposal of national awards for science and technology to the Supervision Committee of Science and Technology Awards. Where necessary, the Supervision Committee of Science and Technology Awards may require the making of a report on a special subject.
Article 70. Any entity or person who finds problems with the appraisal and demurral disposal of national awards for science and technology may expose or complain to the Supervision Committee of Science and Technology Awards. Relevant authorities that receive materials of exposures or complaints shall deliver the said materials to the Supervision Committee of Science and Technology Awards in time.
Article 71. The Supervision Committee of Science and Technology Awards shall make regular supervision and examination of the appraisal activities, and, for any expert or scholar who violates the Regulation on Awards or provisions of the present Detailed rules, may, in light of the different circumstances, suggest that relevant authorities make such treatment as ordering the said expert or scholar to correct, giving him a demerit, warning, circulating a notice of criticism, terminating the appointment or disqualifying him.
Article 72. The national science and technology awards shall adopt a credit appraisal system. The Ministry of Science and Technology shall establish credit archives for the experts and scholars who attend appraisal activities. The credit records shall be an important basis for nominating candidate members of appraisal committees and groups.
Article 73. The national science and technology awards shall accept the supervision of the general public. The appraisal of the National Award for Natural Sciences, National Award for Technological Inventions and National Award for Science and Technology Progress shall adopt a demurral system.
Any entity or person who holds any demurral against any candidate person or entity of national awards for science and technology and the project thereof shall put forward the demurral to the Office of Awards within 60 days of the publication of the projects that have passed the formal examination. Where it fails to propose a demurral within the specified period and has no justified explanation, the said demurral shall not be accepted.
Article 74. Demurrals are divided into 2 categories: substantial demurrals and non-substantial demurrals. Any Demurral, which concerns the innovation, advance and practicability, etc. of a project as accomplished by a candidate person or entity and the falsehood of the content as written in the recommendation letter, is a substantial demurral. Any demurral against a candidate person or entity and the arranged order thereof is a non-substantial demurral.
Any opinion of any entity or person of recommendation and any person or entity who has accomplished a project against appraisal grades shall not be classified into the category of demurral.
Article 75. Any entity or person who proposes a demurral shall provide written materials of demurral and necessary certifying documents.
Any entity or person who proposes a demurral shall indicate its real identification. Any person who proposes a demurral shall indicate his real name on the written materials of demurral. Any demurral that is proposed in the name of an entity shall be affixed with the seal of the said entity. Any demurral that is proposed anonymously shall not be accepted as a general rule.
Article 76. In order to safeguard the lawful rights and interests of any demurral maker, the Office of Awards, any entity of recommendation and the personnel thereof, and any person of recommendation, and other relevant personnel who participate in the investigation and disposal of any demurral, shall keep secret of the identification of the demurral maker. Where it's necessary to publicize the said identification, opinions of the demurral maker shall be solicited beforehand.
Article 77. The Office of Awards, when receiving any demurral material, shall carry out an examination over the content of the demurral. Where the demurral content falls into the case as described in Article 74 of the present Detailed Rules and sufficient proof is provided, the said demurral shall be accepted.
Article 78. Any substantial demurral shall be under the charge of the Office of Awards for collaboration, and the work thereof shall be assisted by the relevant entity or person of recommendation. The entity or person of recommendation, after the reception of demurral notice, shall verify demurral materials within the prescribed period and deliver and report the result of investigation and verification to the Office of Awards for examination. Whenever necessary, the Office of Awards may organize appraisal members and experts to investigate and put forward disposal opinions.
Any non-substantial demurral shall be put under the charge of the entity or person of recommendation for collaboration, who shall put forward its preliminary disposal opinions and report such opinions to the Office of Awards for examination. Any demurral disposal that concerns several departments shall be put under the charge of the Office of Awards for collaboration and assisted by relevant entity or person of recommendation. The provisions of the proceeding paragraph shall be applicable, by analogy, to the procedures for handling demurrals.
Where any entity or person of recommendation fails to submit a report of investigation and verification or any opinion of collaboration and disposal, the recommended project shall not be submitted for appraisal.
Any demurral which concerns any project of national defense or national security shall be handled by relevant authorities and the disposal result thereof shall be reported to the Office of Awards.
Article 79. In the process of handling any demurral, any party who is involved in the said demurral shall cooperate actively and shall not shuffle his responsibility or incur any delay. Any candidate person or entity who fails to provide relevant certifying documents in the prescribed period shall be deemed as admitting the demurral content. Any person or entity who makes the demurral but fails to provide relevant certifying documents in the prescribed period shall be deemed as giving up the demurral.
Article 80. The Office of Awards shall report the investigation results and disposal opinions of the demurral to the relevant appraisal committee of national awards for science and technology and submit for an decision of the appraisal committee of national awards for science and technology and inform the demurral maker and the entity and person of recommendation of the said decision.
The Office of Awards shall report the work of demurral disposal to the Supervision Committee of Science and Technology Awards in time.
Article 81. where any demurral is disposed within 60 days since the date of acceptance, relevant candidates may be submitted for the appraisal of the current year. Where any demurral is disposed within a year since the date of acceptance, relevant candidates may be submitted for the appraisal of the next year. Where the handling of any demurral lasts for 1 year or more since the date of acceptance, relevant candidates may be recommended again.
Article 82. Any entity or person who proposes a demurral shall not unlawfully submit any demurral material directly to any appraisal organization or the members thereof. Any member who receives the said demurral material shall forward it to the Office of Awards and shall not submit the said material to any appraisal organization for discussion or deliver to any other member thereof.
CHAPTER VII AWARD GRANTING
Article 83. The Ministry of Science and Technology shall examine the decision on the candidates, projects and grades of awards, which is made by the National Committee of Science and Technology Awards, and report to the State Council for approval.
Article 84. The Top National Award for Science and Technology shall be submitted to the president for signature with the certificates and prizes are conferred thereby.
The prize amount of the Top National Award for Science and Technology is 5,000,000 yuan, of which 500,000 yuan shall belong to the individuals themselves, while the remaining 4,500,000 yuan shall be used as scientific research fund for a subject as decided by the prize winner itself.
Article 85. The certificates and prizes of the National Award for Natural Science, National Award for Technology Inventions, and National Award for National Science and Technology Progress shall be conferred by the State Council.
The prize amount of the National Award for Natural Science, National Award for Technology Inventions, and National Award for National Science and Technology Progress shall be separately announced by the Ministry of Science and Technology in collaboration of the Ministry of Finance.
Article 86. The certificates of the International Science and Technology Co-operation Award shall be conferred by the State Council.
CHAPTER VIII SUPPLEMENTARY PROVISIONS
Article 87. The management of funds for the recommendation, appraisal and granting of national awards for science and technology shall be executed according to relevant provisions of the State.
Article 88. The present Detailed Rules shall come into force as of the date of promulgation.
